The unit I moved into was unleveled, they offered to refund me 1 month and a ********************************* talk about my experience. I said I wanted 2 months and moving expenses they declined.Customer response

They offered me a different unit then the one I was in, all they had was smaller units and after my experience with the staff I didnt want to deal with them anymore so I asked to be let out of the lease. They said they ***** let me out and refund my first month and a $250 gift card. I said I wanted 2 months of rent, they said no. In the document they sent me to be released from the lease it stayed that I cooldnt talk about my experience at all or write reviews, I thought that was wrong , people should know about the problems with the unit. I could find the ****** county code but Im pretty sure these units just being on dirt is against code .Customer response

I asked if I could get my refunded 1 month at signing of their lease break agreement they said no. Now I have late fees, I need that money now to find new housing. My unit is still unleveled. They said they would refund me in 30 days but I dont trust they they would give the full amount back.Business response

The Complainant in the referenced complaint signed an Apartment Lease Contract executed January 10, 2023 (the Lease). The Lease was for unit 719 at ********************* (the Premises). The Complainant is the Tenant under the Lease.
The Lease provides that if Tenant wishes to terminate the Lease early he is subject to a $3,380 Early Termination Fee and must provide a minimum of 60 days prior notice. Tenant is subject to other charges/fees should he be in default under the Lease.
Tenant notified landlord on February 22, 2023 that the Premises needed to be leveled. The unit was fixed approximately one week later. Tenant had no right to break his lease, but was granted his request to break the lease without penalty or Termination Fee. In fact, Landlord provided him an extra $250 to move out, and refunded all monies paid, despite the fact that he was in the Premises rent free for over a month. ****** was notified that his refund was provided on March 20th,and he confirmed receipt on March 26th.
Landlord reserves rights for fees and penalties Tenant owes under the lease Tenant executed.
