On 7/18/21, I contracted with ******* *****, dba, Lone Star Paving, Malakoff/Athens, Texas, to lay approx 37,000 +/- sq ft of 4" recycled asphalt for a driveway, approx 3000 +/- ft long, which comes through secutity gates off a Van Zandt County Rd. During our initial estimate/quote mtg, I informed Mr ***** I would b installing automatic gate openers soon after project completion, He offered to install a PVC pipe under drive for electrical access to gates.When project was complete, with Mr *****, crew and equipment gone, I realized gates would not close because asphalt was laid 2-3 inches higher than the bottom of the gates. I contacted Mr ***** several times, via live calls and text msgs over the next 6 wks concerning this issue. His 1st resonse was to suggest I raise the gates. I told him this was not an option as the gates are welded to the support columns, in addition to the fact they would no longer be at a uniform heighth with the rest of the fence. He said a crew would b sent out to address the issue, but after several days I determined his crew was a no show. My 2nd conversation with Mr ***** resulted in his offering to pay me to fix the problem myself. I informed him I was not in the asphalt business, otherwise I would not have contracted for his services in the 1st place. AGAIN Mr ***** said he would send out his crew to correct the problem and AGAIN the crew no-showed. On my 3rd conversation with Mr *****, he informed me that we never actually discussed whether the gates would open/close upon completion. WHAT? REALLY? It does not take a rocket scientist to figure out that if a gate opens, then it must also close, in other words, Mr ***** should have been smarter than the gates.He changed his tune when I reminded him I would be installing auto gates soon after completion and he, himself, offered to install PVC pipe under drive for electrical purposes. He further changed his tune when I informed him that in the event my home is burglarized, my property trespassed upon, or any damage done to my property due to his incompetentcies and negligence, he/Lone Star Paving would be held legally liable. Once AGAIN, he said a crew would be sent out to address the issue. On Sat, 10/23/21, while I was out of town, a crew of ONE (1), who identified himself as Mr *****' son *******, showed up to address the issue with nothing more than a pick ax, as witnessed by my grounds keeper. His "repairs" consisted of a 10' 4" × 13' 6" × 4" pothole, A LITERAL HUGE POTHOLE. Upon my return, I called Mr ***** a 4th time to voice my dissatisfaction and inform him the "repairs" were NOT ACCEPTABLE. I further told him to properly correct the problem, the footprint of the gates would need to be re-graded to 6" below bottom of the gates and relayed with 4" of ashalt. He declined to correct his workmanship in this manner, instead offering once again to relay the asphalt if i raise the gates, AGAIN, letting the gates be smarter than he. At this point, I informed Mr ***** I would contract with a competitor to correct his ineptness and sue him for the damages. In my opinion, Mr ***** is unprofessional, incompetent and is not to be trusted once the project is complete and the check has cleared. I cannot/will not in good faith and consciousness recommend Mr *****/Lone Star Paving for the smallest or easiest of projects. BEWARE of and stay away from ******* *****/Lone Star Paving.
