      RK junior purchased a home next door to mine and has been in the process of redeveloping the lot to accommodate 4 much larger units over the past year, construction is still ongoing. Over the past year his construction crew(s) have vandalized my property, destroyed established vegetation on my side of the property line, has adversely altered the slope of the land to force water runoff onto my property. Removed existing chain link fence, only to replace it with another one on my side of the property line. Construction debris including concrete chunks in yard. Constant trespassing, erection of scaffolding on my property against my will. Workers are hostile and make me feel unsafe.

      Thank you for the opportunity to respond to this complaint,as it is a unique situation being that ************** was not a client of ours but a next-door neighbor to a property that we were building on. From the beginning,the owner of RK Junior met with ************** because there was a property line issue that was found by our surveyor. Once we found out the owner introduced himself to ************** and offered solutions on how the issue could be resolved.************** decided to get his own survey to confirm, and his surveyor agreed with the survey our surveyor initially provided. The issue was that **************** property line was intruding 2 feet over onto our property. When the owner met with **************, he offered solutions that would improve **************** property, as well as allow us to build within acceptable zoning administration parameters. The improvements included cutting, repaving, and pressure washing the driveway, relocating the mailbox, removing foliage from and relocating the fence, as well as putting in brand-new landscaping on **************** property. This was over $10k in improvements and updates to **************** property that were made at no cost to him. The owner did this out of compassion for ************** because he understood that ************** was not at fault and was essentially unaware of the property line issue. We believed that the solution provided went above and beyond reasonable measures and was more than fair. We also believed at that time ************* felt the same way about the solutions.


      Once we began construction on our property, we began to see that ************** was not appreciative of our generosity. ************** began to be combative, entitled, and overall unreasonable despite our efforts to work with him amicably. The property line issue made it physically impossible for our subcontractors to build the homes on our lot, and not have minimal intrusion onto **************** property. We did our best to work with and around each unreasonable request as best we could, but ************** was persistent and vigilant in monitoring our every move from his video monitoring system on his property. ************** became increasingly rude to our subcontractors, he would physically block entrances where they could not get material on site, he would demand them to stop working because what they were doing was illegal, which overall slowed down operations, and the building of the homes. ************** called codes administration and reported violations that we were allegedly making. The zoning administrator reviewed the complaints and found them to have no merit,and even acknowledged that the requests that ************** was making were unreasonable.If that was not enough, ************** showed up at our zoning appeal to speak in opposition to us being able to make the homes that we were building short-term rentals (STRs) even though **************** property, the one that we improved and that he was so vigilantly protecting, was a short-term rental. ************** stated to the commission, that we should not be able to operate STRs because of how we do business. The appeals board dismissed him stating that this is an appeal and not a community meeting.


      At the end of the day, we do not know why ************** felt entitled to constantly harass us and make the building process as difficult as possible. We could speculate that it is because he did not want our newly constructed homes to be in competition with his STR property, but at the end of the day we do not really know. What we do know, and what we can confidently and with clear conscience say is we did EVERYTHING within reason to amicably resolve any request ************** made, regardless of how unreasonable it was. Once the project was completed, we resolved to move on and move forward, only to find out later there was a complaint on our BBB file. When we found out who submitted the complaint we contemplated not responding because we have not had any complaints filed against our business in the 12 years that we have been in operation.In the end, we decided to respond to the complaint in order to protect the integrity of the business that we work so hard to build.
