On August 13, 2021, I entered into an agreement for a Home Improvement contract with **** ****** (**** Restoration, **** Construction). The project was to be completed in 6 weeks after additions were made to the project scope of work. On October 29, 2021, **** received his 10th draw payment with the promise that he would return to finish up the project the following week, by 11/5/2021. At that point $35,000 out of the project total of $39,000 had been paid out. In the 20 weeks that have passed ***** the original promise to finish the job by 11/5/2021, Mr. ****** has not performed any substantial work at the job site. Twice Mr. ****** has collected additional money since that time because he stated that he needed the money to pay for his people and he cannot finish the project without the additional money. In both instances he was paid $500 but only showed up to collect the money and did not do any substantial work at the site. Mr. ****** has continued to say that he will be at the jobsite tomorrow but he never shows up to do work. This has continued for 20 weeks. There are several instances of Mr. ****** saying that he is at the jobsite (which he was not because I was at the house), that he will work tomorrow and that he will finish the job, but he doesn't show up to do work. After 5 months it is clear that Mr. ****** has no intentions of finishing the job that he was paid to do. In the last few weeks I have asked him a few times if he is going to finish the job or give me my money back. He replies that he will finish the job, but he still does not show up to the job site or do any work. I received quotes to finish the job and the total to finish the job that I have already paid him to do is $17,000. The details of what parts of the job he did not finish are attached. I sent a Certified Letter to Mr. ****** on March 18, requesting a refund for $13,500. I have not received a response and am hereby asking the *** to help mediate a resolution.
