      In mid June of 2021 I responded to an ad posted on-line by Lumbermens for a **** ********* portable sawmill. They requested a $******* deposit which they received 6/22/2021. Lumbermens gave me the tel. # of the owner, ******* S*******. When I called I was told the **** wasn't ready. I agreed to wait a week or two. Finally months passed *** I asked for a refund by email and phone message. They don't answer my calls. Find in the attached documents that ******* ******** admitted to me and Lumbermens that the **** wasn't supposed to be listed and they misrepresented the condition. They never offered to ship it, **** not respond when asked for a legitamate refund.

      Business Response /* (**00, 5, 2021/**/29) */ The customer never went and inspected the ********* he instead waited 2 months and decided that he no longer wanted the mill, and in turn wanted us to return his deposit. We made it clear (as per recorded conversations and signed contracts) that the deposit would not be refundable since he never physcically came to inspect the ********* as is stated on the invoice. The buyer then told us that he did still want to buy the mill, but was un happy with the price, and we told him, it was non negotiable. The mill is still available for purchase, and everything works, but Mr. ***** has declined to purchase the mill after further talks. Consumer Response /* (3000, 7, 2021/11/01) */ (The consumer indicated he/she DID NOT accept the response from the business.) 1) Lumbermens claim about not physically inspecting the ** ** mill. The round trip is ** hours and after speaking to the owner, ******* ********, he told me IT WAS NOT Ready, nor was the machine as described. It needed parts, was not towable, no brakes etc.. I had made arrangements in June 2021 to pick up the machine which I had to cancel. It still wasn't ready for 3 months. ******* admitted the machine WAS NOT supposed to be listed by Lumbermens as it WAS NOT ready. I would like to hear the recording of the description Lumbermens gave me. 2) Again, they misrepresented the ** **, which is fraud. They told me their representative viewed the machine and it was so good he wanted to buy it. Mr. ******** told me that NO ONE from Lumbermens ever viewed the machine. Another lie. Lumbermens also told ******* that they were willing to truck it but that is a lie. I needed the machine in June, that is what I was paying for, not a machine that couldn't be towed hundreds of miles. I should also mention that this is a **************** with wheels. I wasn't buying a stationary machine and Lumbermens is well aware of that fact. I was paying a premium price for a machine that was ready to move to job locations and use immediatly. I have not spoken directly to Lumbermens for months. I never asked to negotiate a new price. I did tell ******* when I spoke with him when it wasn't ready that I'm not in the business of loaning money, the *K deposit I paid, to Lumbermens for brokering the machine under false pretenses. Simply put Lumbermens is trying to say because I didn't view the machine they **** not refund, but again why would I when the owner said it wasn't ready and he had no time to fix it. I was willing to wait a short time, a week or two, NOT 2 months. After reading Lumbermens reply I can only conclude they are trying to defraud me of *K. I **** attach all of my emails with Lumbermens and all of my email communication with ******* ********. 3) Lumbermens in their original internet ad only had 1 vague picture of the machine from a distance. ******* ******** sent me all pictures he sent to Lumbermens which would have illustrated to a potential buyer the reality but Lumbermens purposely didn't include them. More fraud.
