My wife and I entered into a contract agreement to purchase a house in Shelby County, at ******************************************************************. We were scheduled to close on August 22, 2022. We decided not to purchase the home as detailed below. On or about August 17 or 18, we went to do our due diligence and conducted a final walk though. During our walk through, we observed a repairman on the roof of the house. The roof work looked unprofessional and substandard. In accordance to the contract, ************** was required to return the Repair Addendum Proposal signed by the sellers within three (3) days to our agent, ***********************. ************** never returned it which is a breach of contract. In addition, ************** and the sellers never submitted a counter repair addendum to stipulate what repairs they were willing to complete which also voided our contract.We informed our agent, *********************** we decided not to purchase the home. Our agent, *********************** emailed the signed Mutual Release of Purchasing Sales Agreement and Disbursement of ******* Money Form to the listing agent, ************** requesting our $3,700 ******* money be returned to us. ************** did not respond.The listing agent, *********************** re-listed the home on the same day as our closing, August 22. The house was under a new contract within the same week. However, he never refunded our $3,700 ******* money.Business response

Please understand that ******************** filed the complaint because he was buying a home and one business day before closing he decided to withdraw from the purchase.My agent ********************* was the agent on this transaction representing the seller and ******************** was represented by his buyer agent.******************** is upset because he didn't get his earnest money back from the seller, because the seller felt that ******************** defaulted on the contract.The seller was under a contract to buy another home and was already in the process of moving out.I don't want this email to be too long, so I will just say we have power to make the seller give back the ******* money back to the buyer even if we wanted the seller to give it back.The issue is with attorneys and the interpleader has to decide where the money goes, not us. Whether it will be given back to the buyer or left for the seller. We have no saying or control over this matter. So I hope you understand, if you have any questions please call me at ************
