On Friday March 31, 2023, ************************* hired *********************** from SchayCo Construction, LLC to tear out the old driveway and put in a new driveway from the street to the backyard shed for $10,400.00 at his rental property at *****************************************************. The total job was completed that day, but ***** noticed that the left side and the right side on the bottom apron did not match. The left side was straight and the right side was curved correctly. The following Monday April 3, 2023, SchayCo redid the left side portion to match up with the right side. It looked patched and eventually cracked. Over the course of a month or two, the crack got worse and SchayCo had to put crack sealer into the crack. But it did not fix the problem. The crack still showed and looked bad. *********************** said that he would redo the whole bottom driveway apron up to the sidewalk to the street in July 2023. *********************** will not come back out to redo the cracked driveway apron. Called, sent texts and then finally wrote an email on August 22,2023 trying one more time to schedule a time to replace the bottom driveway apron. In the last month, ***** has also notice another small crack starting to form on the other right side of the apron.

***** hired Schayco to redo his driveway and apron.  When we tore out the apron he asked if we could redo the curb next to the apron because it was broken (which was not part of the original quote) but we agreed to fix it for him at his request at no extra charge since we had the apron tore out already.    The next day he liked everything but that the new curb didnt match in color to the other side and he asked us if we could do the other side to match.   Which because he seemed nice we did that extra curb for him three days later at no extra charge and he was notified before that if we put up new concrete without expansion joint that it will crack and wanted it done regardless to match the other side.   Now that there is a crack there on the curb.he wants the entire apron redone for free  (that I do not agree to redo) because of curbs we did extra for him which were not part of the original contract.  He has been notified that we can redo his apron at charge.  Also notified him that it would look very bad to redo the apron because it would make his driveway a different color than the apron which would make it look substandard.

      Hi *******,

Thank you for calling me back yesterday and it was great talking with you!  I wanted to go ahead and response to the Message From Business, since I feel it was not the real story.  I've responded to parts of their message with my responses in < *****  Thanks again *******!

      Message From Business:

***** hired Schayco to redo his driveway and apron.  When we tore out the apron he asked if we could redo the curb next to the apron because it was broken (which was not part of the original quote) but we agreed to fix if for him at his request at no charge since we had the apron tore out already.  <*****:  I flew into ******* from my home in LA to oversee redoing the driveway.  I wanted to make sure everything was done right.  I was on site about the whole time and left in the afternoon to run an errand.  When I came back to the site, they had finished the whole driveway, but the left side of the apron did not match the right side like the original driveway.  Holden Schay was not there.  I asked the ******* and he said that he usually does all the side work on the aprons, but someone else had done it.  I asked him why?  He said, I don't know why he did it that way, but it did not match the right side.  The ******* did the right side.>  The next day he like everything but the new curb didn't match in color to the other side and he asked us if we could do the other side to match.  <*****:  I did like everything about the driveway, but the left side of the apron did not match the right side.  I never mention about color, but did mention that the right side was curved correctly and left side was done wrong and was straight.  It looked bad.  The pictures I submitted shows that.  I asked *********************** if he could fix that and said that he could meet me Monday to tore out the straight area and put in new concrete to match the right side.  I was very concern about doing that, because it would look patched.  I didn't not want it to look patched.***** Which because he seemed nice we did that extra curb for him three days later at no extra charge and he was notified before that if we put up new concrete without expansion joint that it will crack and wanted it done regardless to match the other side.  <*****:  They finished the job on Friday afternoon and I called *********************** first thing Saturday morning to tell him I was very unhappy about the left side of the apron.  It was done wrong.  They did come out Monday, three days later to repair and fixed the right side apron to match the correct right side.  The best solution because of it looking patched would of been to redo the whole apron at that time.  Now that there is a crack there on the curb....he wants the entire apron redone for free (that I do not agree to redo) because of curbs we did extra for him which were not part of the original contract.  <*****:  After they had patched and ***** the left side to try to match the right side it cracked.  The crack was very noticeable on the left side.  Schayco came back out and try to fix then put in crack filler, but the crack was still noticeable.  The driveway was only a few months old.  It did not look good.  After many calls and text, *********************** said to me if you are not happy *****, we'll come back out and redo the whole apron.  I said, I'm not happy let's redo the apron.  I asked when can we redo it and ****** said July.  I included a text in my original report showing him trying to set a date to **** the apron along with a client job down the street.  July came around and we had a day set to redo it, but he came back and said I should just leave.  I was very upset about this last minute decision not tor redo it.  I had told my tenants about moving their cars etc.***** He has been notified that we can redo his apron at charge.  <*****:  ****** never notified me that there would be a charge.***** Also notified him that it would look very bad to redo the apron because it would make his driveway a different color than the apron which would make it look substandard.  <*****:  ****** did mention that the two parts would be different color but I'm more concern about the bad crack and the new crack is now forming on the right side.  I still wanted them to fix and repair their mistake by putting in a whole new apron.  Just recently, I had five different quotes done to see about the cost of redoing the apron.  None of the Contractors mention the different color, but did mention using rebar, dowels and mesh, so it wouldn't crack in the future.  My Attorney and I have decisioned to take Legal Action toward Schayco.>

