I contracted with Ever-Seal to seal my concrete patio. Now, five months later, it is looking the same as before sealing. I have green mold and dirt stains that wont wash off, though I was assured they would. I think there are at least a couple of areas that need to be resealed, but the company refuses to do so. They claim (incorrectly) that there is no warranty coverage for this based only on photos I sent. They could and should have sent someone to look at it before denying the claim. Looking at all the other complaints filed by customers that have gone unresolved, I am amazed the BBB gives this company such a high rating.

We have spoken to customer. He wasn't in agreement with our response. Our seal is not a top coat. It is a penetrating seal that protects from the inside out. The top 1/8th is still open to the elements and will get dirty and depending on how much moisture the surface gets, mold may develop. It must be washed more in the areas that get a lot moisture to keep it clean. There is never a reason to re-seal once our seal is applied . It will last at least 25 years.

      Business response

      01/16/2024

As explained to the client, and also explained in our presentation and paperwork, Ever-Seal is a penetrant that is designed to fill the pores of the concrete from the inside. The excess is designed to evaporate off at the surface leaving the top 1/8th inch or so as exposed concrete as to not leave a slippery finish. This also allows clients to stain, paint, or apply a top-coat if desired. The curing process will push anything not removed during the cleaning process to the surface. Since Ever-Seal expands inside the concrete, it is not possible that the concrete was not sealed properly as the client has stated. Our process applies our sealer in both directions, intentionally over-sealing our projects to prevent this from ever happening to our clients. After reviewing the before and after pictures, along with the pictures the client sent in, there is a clear path of red clay **** (which has a dye in it) being tracked by the dogs. The green spot does not appear to be mold, but something from a spill or urine. With what's being track across the concrete, I would recommend soaking the area down with a heavy duty concrete cleaner and thoroughly powerwashing. This will be easier since they're only having to clean the surface due to teh rest of the concrete being Ever-Sealed. I would also recommend applying a strong top-coat to help resist future staining.

The company signed a contract with me on 6/5/2023. The installation was to take place with six weeks. The company has now reached out to me three times to reschedule. The last time was today, forty five minutes before the ******* time to complete install. The company has no credibility, and I seriously doubt the y ever intend to complete this process. I have requested a refund of my fees, and to cancel the contract. I am being given ******** about being outside of three days.I am now waiting on a call back from upper management. I doubt this will ever happen.

On June 29, 2022 I signed a contract to have deck sealed. The salesman informed me it would be completed within 30 days and the office would call to confirm a date. Multiple calls to the office for an appointment were not returned. On July 8th I contacted my salesman for assistance and I was contacted and given a date 60 days out (8/29/22) from order. The scheduler told me they were short handed & had a new crew going through training and that if they got trained up we may be able to complete it early but Aug 29th was confirmed and would not be later than that date. I agreed to the delayed appointment. Yesterday, 8/25/22 I was contacted and told that my appointment for Monday needed to be rescheduled for October. I told the lady on the phone that date is not acceptable and not in line with what I purchased. I told her I wanted a refund of my $2907 deposit. She said that "******" would have to call me back however no call was returned. I contacted the office and ****** refused to talk to me and relayed a message that "****** ******" the GM would call me on Friday morning. It is now past noon and I have received no call from ****** and my call to the office was met with "he is not available". I attempted to drive to the office and speak with someone in person but there was no business at the address *** W **** ******, **************, TN. At this point, the company has not upheld the contract that I entered into in good faith. I have no confidence in the integrity of the company and request a refund due to their failure to uphold their end of our agreement.

