      I am the homeowner at Lakeside Cove I have lived here for 17 years I replaced my garage door in 2009 to a garage door with windows. The door was replaced after approval from the ARC **mmittee. The management ** was ******** at the time. It was approved by the property manager *****************. I was fined in Aug 2022 for a screen which was replaced. After the fine for the screen I was fined for the garage door that I have had since 2009. I emailed the hoa and was told the fine would be removed. Then I received another letter that it was added to my ac**unt again without notice and was overdue. I have all the documentation on this. You cannot charge for something that was approved in 2009 and you agreed that the case was closed for that reason and the fine would be reversed. This fine will **ntinue to grow interest and attached to my home if not removed. I need this remedied, I have e mailed and called to no avail. Please help

      Thank you for reaching out to me.  This issue was closed after you brought this up at the annual meeting.  There were no fines assessed.  As discussed at the Annual meeting Timmons dors not make these decisions, and was asked to send the notice for the ARC.  Given that it was approved by the previous management company, we were not aware, however, everything has been closed.

      This is an HOA management company. They have been sending me violation letters for the last 10 months and fining me. I have responded in writing to them multiple times asking for the exact sections of our HOA governing that these violations are from and also the section that allows them to issue fines. They refuse to provide this information. The lack of communication from them is appalling as they charge our HOA over 50k a year to drive around and send violation letters in our neighborhood. I am not the only one in our HOA that has issues with not receiving any communication back from this company. They are now claiming they are turning me over to an attorney because they refuse to answer my questions.

      Business Response /* (1000, 12, 2022/09/07) */ Timmons Properties does not make decisions for the community. All decisions are made by the board of Directors according to the Governing Documents. There is a website that all homeowners have access to that houses all of the information for the community. Timmons is not a decision maker, we are only a liaison. Consumer Response /* (3000, 15, 2022/09/13) */ (The consumer indicated he/she DID NOT accept the response from the business.) Timmons claims to be a liaison between Homeowners and the HOA board. They have failed to communicate issues homeowners are having to the Board. Timmons also claims they do not have the authority to remove fees and fines, I also believe they do not have the authority to issue fines. This question has been asked over and over again what section of the governing documents grants them permission to issue fines. They refuse to answer this question. They have also denied me access to all of our HOA records that I am entitled to review and make copies of, according to our governing documents. They still need to answer these questions that was presented in the emails, this is what Timmons is paid for. As well in this homeowners case the homeowner emailed and communicated directly with the board president. Timmons does not make the rules, create the fine policies or decide who does and does not receive fines. Per the Bradford Hills Homeowners Association Articles of Incorporation filed with the State on March 23,1990. ARTICLE IV PURPOSE AND POWERS OF THE ASSOCIATION This Association does not contemplate pecuniary gain or profit to the members thereof, and the specific purposes for which it is formed are to provide for maintenance, preservation and architectural control of the residence Lots and Common Area. and to promote the health, safety and welfare of the residents, (g) have and to exercise any and all powers, rights and privileges which a corporation organized under the Non-Profit Corporation Law of the State of Tennessee by law may now or hereafter have or exercise. Per the HOA Attorney, The Board of Directors has the authority and responsibility to create and implement service fees/fines based on the TN Non-Profit Act 48-53102. General powers.-- (a) Unless its charter provides otherwise, every corporation has perpetual duration and succession in its corporate name and has the same powers as an individual to do all things necessary or convenient to carry out its affairs, including, without limitation, power to: (16) Impose dues, assessments, admission, service and transfer fees upon its members; (19) Do all things necessary or convenient, not inconsistent with law, to further the activities and affairs of the corporation. 48-56-204. Member's liability for dues, assessments and fees.-- (a) A member may become liable to the corporation for dues, assessments or fees by consenting (expressly or impliedly) to such obligation; provided, that a charter or bylaw provision or a resolution adopted by the board authorizing or imposing dues, assessments or fees does not, of itself, create liability" Initially Mr. ****** disputed all or moist of the violations that her received, therefore he received fines. One of the violation notices Mr. ****** received was for a wooden Barrell and a bench, Mr. ****** disputed that he was in violation for the bench and wooden barrel, the board was notified and agreed and the violation was removed, Mr. ****** removed his trailer and resolved all other violations, the board was notified. The board president completed an inspection and agreed that all issues have been resolved, He has agreed to bring the fines to a vote at the next board meeting later this month and discuss waiving the existing fines. If approved, Mr. ****** will receive a notice from the Association Manager.