I am rejecting this response because:

MESAGE FROM BUSINESS and MY RESPONSE:

***** hired Schayco to redo his driveway and apron.  When we tore out the apron he asked if we could redo
the curb next to the apron because it was broken (which was not part of the original quote) but we agreed to fix
it for him at his request at no extra charge since we had the apron tore out already.

<*****:    I flew to ******* from my home in LA to oversee the redoing of my rental driveway.  Wanted to make
sure everything was done right.  I was on site about the whole time and left to run an errand.  When I came back
to the site the whole driveway was finished, but I noticed the right side and the left side of the apron was not done
the same.  The right side was done correctly, but the left side was done wrong.  It was straight and not curved like
the right side as it was with my original driveway.  I asked the ******* and he said, I dont know why he did it that
way.  The ******* did all the repair work on the right side apron, but someone else did all the repair work on the
left side.  The ******* told me that he usually does all the side work on all the driveway aprons.  Holden Schay
      was not there.

The next day he liked everything but the new curb didnt match in color to the other side and he asked us if we
could do the other side to match.  Which because he seemed nice we did that extra curb for hime three days
later at no extra charge and he was notified before that if we put up new concrete without expansion joint it will v
crack and wanted it done regardless to match the other side.

<*****:    I did like driveway except that the left side was done wrong.  ****** was not there Friday afternoon,
so first thing in the morning I contacted *********************** to let him know that I was very unhappy about the way the
left side was done on the driveway.  Pictures that I submitted in my complaint report show the left side was done
wrong.  He agreed to meet on Monday morning, three days later after the job was done to look at tearing out part
of left side of the apron to match the correct curved right side.  I stated numerous times that I did not want it to look
patched as it was a brand new driveway.  The best solution would of been to fix the mistake by replacing the whole
apron.  After they patched the left side, the patch work started to crack.  It looked very bad being it was a brand new
driveway and only a two months old.  I contacted *********************** about the crack.  He came out and put in some crack
sealer, but it did not fix the problem.  It still looked cracked and looked bad.

Now that there is a crack there on the curb.he wants the entire apron redone for free (that I do not agree to
redo) because of curbs we did extra for him which were not part of the original contract.  He has been notified
that we can redo his apron at charge.  Also notified him that it would look very bad to redo the apron because
it would make his driveway a different color than the apron which would make it look substandard.

<*****:    I contacted Holden Schay about fixing the crack.  He said to me if youre not happy with it *****, Ill
replace the apron.  I said, that I was not happy and lets replace the apron and asked him when can you do it.  He
told me July and I said okay.  He never mention that there would be a charge.  With numerous calls and texts he
settle on a time to redo the apron along with a client job he was doing down the street.  I included a copy of a text
of that in my complaint report.  I said that could work and can I tell my tenants, so they can move their cars.  He
said yes.  When it got time to redo the apron at the last minute he tells me, you should just leave it and that the
color wont match.  He didnt want to do it.  I still wanted it done, because it was cracked.  *********************** told
me he was going to fix it and replace the apron.  Plus, a new crack is forming on the right side.  Just recently, I
got five different quotes on replacing the whole apron.  None of the Contractors mention the different color, but
they did mention that they should of used rebar, dowels and mesh to keep it from cracking.  I made contact on
Aug 22, 2023 by text and email to see one more time about fixing this problem.  He responded by saying good
luck with your driveway.  I decided to give him another six weeks of time to contact me back and fix the problem.
Since I did't hear back anymore from him, on Oct 2, 2023 I filled a complaint with the ********* *************************************** when I found out he did not have the required ***************************** or Bond.
On Oct 3, 2023 I filed another complaint with the Better Business Bureau.  At this time, my Attorney and I have
      moved forward with legal action.

      Sincerely,

      *************************
