      Realty Capital Management was hired to manage a rental property while I was working overseas. I moved back into my house in October 2022, thus ending the agreement of them managing my property. Since I moved back in, I have been trying to have Realty Capital Management correct all the issues that was required, by the lease and their company policy, to be fixed/corrected when the renters moved out. In the last six months Realty Capital Management has not tried to actively participate in the resolution of the problems. They have completed some repair of the documented issues, but only after dozens of texts, re-texts, emails, and phone calls. Throughout the six months, the company has stated actions would be completed, but failed to actually follow-up on their statements.

      All items that were agreed upon were done and have been done. While our guys were there working, even on items that would be considered normal wear and tear that we paid for in order for this client to move back into his home, he started adding items that were not agreed upon which is why my contractors reached out to me immediately.  Unfortunately, I can not continue to pay for items out of my pocket for this client and I would say with the 1K plus I have already paid was much more than what should have been done.  Glad to have this client back home and thank him for his services.

      I am rejecting this response because:


      The response from the business is a complete deceit.  Realty Capital Management lease states the home would be returned "rent ready" not "normal wear and tear is ok".  The Realty Capital Management posted policy was that all holes would be filled in and painted.  This wasn't completed in approximately four rooms.  Some of the holes when filled in were not sanded down prior to the them being painted.  Then they paint utilized did not match the original paint. Most of the rework was based on the poor or lack of quality assurance conducted by Realty Capital Management when numerous repairs were conducted while the house was being rented.  The entire house was repainted between renters.  Realty Capital Management failed to hold the painting company accountable by conducted reasonable inspection of their work IRT sanding down holes that were filled in, overspray of paint on the lighting fixtures, paint drips on kitchen cabinets and window *****.  As acknowledge by personnel working for Realty Capital Management. Additional work in the master bedroom's closet of repairing the clothes racks,holes were not filled in and repainted.  The frame on one of the kitchen cabinets was broken off.  It reflects that it was initially glued on and then nailed back on instead of being attached like the other six cabinets. The cabinet in the washer/dryer room top frame isn't attached.  Realty Capital Management stated they would have someone to fix.  Twice nobody showed up to fix. During conversation with Realty Capital Management, they initially wanted me to find someone to fix, but I declined.  Then they acknowledged their personnel would correct.  In the last email Realty Capital Management changed their thoughts and wanted me to find someone to fix.  I have declined since they last time I purchased an item to replace in which they stated it would be reimbursed, it took approximately four office visits, three texts, and two emails over 2 months (8 February 2023 receipt provided, reimbursed on 20 April 2023).  Various fixtures were attached to walls in the house and garage that originally were not there and currently serves no purpose and should have been removed and the area repainted.  Realty Capital Management concurred during our conversation, but no action taken to date.
      Most of the issues should have been charged to the renters and/or the companies Realty Capital Management hired to correct or fix the issues.  However, based on Realty Capital Management inability to hold personnel and companies accountable and conduct the proper, or any, after action inspection the issues now fall back onto them to fix and correct.

      Again, this owner is talking about a home he moved back into after a tenant. Yes, wear and tear does fall back on the owner of the home legally 100% of the time. In this instance he moved back in the home and RCM didnt do any work on the home or charge him. When he asked for things to be done, I kindly paid for certain items for him due to his service in the military but now all he has done is start to take advantage of my kindness. I have never had an issue with the BBB in the 10 years Ive been in business, but I can not agree to continue to be taken advantage of by this individual and he will need to finish anything else on his home himself.

      I am rejecting this response because:


      RMC again failed to address the key issues that were provided in my previous responses of concerns/issues.  Why is that? 

      Did RCM meet the requirements as dictated in the tenants lease and RCM's company policy.  No they did not, hence the reason why I wouldnt be charged.  Should they have held the tenants accountable based on the lease and RCM policy? Yes.  Did they?  No

      I am not sure of the Kindness he provided by correcting the issues/concerns that should have been conducted after the tenants moved out.  Therefore, charged to them vice RCM.  However, that is a self-imposed punishment they brought on themselves.

      There is no Advantage of my Kindness that is being invoked here. Just adhere to the lease and RCM policy.

      I do not disagree with the fact RCM is a huge supporter of military personnel and their family.
