I was a vendor at Painted Tree Boutiques. I received the attached email from Painted Tree Boutiques. In my response, I clarified that I had not considered ending my lease with Painted Tree, but if they were willing to return my deposit, I would agree to terminate the lease. I then informed them that I would vacate by May 1st, which they confirmed was acceptable. At no point in their email did they mention the requirement of a 30-day notice to end the lease. Had this been communicated clearly, I would have kept my business there for another month. ***************************** encouraged me to end my lease under the impression that my deposit would be refunded. However, the home office later informed me that without a 30-day notice, my deposit would not be returned.Encouraging a vendor to leave with the promise of a deposit refund, only to later withhold it by citing a notice requirement that was never mentioned, is not a good faith practice. This approach breaks the contract and reneges on your word, causing unnecessary hardship and confusion for your vendors.

      Hello,

This looks like a communication error between store management and the administration team. I will advise administration to resolve this matter expediently by returning your deposit. I apologize for the inconvenience this has caused!

To whom it may concern I am a customer who purchased several items at ********************** tree ******* over the christmas holiday. As we were opening gifts a pair of warmers furry foot slippers that I bought my sons fiancee were defective and had a hole in which the flax seeds were coming out..never been wore. I immediately called the store after Christmas in which the manager had a very demeaning attitude toward me immediately which obviously was upsetting after receiving a defective product on Christmas that I knew was one day past the 2 day return policy. She called the vendor and purposely would not explain the situation as it was trying to make it to be my fault..the vendor still was willing to exchange although I was trying to tell the manager the correct information and that he did not have the correct color she precedes to arrogantly ignore me and talk to me condescendingly in which I have contacted the manufacturer on the product and resolving it that way nonetheless very upset about how I was treated. Today I my son just informed me that the light on his diffuser has stopped working, it's not even a week old. We have used the product as required, its another defective product I have recieved from another one your vendors. As upsetting as this is because I knew I would have to speak to the same condescending manager I knew I would need to be humble patient and explain as simply as possible and still risked being talked down to but was keeping a positive attitude that that possibly wouldnt he the case as long as I speak kindly and patiently...that did not work...I called the store spoke to the manager and explained that I have recieved another defective product...now granted keep in mind I should be the one upset but instead I am the one walking on eggshells knowing I would be told the two day window is gone and too bad. Indeed that is what I was told and I explained calmly that it is a defective product are you not going to contact the vendor and she said that she would not because this is the second time I have done this. This is what is upsetting after all of this negative experience with your company, your vendors AND your managers I had to tell her not to speak to me like a child, that she is the child, I am a 50 yr old woman and telling me that this is something I have done is not good customer service. I did not do anything, I recieved a bad product from your company and vendor and I am the one being talked to as though I did something wrong because I want a product I paid good money for that a company should stand behind instead of allowing a customer to be swindled out of their money and treated badly on top of it. Thank you for your consideration Sincerely ******************************* **********

I do not have the receipt anymore..I appreciate your willingness to look into the matter but your company was very rude and unfair and took too long to resolve the issue so I was forced to contact the manufacturer of each of the items, went through process of returning and receiving a non defective item. I dont appreciate the frustration but I consider this issue over. Thank you.

I was one of the vendors who decided to rent out a space at the Painted Tree Boutique in Matthews, NC. Within the contract I signed there is a section listed that a vendor must give a 30 day notice before vacating the premises or lease. I decided to part ways with the *** based on how much they took out for sales (10%) and taxes but the location wasn't producing any money and it was high in theft. They could not do anything about theft so we were forced to take out insurance for our own merchandise if something was stolen of taken which is more money out of our pockets. They switched managers and the place fell apart. I was not happy there. The *** sent me an invoice to pay $1344 (for the remaining 8 months of my lease) - which is nowhere listed in the contract I had signed) before 8/2 which gave me indication that I would have to be moved out by 8/2. During the week of 7/23 I decided to start moving my merchandise out and within that week I went back to repaint my space the *** had already allowed a different vendor to occupy or move into that space. I was not fully moved out yet. Also, the month of July had already been paid for in full. I want my pro-rated rent amount for the month of July from 7/23 to 7/31. They refused to pay me this amount.

