Date of transaction: March 25, 2017 (actual date of contract signing) Amount of money paid: $28,500.00 (unsecured loan) for 1 acre lot. The business committed to provide: I made my intention known that I would place a Boat and Camper on the lot to fish from Lake Greenwood. Saleswoman said I must purchase a lot to fish on lake, but did not tell me that a boat or camper could not be put on the lot. Nature of dispute: It was months (year) later that I was told boat or camper are not allowed on lots and that the saleswoman should have told me that at the time. Whether the business has tried to resolve the problem: No, neither Grand Harbor Resort, Grand Harbor Club in Greenwood, SC., or Woods & Water Realty LLC., Knoxville, TN have committed to do anything; with the exception: (1) Grand Harbor & Club states that it the fault of Woods & Water Realty (hired to make sales for Grand Harbor), if they didn't provide and go over the By-Laws with me at the time of sale I need to discuss this problem with them. (2) Woods & Water Realty Representatives stated that yes, these By-Laws I should have received at time of sale. I replied that they were sent in the mail to me in July 2017 (months later) asking me to sign and return them so I signed and sent them back. Yet even at that time I was unaware that a boat or trailer could not be placed on the lot. I would not have purchased the lot knowing I could not have the boat and camper on it. I am seeking the money spent in membership dues, estate taxes, Club and POA fees, and maintenance fee for upkeep of a lot I can't use.Initial Complaint

I was solicited for a land sale in Franklin NC by Woods and Water Realty. Met them onsite 10/22/22 to look at properties.Multiple times we asked about lots being perc tested/soil tests and was assured they had been done but "didn't have them on site but would get them". They required a deposit that day. I contacted the health department in Macon Co NC the following week for the soil test on file but was told there were no soil tests for any lots on file. I worked with David *********n and Chip ******* at the sale and David said it was ok to delay the closing (set for Nov 7th 2022) while he gathered information. After several communications on my part he put me to the "owner" Jason Benton who also confirmed he would get me the information. He stated on 4/17 that if he couldn't get the documents needed in two weeks he would happily refund my earnest money (nearly $10K).I waited 6 weeks with no response from him. Jason went weeks without contact multiple times. Jason passed me to the developer Don **********. After a month of trying to get in touch with Don he assured me all of my concerns would be handled and passed me back to Jason. They set a closing with Southern Law for April 26 but two days prior that law office stated there would be another delay due to them not having a survey on file with the county. I asked again for my earnest money back as they could not provide the documentation and it had been nearly 8 months they have held on to my money. I advised Rose at Southern Law that I wanted to back out of the deal with the seller being in breach on many levels and was told they weren't interested in refunding my EM. I then reviewed an email from Cunningham Law telling me they were going to pursue legal action since I was in breach. I spoke with their attorney Daniel ***** who is looking into it with his client. I have also reached out to the North Carolina Real Estate commision and opened a case as well. Jason Benton has not responded since mid April.Initial Complaint

I put down a deposit for a land purchase and was assured multiple times by multiple parties that I would receive a refund of my deposit if I was unable to obtain financing for the purchase. I was lied to about several aspects of the deal, including how much more I would need to pay in order to secure funding, which was over $7,000. Jason ****** even misled me on which company he worked for, as I was told the name was ****** **** ***** Woods & Water stole $2,650 from me. Despite multiple attempts to reach him through various channels, he has avoided all contact with me and has not responded to any demands to return the deposit he coerced me to give him through lies and deception.Business response

Dear Sir or Madam,
Apologies for the delayed response. I am Daniel J. Chung, an attorney licensed in the State of Tennessee, and I represent Woods & Water Realty LLC ("Woods & Water") as to a variety of matters. It was my understanding based upon the date of receipt of *** ********* BBB Complaint by Woods & Water that the requisite response was due today, March 2, 2023.
Despite that, on Woods & Water's behalf, I have been in touch with Ms. J****** regarding her BBB Complaint. Although Woods & Water is of the position that it has not acted inappropriately as to the relevant transaction with *** *******, Woods & Water acknowledges her frustrations and regrets that any individual with whom it has transacted business is not satisfied. As such, Woods & Water has offered to terminate the relevant contract and return *** ********* earnest money upon the parties' execution of a termination of contract and release.
As of present, *** ******* is reviewing the termination of contract and release, and Woods & Water will continue to work with Ms. Jimenez to resolve her concerns in a manner that is satisfactory to her.

I purchased property on Cumberland Lake KY. Sunset point. Phase two of the properties. Per my signed contract the electrical would be supplied to the properties by Dec 2022. The issue is that ***** Benson has not responded to any calls sense I talked with him 2 months ago, only texts that say everything is on track. I was at the property on 11/19/2022 and there is nothing happening for electrical services. Not even supplies on the phase two sites. ***** will not respond to any needs, No emails, returned phone calls...NOTHING. I have contractor scheduled to start a new home build in January 2023. As of today I have NO plan or responses on completion. They got there money and haven't held up there end.