Business Response /* (1000, 10, 2022/09/24) */ Ms. ****** was scheduled for 8/29/2022. On 8/25/22 we did have to reach out and attempt to reschedule her installation to a date in October. She was very upset with this and asked for an earlier date. Shortly after this we were able to move some things around and offer a date of 9/12/23. Ms. ****** accepted this date, and her installation has been completed. ************* Ever-Seal Inc

I had the Ever-Seal process applied to my brand new wooden backyard deck in March 2022. By July 2022, black mold was observed throughout the deck. When I called Ever-Seal, I was told to send in photos of the mold to the link they sent to my phone. I did that but never heard back from the company. Five days later I reached out to the salesman. He told me he would check with the office to see what they were doing. Four days later I had not heard back from him and sent him another text, but he did not respond. I phoned the company and was told they would send an email to the person in charge of applications and I would receive a call. When I asked when I might expect a call back, the receptionist was noncommittal. The mold continues to spread on the decking each week.

      Business response

      08/01/2022

Business Response /* (1000, 5, 2022/07/26) */ After locating and reviewing the pictures sent in, it is very clear that this is not a black mold issue. With the amount of direct sunlight this deck receives this will never be an issue for this particular deck, even if it had not been Ever-Sealed. I contacted Mr ******** personally to let him know that what he's seeing can be one of two issues. The first is that our sealer is a penetrant that will push out any dirt remaining in the deck to the surface during the curing process. Normally the rain will wash this off naturally, but we haven't seen much rain lately in this region. Some of those spots are likely just dirt or pressure treatment chemicals that have pushed up to the surface. The second and most likely issue is just the natural greying of the wood which is the wood's natural defense against UV light. This is why all of the trees are grey. Ever-Seal is designed to evaporate off the excess sealer at the surface as to not leave a slick finish which could be hazardous. The top 1/8 of an inch or so is still exposed wood, which allows clients to still stain or paint if desired, but also leaves the wood susceptible to the wood's natural darkening. Since this issue is only able to occur at the surface versus going deeper into the wood as it would had it not been Ever-Sealed, it normally cleans up easily with just a deck cleaner and a garden hose (as we recommend annually in our statement of understanding given to all of our clients). With the amount of sun hitting this particular deck, it may need to be washed more often to keep the desired appearance, or a top-coat with a high UV protectant can be used as well (basically like applying sunscreen to greatly increase the amount of time needed between washes). Mr ******** said that he would try giving it a wash with a deck cleaner and see if that worked. I asked him to call me direct if it doesn't and I'll be happy to stop by when I'm traveling through his area for a charity event in a month or so. Looking at decks and driveways for well over a decade now, I'm sure that a light washing will clear it right up for him though.

We had ever-seal come out and clean and seal our driveway. They did so but after the 1st winter it was already looking bad. They came back out and cleaned it off again but didn't come back out an reseal. After several promises they eventually said they would come July 5 or 6 to seal it. They never showed. I just keep getting the run around when I call them. At this point I'm tired of dealing with them and want my money back since they will not honor their 25 YEAR WARRANTY.

A representative from Ever-Seal came to my home to provide a quote on service. My interest in the product was exclusively to limit growth coming through my patio, which the representative **** ******* assured me the product would perform. After purchasing the service, a month or two later, there was already new growth pushing through the pavers. I attempted to contact ****, and received no response. I reached out to the business office directly, and a different representative (who indicated he was the Ops Mgr for the company) came and reviewed the situation. He agreed that the claim that their product would perform the requested purpose of stopping growth was false, and that **** had misrepresented the product. He asked for "a week or so" to get back to the office and process a refund. After that, I heard absolutely nothing from the business. My follow-up emails have been ignored.

