On October 2, 2021, my family and I dinned at the Rafferty's Restaurant & Bar franchise location on Germantown Pkwy in Memphis, TN. That night they received us as one of their last guests for the evening. Due to the late nite circumstances there seemed to be a discomfort and frustration exuded from the staff members which turned into unfriendly service and undercooked food that lead to physical harm and endangerment to our health. After, constant bowel release pain, a few days later we mustard up the courage to inform the establishment headquarters about our incident. This lead to an investigation and an unapologetic reaction from the franchise managers and an even shrewder reaction from the area operation manager who in turn tried to force us to accept a gift card instead of a full refund. We told them, we refused to support a business that doesn't accept full responsibility in failed service and bad products; therefore, only a full refund would be deemed as the only option to resolve our hurt experienced without a lawsuit for the unhealthy foods alone. Today we were put down and left without proper help and still no formal apology or return of funds. We would hate to harm an establishment's reputation but at this point we have no choice but to file this official complaint with the expectation of a full refund and coverage of days out of work concerning our illness experienced from their uncooked products.

      Business response

      12/08/2021

Business Response /* (1000, 5, 2021/11/01) */ A gentlemen called Corporate office on 10/12 about food he ate on 10/02. He had previously called a manager 10/08 about sunglasses he claims he left on the table. He called again on 10/09 and spoke to a different manager demanding to talk to the server about his glasses. He was told that managers handle all situations between guest and associates. The server stated to the manager he had not found any glasses. At the end of the conversation, he did tell the manager that the food wasn't right but he didn't send it back; nothing about being sick. I spoke with him on 10/12 about his visit and asked why he waited 10 days to call about his visit. He said he was busy and just then had the time to call. He simply wanted me to cut him a check for the full amount. I told him the restaurant does not cut checks. I asked if he had asked to speak to a manager about his food and he said yes, but one never came. I told him I would look into the matter and call him back. Again, he never said anything about being ill. The server said he never asked for a manager, and if he did, he did not hear him. I called Larry back and told him that since his mother insisted on eating there, I would send her a Gift Card, even though it was reported 10 after his meal. Consumer Response /* (3000, 7, 2021/11/02) */ (The consumer indicated he/she DID NOT accept the response from the business.) The respected party failed to meet consumer laws after selling our family undercooked meals. The staff and managers became very shrewd and disregarding to the incident at hand. The issuance of a refund was the only thing asked for after we wouldn't consume the meal prepared. We went further to deal with the Corporate Advisors who tried to force our hand to accept gifts cards to further our business with their establishment. We declined due to the nature of this concern and the down right disrespect dealt to our loving family. Again, at this time we took an illness to the underprepared meats and would like a full refund.
