We purchased a house under construction from Mark R******* in 2022. We have given him much grace on many items (like the radon gas leaching into our home, roof patch, 6” unconnected HVAC vent to nowhere - conditioning our crawl space). Our concerns are actually even more serious. My husband repeated told Mark during construction that drainage would be a problem because of the large hill beside us. Mark reassured us that he would be able to grade away from the house. Unfortunately, the house was built a few bricks short and the air vents literally sit on the ground - making it impossible to build up the dirt to grade away from the house. There were no extra steps taken because of the hill (he’s been in construction a lot of years he should have the knowledge) - like plugging holes at the foundation, sealing the foundation to make it waterproof, applying a dimple mat and drain to redirect the water - things we are now paying for out of our pocket, because he wouldn’t even come out and review it with us. Mark told us it was not a problem to have shin deep water in our crawl space. The heavy rains were “unusual”. Heavy rains are coming and certainly have been very common in the last few years, flooding has been repetitive and we are now paying for fixes to stop these huge amounts of water that will dryrot the beans supporting our home and cause unhealthy mold in the crawl space. He has refused to help financially in any way. Mark requested we ado our neighbor to drive on their property with a cement truck for a patio to avoid our leach lines. Instead, Mark supervised the cement truck not only driving and sitting on our leach line, but he also built a cement patio, in the wrong spot, on top of my leach line as confirmed by TDEC. Mistakes can happen and we gave him a lot of grace. But he has refused to acknowledge the problem or be part of the solution. We are so disappointed. We have pictures, documentation, professionals that we have hired to resolve This.