      Business response

      07/06/2022

Business Response /* (1000, 5, 2022/06/29) */ Ever-Seal was contracted to permanently seal the concrete pavers for this project which is what we did. Ever-Seal is not an herbicide, but can only keep moisture out of the pavers. We've reviewed the pictures and came back out for a site visit and can clearly see what the problems are. The weeds are coming from mowing debris and through the mortar joints, not through the pavers themselves, so I'm not sure why he would be asking for a refund. Any homeowner has seen weeds grow in little to no soil or water in cracks, on walls, in gutters, etc. He needs to put down weed killer, re-polysand it, and then keep it blown off after mowing to prevent future weeds. If it's holding water at the surface, he'll still see some growth occasionally though. This was explained via email in October of last year. No refund was ever promised since that would have had to be approved by the CEO, nor should it have been after we performed our work per the contract (which I've attached). Consumer Response /* (3000, 7, 2022/07/03) */ (The consumer indicated he/she DID NOT accept the response from the business.) There is no debate that the product does not stop plant growth, and I can't speak to the refund process within this business. My complaint is with the blatant misrepresentations made by the employees. I told **** my only interest in a sealant product was to stop plant growth in my patio, and showed him examples of my concerns. He said it definitely would address my concern, and that Ever-Seal would come right out to fix it if there were any places it didn't. He lied about your product to get my money. When I started making contact in July '21, it wasn't until October that I got a response. The ops manager came to my home, reviewed the situation, agreed that **** had misrepresented the product, and said he would need to return to the home office to process a refund, which he estimated at slightly over a week. After over a month with no response, I started reaching out again to the business, and received absolutely no response. Indeed, the only way I have heard anything from the business is going through the BBB. If the sales rep had not lied, I would not have bought the product. If the Ops Manager had not lied, I would have at least had more realistic expectations for the business response. If the employees who are responsible for responding to customer complaints had responded, I would not have had to come out to third parties to get a response. Ever-Seal has been unprofessional, negligent, and dishonest in their dealings with me, and I will make sure that other consumers are made aware so that they are not similarly exploited. Business Response /* (4000, 9, 2022/07/06) */ We service thousands of clients every year. You will not find another client among them that will say that we claimed to "stop plant growth on a patio". The reason for this is that we do not make false claims regarding our services, nor do we need to. By making the pavers non-porous, we can deter mold and mildew growth since the pavers will dry out more quickly. However, the weeds growing into your patio are NOT growing through the pavers that we treated, but from in between the pavers. Ever-Seal is a penetrant, not a filler, grout or top-coat that would fill in the gaps in between. From the pictures we've seen from your project, the cause and treatment are pretty clear. It appears that your paver patio was laid without an adequate weed barrier laid first, and that lawn debris is accumulating in the area leaving it prone to weed growth. Neither of these things would be in our control, nor would be just cause for a refund of services rendered. As for items that are important to our clients outside of our normal service, our estimators are trained to identify those concerns in writing on our work order that you signed. This was not the case as it is for any other client, but only states that we will be cleaning and permanently sealing your patio pavers and backing with a 25 year warranty. Furthermore, our operations manager that visited your project for follow-up would not have offered you a refund no matter how much you demanded one since that is something that would have to be approved by the office. One of your earlier emails stated that he was "checking" on it for you. We have very few complaints so I remember reviewing your account clearly and the refund was not approved due to the fact that we performed our services fully as contracted. **** forwarded this decision to you via phone attempt first, and then by email. You may need to check your spam filter though. The three months to respond is not accurate either since when you first contacted us we asked that you allow it the 90 day cure time so we could accurately evaluate the issues on our follow-up. We came back out almost exactly 90 days after the installation. Your accusations do not accurately describe our company or the way we do business. While I'm sorry that you feel that you have been wronged somehow, Ever-Seal performed the work that we were contracted to perform. We've paid for the advertising, the labor, the gas, the chemicals, the equipment, the insurance, and even an extra trip out to your account just to verify that we had done the job that we were supposed to do. That being said, the request for a refund is not a reasonable request. Given that it has been over a year since your initial presentation with ****, I believe that you believe you were told something beyond what we cover in the over 1500 presentations that each one of our estimators do each year, but I can only fall back on the contract that we both signed. **** has maintained his claim that no "plant growth guarantee" was ever given or implied, but again, our legally binding contract is what we have to defer to. I also understand that "deters mildew growth" and "stops plant growth" may sound similar, but one is a claim that we would never make, nor should you do business with any company making such an obviously false claim. Any local reputable lawn care company should be able to recommend some type of extended control weed killer that should be able to address this issue for you in your part of the country going forward. A local co-op likely has some effective products as well. Either way, your pavers will be sealed for the next 30-50 years with the first 25 years under warranty.

