      We hired them to chip seal coat our driveway. After they left we noticed there were bare areas that were not treated. We contacted them immediately and asked them to come back to fix it. They never would. We texted the local guy here in Childress that they had as foreman of the job, Russell ****** and also Mr *******. We emailed them, called them and texted them multiple times. I'm attaching some of that for you as proof but not all as I'm limited to 5 mb. We have copies of all our correspondence. Finally Russell said they would come back and fix it in October. We have had no word and they are once again not answering. They gave a 1 year warranty and we have been trying to get them to fix the bare spots since December. We just want the job done that they promised us.

      Texas Asphalt was hired 9/10/2022 to chip seal our road coming in from the Spur to our house. This is a 900 foot road with a grade. John ****** explained his work. They would prepare the road for the chip seal. Grade it, put in ditches on both sides to handle the water moving down so that the road would drain properly and not erode. He would prepare the pad at the top and bottom to the Spur and chip seal it as well. The road was supposed to be 10 ft wide. And we were given a 3 year warranty. The work was finished on 9/13/22. The ditches were not as deep as were promised and the road is only 7 feet in most areas. It still had ripples in it. But it looked nice and we wrote a check for 15,000.00 to Texas Asphalt as directed by John *******. We did not receive rain until 9/23. The road did not drain properly and has washed in several areas. I called John and he remembered the work. He said he was out of town for 10 days and would come and look at our road in 10 days. That should have been on 5/08/23. We have not heard from John ******. I have tried to call multiple times and have left messages but he has not returned my calls. I have texted him as well to no avail. We would like for Texas Asphalt to repair our road properly.

      I would like to correct the first date that we had rain after the road was completed.  5/23  (not 9/23).  Also, I called Texas Asphalt on Monday 5/15/23 and spoke to Tommy, he just like John asked me first off how much we paid for the work they did on this road and I told him 15,000.00.  Tommy told me to send him pictures of  our road and he would respond after he got the pictures.  I immediately sent him 25 pictures of the road as it is now since the rain that we have gotten.  I texted Tommy for acknowledgement that he received all 25 pictures and Tommy responded that "Yes, I got them. Let me go through them".   I texted Tommy again on Tuesday at 2:34 that I was waiting for a response and as of 5/20/23 I have not heard back from either Tommy or John.

      My husband called Tommy today 6/2/23 at approximately 1:00 pm.  Tommy answered the phone.  My husband explained to Tommy that he had told my husband on 5/23/23 that someone would contact us in 2 days and that it is now 10 days later and we have not heard from anyone regarding the repair of our road that they installed.  Tommy said that someone would call us back either late today (Friday) or Monday.  He then said that we can call him back if we did not receive a call.  When I asked if he would answer the phone if we called him back; he totally went off on me and ended by telling me to **** Off and hung up!  Neither my husband nor I had any opportunity to respond.

      Dear Facebook Friends, I usually don’t put my downfalls on Facebook, but I DO NOT want anyone else to be scammed like my family and I were with Texas Asphalt and Chip seal out of Amarillo, TX. We were scammed out of $2,800. These are very nice and kind people. I guess that is why I didn’t think they had evil on their minds. The Lord has taught me to think only the good in people. The way this works is they find out how much money the client has, say they will do the job that the client wants or needs, and then give the client something that you knew that would not work in the first place. (Get every penny the client has and give then something cheaper or (not what the client ask for) that the client can’t use just to shut the client up.) When they started our driveway I seen that they had pea gravel on the truck and not chip seal. (That should have been my 1st clue.) I asked why. Tom ******* said that they would put a base first then they would cover it with chip seal. (We never even spoke of pea gravel.) They laid the pea gravel down and start putting they started putting the machine away. I advised the crew I didn’t order pea gravel that it would wash away. I ordered Chip seal. I asked when would they finish it. He said call Tom. Tom was already at the bank cashing our check even before the machine was off the trailer. (2nd clue) Then I started the calls and left messages to them. Then came the excuses after excuses. At 1st, it was we will be there on Monday. That was on a Wednesday, so I would not bother through the weekend until the following Monday. This happen for a couple of weeks. I thought I had taken all the correct precautions. I have contacted the Ellis County Sheriff Office and file a report. I have 2 recording of the calls (I thank my husband for this. He said it was a scam for the first day and advised me to record our calls.) with Jerry that they will be there on Monday along with several others. I did have “chip seal driveway” in the memo line of my personal check. I am taking it to court (if the matter is not resolved very soon) and filing with the BBB and BBB scams website. The check was wrote to “Tom *******” and Jerry is the one that made the enormous amount of empty promises. I am not sure who is running the show but, Tom ****** is the one that cash the check. I am fighting cancer right now and I guess I looked like a good person to scam. For over 3 weeks I really had faith in the in Tom ****** and Jerry. They have really taken my joy for the past 3 weeks over this issue. They were really so very kind to me. I would have had of never thought that they would of done this to anyone much less me. By talking to them you would think that they were true Scholars. Tom even told he went through cancer last year and he would not do me wrong. Please share the post as many times as possible so this does not happen again. It’s sad that this is what some people do to take other hard working money.

      Business Response /* (1000, 5, 2022/06/29) */ That is incorrect you paid for your driveway to get graveled he did not pay for a chipseal the best they will offer you as a refund of $500 Consumer Response /* (2000, 7, 2022/07/01) */ (The consumer indicated he/she ACCEPTED the response from the business.) Both parties agreed that $1200 to client would resolve the incomplete job.