Business Response /* (1000, 6, 2022/08/12) */ Ms. ***** signed the Painted Tree Partnership Lease Agreement on 03/19/2022. The Lease Agreement specifically states in Section 2- SPACE INFORMATION -that the length of term is 1 year. Ms. ***** rented a space for 1-year. Ms. ***** stated in her complaint that the she was unaware of the term length; however, she signed the agreement that stated the term length. In addition, the store manager informed Ms. ***** that she would be liable for her rents until her lease term. Ms. ***** was contracted to pay rent on the space that she rented until 4/19/23. On July 19, 2022, Ms. ***** was invoiced for the remaining balance of her contracted rent in the amount of $1,344.00. I have attached the agreement for your review. As a courtesy, Painted Tree voided the invoice for the remaining contracted amount due. I have attached the voided invoice for your review. Ms. ***** put in a 30-day move out notice on July 15, 2022. This notice stated that the space will be vacant on 8/17/2022. I have attached the Termination Form for your review. Ms. ***** is responsible for any rents due until 4/19/2023 per the lease agreement, but as a courtesy, Painted Tree chose to let Ms. ***** terminate her contract early without penalty. After voiding the contracted rent amounts due to the end of the contracted term, this made Ms. ***** only responsible for rents due until the 30-day notice expired which was August 15, 2022. As a courtesy, Painted Tree did not charge Ms. ***** for the prorated rent for August for the 15 days that she should have been charged throughout the end of the 30-day notice. Ms. ***** stated that she vacated the space during the week of 7/23/22, however, her 30-day notice did not expire until August 15, 2022, so Ms. ***** is fully responsible for any rents due until such date. We have made attempts as a courtesy to help Ms. ***** avoid monetary damages for terminating her contract with leasing a space for 12-months. We also did not charge her for the prorated amount due for August. We feel disheartened that Ms. ***** has made statements that clearly contradict the Lease Agreement and our policy regarding move-out that she was fully aware of. The amount of money that she is requesting as a refund is not stated. Consumer Response /* (3000, 8, 2022/08/15) */ (The consumer indicated he/she DID NOT accept the response from the business.) I was a vendor under my father's name starting out at the PT and split from my father under my own vendor ID. I was not asked if I wanted to sign a 1 year lease. I was placed under a 1 year lease by the PT. Upon submitting my 30 day notice- I never received nor did I sign any documentation stating my 30 day notice will expire on 8/15. The only document received (not signed) was the invoice (which that is correct - is now voided). There is no documentation signed stating that the full lease term will need to be paid in full after submitting a 30 day notice. The contract ONLY states that a 30 day notice will need to be submitted per the screenshots I have submitted to BBB. I was not notified and still have not been notified that someone else was/is occupying my space. My father advised me who is also a vendor there. I would like my pro-rated rent amount for the month of July that I paid in Full. I moved out before August 2nd so my payout for my sales are/we're entitled to me. As stated on the invoice (the only documentation sent to me by the PT admin office I would need to have the $1344 paid by August 2nd. However, the PT is stating I would have to be out by 8/15 in this corresponding case but that makes no sense. That would have been a double payment to them of a pro-rates amount of the month of August and $1344 for months. Thanks! Business Response /* (4000, 10, 2022/08/23) */ Comments to Ms. ******* rebuttal are in CAPS: I was a vendor under my father's name starting out at the PT and split from my father under my own vendor ID. I was not asked if I wanted to sign a 1 year lease. I was placed under a 1 year lease by the PT. THE LEASE THAT MS. ***** SIGNED WHEN MS. ***** SPLIT FROM HER FATHER STATES THAT THE LEASE IS A 12-MONTH TERM. Upon submitting my 30 day notice- I never received nor did I sign any documentation stating my 30 day notice will expire on 8/15. 30 DAY NOTICES ARE FOR 30 DAYS, SO NATURALLY 8/15/22 IS 30 DAYS AFTER THE INITIAL NOTICE. The only document received (not signed) was the invoice (which that is correct - is now voided). There is no documentation signed stating that the full lease term will need to be paid in full after submitting a 30 day notice. WHEN SOMEONE SIGNS A LEASE FOR ANY COMMERCIAL/RESIDENTIAL SPACE, THE TERM LENGTH INDICATES THE AMOUNT OF TIME THAT THE PERSON IS RESPONSIBLE FOR PAYING ON SAID COMMERCIAL/RESIDENTIAL SPACE. The contract ONLY states that a 30 day notice will need to be submitted per the screenshots I have submitted to BBB. I was not notified and still have not been notified that someone else was/is occupying my space. My father advised me who is also a vendor there. THE INFORMATION IN THE SCREENSHOTS THAT MS. ***** SENT STATES THAT AT THE END OF THE TERM, A 30 DAY NOTICE IS REQUIRED. I would like my pro-rated rent amount for the month of July that I paid in Full. I moved out before August 2nd so my payout for my sales are/we're entitled to me. PAYOUT ISSUED FOR JULY SALES TO RECONCILE ACCOUNT ON 8/1/22 FOR $159.60 CHECK #**** As stated on the invoice (the only documentation sent to me by the PT admin office I would need to have the $1344 paid by August 2nd. However, the PT is stating I would have to be out by 8/15 in this corresponding case but that makes no sense. That would have been a double payment to them of a pro-rates amount of the month of August and $1344 for months. Thanks! THIS INVOICE DUE DATE WAS AUTO GENERATED AND HAS NOTHING TO DO WITH THE DATE THAT MS. ***** SHOULD HAVE, OR WOULD HAVE MOVED OUT AFTER THE 30-DAY NOTICE. THE PRO-RATED RENT AMOUNT FOR THE DAYS AFTER MS. ***** MOVED OUT EARLY IS: Prorated amount for move out on 7/23/22 (8 days not in-store) based on $168 per month = $43.35 IF REFUNDING THIS AMOUNT TO MS. ***** WILL RESOLVE THIS ISSUE, WE CAN REFUND THAT AMOUNT. Consumer Response /* (3000, 14, 2022/08/24) */ (The consumer indicated he/she DID NOT accept the response from the business.) Yes, please set up a time and day to where I will be able to stop by to receive my check for $43.45 from the PT Matthews location and once I pick up I will resolve this accordingly. Thank you! ********* ***** Business Response /* (4000, 17, 2022/08/30) */ That sounds like a plan. I have let admin know that the manager will have a check ready for you in the amount of $43.35. She should have it ready today.