I paid over $4000 to have my deck in Gallatin, TN sealed. The company did not sand the deck prior to sealing and came back out months later to sand it. It was guaranteed to protect deck from rotting, etc. Deck has since developed mold, rot, algae stains, warping. I now need to have deck totally replaced. Business Response /* (1000, 5, 2022/01/12) */ We do not offer sanding as part of our standard service. We came to sand in order to satisfy the customer's complaints due to aesthetic reasons. Ms. ***** did fill out a statement of understanding with her contract that informed her we do not ensure 100% acrylic removal, and our product is a penetrating protectant rather than an aesthetic product. Our technicians and operations manager have returned to Ms. *****'s project many times to ensure satisfaction, and Ms. ***** did report some surface algae (which we cleaned off as a courtesy), but no other issues. We have made every effort to satisfy Ms. *****, even though her aesthetic expectations exceeded our service. Consumer Response /* (3000, 17, 2022/02/15) */ I still do not understand why this case is closed? I received no satisfaction from business and I did reply. It says I did not. Business Response /* (4000, 19, 2022/02/15) */ The case was closed by the BBB because Ever-Seal has provided ample evidence that they have more than fulfilled their contractual obligations for the services you agreed to in writing.

I am filing a complaint against Ever-Seal, Inc. due to the quality of the product/services failure to clean our deck according to their contract statement and for Ever-Seal's subsequent damages to our deck wood, railing metal spindles and landscape lighting on 9-17-2021. The contract with Ever-Seal states "Work to be completed: Clean deck floor and steps thoroughly & restore to natural color. 10/22/2021

Business Response /* (1000, 7, 2021/10/12) */ Ever-Seal was hired to clean and seal their deck and rails. Ever-Seal completed this per our agreement. The client understands that her balance of $2459 was due at the time the project had been sealed, which she has not done and is now in breach of her contract and subject to civil litigation in ****** County TN per her contract. The client signed and initialed a statement of understanding (attached) that states - 1. Objects in and around service area will be masked off and protected as needed during the service process. Ever-Seal cannot be responsible for loose or chipping paint removed during service. Any areas of concern should be addressed with installer prior to start of service. 2. Surrounding areas will get wet and dirty during cleaning. Upon completion, Ever-Seal will rinse those surfaces (i.e. siding, plants, sidewalks, cement patios, etc.) 3. Should any previously unidentified coating or stains be discovered during the cleaning process, Ever- Seal will make every effort to remove said coating/stain but cannot guarantee complete removal. Ever-Seal does not guarantee 100% removal of all coatings, and it is not required to properly seal. 4. Some splintering can occur during service. Obvious splintered areas can be sanded after the wood has been sealed and dried. Ever-Seal will not be responsible for sanding an entire structure to make it splinter-free, and can only address areas damaged due to service errors. 5. The service process may cause the wood to appear fuzzy. This will subside during curing process. The client understands that the curing process will take up to 90 days, in which time most "fuzzing" will subside. We have offered to come back out to sand down any obvious areas, but the client has refused to allow us to do our job. I am also perplexed as to how our garden hose used to fill our water tanks was able to break the glass in all of her landscape lights when the manufacturer states that the lenses are made of weatherproof protective hammered plastic and not glass at all. These are also sold individually and in 2-packs as well since there is no way that we could have "broken" all 8 of them from stretching a rubber hose across the ground. Ever-Seal makes it a practice to exceed all of our clients reasonable expectations. We actually do a great job of this 99% of the time. As in any service industry, mistakes can happen, but we will do our best to rectify these issues in a timely manner. To do this, the client must allow us to come back out to do our job. The project is still in the curing phase (90 days) which will help loosen any remaining paint left on the project. The client can contact our operations manager, Marc G*****, to schedule us to come back out with our sanders for any severe splintered areas. Any fuzzy appearance from the fibers lifting during the cleaning process will subside over the curing process. The lights, we would be happy to replace as soon as I can understand how we broke glass in a plastic lens. Also, the $100 to push the connections on to a wire is robbery. And the spindles, since nothing we use is "blue" I'm not sure how we left a blue film, but we do carry some 300 to 1000 grit sandpaper that will easily remove any residue without damaging the spindles. She just needs to return Marc's call to resolve these items and pay her balance owed so we can schedule our crews to come back out. When I called to schedule a date, I was told by (1) Ever-Seal's main office that they rejected our project after reviewing Brad's pictures and specs. Mr. N*****, our project was rejected by your company so why wasn't the contract cancelled? Then Brad asked to re-do the test on the same spot. On 9-17-21, two crews came to our property and tried to remove paint from 8:30 am until 7:00 pm. The crew chief, Thomas, said that they were stopping the job because (2) the deck had already been damaged from the paint removal process and they had to stop before any more damage was done. No, we were not told this so we do not 'understand' We have offered to come back out to sand down any obvious areas, but the client has refused to allow us to do our job. See details above about my conversation with Marc. Marc said he would ask Mr. N***** to call me but he never called me or emailed me and that's when I contacted the BBB for help since we were not convinced that Ever-Seal could successfully finish the job without reconciling issues with Mr. ******. Pg. 2 of 2 I am also perplexed as to how our garden hose used to fill our water tanks was able to break the glass in all of her landscape lights when the manufacturer states that the lenses are made of weatherproof protective hammered plastic and not glass at all. The hose hit the light and broke the plastic piece. Note: I did not know you could buy just 2 replacement lights, so thank you for that information. Ever-Seal makes it a practice to exceed all of our clients' reasonable expectations. We actually do a great job of this 99% of the time. As in any service industry, mistakes can happen, but we will do our best to rectify these issues in a timely manner. To do this, the client must allow us to come back out to do our job. Mr. N*****, your crew really tried their best but now I need the finished job to exceed our expectations. The project is still in the curing phase (90 days) which will help loosen any remaining paint left on the project. The client can contact our operations manager, Marc G*****, to schedule us to come back out with our sanders for any severe splintered areas. See previous comments Any fuzzy appearance from the fibers lifting during the cleaning process will subside over the curing process. The lights, we would be happy to replace as soon as I can understand how we broke glass in a plastic lens. Also, the $100 to push the connections on to a wire is robbery. I purchased the two-set replacement, but the wire has to be dug up and rewired to the existing wire. And the spindles, since nothing we use is "blue" I'm not sure how we left a blue film, but we do carry some 300 to 1000 grit sandpaper that will easily remove any residue without damaging the spindles. See 2.a. above She just needs to return Marc's call to resolve these items and pay her balance owed so we can schedule our crews to come back out. Importantly, Brad told us before we signed the contract that the balance was due when the project was completed and we were satisfied - NOT BEFORE. ____________________________________________________________________________________________________________ I'm asking you, Mr. N***** to help my husband and I be reassured by you that our project will be successfully completed and 'exceed expectations'. I look forward to hearing back from you. Sincerely, ******** ****** ****** *** ********* ***** ***** ** XXXXX **********@gmail.com XXXX-XXX-XXXX NOTE: I am uploading several pictures so that you can view them in color - not black and white. Business Response /* (4000, 12, 2021/10/20) */ Again, We just need to have our operations manager be able to come out to evaluate the project to determine the best course of action moving forward. We do have a strong desire to make all of our clients happy, within reasonable standards of course.
