On 6/13/2022, Want To Sell Now, LLC recorded an affidavit and memorandum of interest against my property, based on a DRAFT contract that I provided, The contract bears my signature but clearly states that it is null and void unless signed PRIOR to the signature date of 6/1/2022, and no effort has been made by them in the intervening time to proceed with the purchase of the property. This memorandum is preventing the current sale of my property to a different buyer, and Want To Sell Now, LLC apparently believes they are entitled to a $2500 payment to release the fraudulently recorded memorandum.Business response

I apologize for the situation that is currently at hand. We did have a contract with you to purchase your property and we only filed a notice of interest after having sent a photographer and others out to the property. It did cost us money and we were working with you to purchase your property. We apologize it did not work out. At this time we have made an agreement with your new purchase to release our interest and you'll have your home sold to them if it has not already been done so. That should all be cleared up now. I used Want to Sell Now LLC to sublease my home so that I could move to ***** for work. They were continually late to pay rent and I had to ask them every month to issue payment and continually call and hassle them. They let the water get to a point a shut off twice and didn't pay the water bill. I received two bills up in ***** at my new home for $275 or more each time. I had to again continually call them and hassle them about paying it or the water would be shut off. Because of the continued problems, I decided to cut my losses with the economy and sell my home. Then I got an email from Want to Sell Now LLC saying that they would be terminating my lease with them citing that they were not able to run their business and the last day would be June 30, 2023. They left the home in disarray, and I had to hassle them about cleaning the home again. They did after many text messages back and forth. They also left garbage stacked in the backyard and did not take it out to be disposed of. (Please see the photo I attached) Furthermore, they have not returned any keys to me and claim they don't have any keys. I told them I hand-delivered keys and garage remotes to ***** in my kitchen in August 2022. I would like them to return all the keys and three garage remotes and remove their garbage or issue payment to me for replacement keys, three garage remotes and removal of their garbage immediately.Business response

I am writing on behalf of Want To Sell Now LLC, in response to the complaint lodged with your property. We understand and acknowledge the issues detailed in the complaint; however, after careful investigation, we believe the primary cause of these concerns is due to the actions and mismanagement by a third party.
In this case, the third-party property management company, which was contracted separately, was responsible for the day-to-day operations and maintenance of the rented property. This includes, but is not limited to, paying utility bills and maintaining direct communication with the tenant. Our role, as a company providing subleasing services, was limited to facilitating the lease between the complainant and the eventual occupants of the property.
Regarding the issue of late rent payments, we want to clarify that we were not responsible for collecting or issuing rent payments. This was the sole responsibility of the property management company. It is deeply concerning to us that they failed to perform this fundamental task efficiently and timely. We share the complainant's frustration over this issue as it is not a reflection of our commitment to high standards and professionalism.
As to the matter of the unpaid water bills, we were under the impression that the property management company was managing these payments. We learned of the overdue bills when the complainant alerted us. At no point were we directly involved in the management of utilities or payment of these bills, and we had every reason to believe they were being handled appropriately by the property management company.
With respect to the condition of the property upon lease termination, we relied on the property management company to ensure the property was left in an acceptable state. It is distressing to hear that the home was left in disarray, as this was not in line with the expectations we set for the property management company.
Concerning the missing keys and garage remotes, we handed these over to the property management company at the onset of our agreement, trusting that they would be safely returned at the end of the lease term. The fact that they were not returned is another unfortunate failure on the part of the property management company, which was outside of our control.
While we empathize with the complainant over the issues raised, we would like to emphasize that Want To Sell Now LLC acted in good faith throughout this process, and the issues arose due to failures by the property management company, which was contracted independently. We are currently seeking redress from this company for their failures in fulfilling their duties and obligations.

I am rejecting this response because:they had care custody and control over the keys and remotes. If they do not produce them, or replace them I am within my rights to file an insurance claim against their business. Also, they hired the third party to do the cleaning and that company failed to do their job and remove the garbage. I am within my rights to file a health complaint, and insurance claim for the disposal.

Thank you for your feedback. In line with your guidance, we are submitting an additional response addressing the concerns raised in the complaint.
We understand that the complainant has raised serious issues concerning late rental payments, unpaid water bills, the condition of the property at the end of the lease, and the missing keys and garage remotes. We empathize with the frustrations expressed, and it is not our intention to diminish the complainant's experiences.
Upon investigation, we found that the third-party property management company, which was contracted separately, was primarily responsible for these matters. However, we recognize that as the party who facilitated the subleasing agreement, the complainant holds us accountable.
To provide context, Want To Sell Now LLC's role was to facilitate the lease agreement between the complainant and the occupants of the property. The property management company was responsible for daily operations and maintenance, including rent collection, utilities management, property cleaning, and key management. Our role did not extend to these areas.
With respect to the late rental payments, we have learnt that these were the result of the property management company's inaction, as we were not in charge of collecting or issuing rent payments.
Regarding the unpaid water bills, our understanding was that these were managed by the property management company. We were unaware of any overdue bills until the complainant brought them to our attention.
As for the state of the property upon lease termination and the missing keys and garage remotes, the property management company was responsible for these areas. We are disappointed that they failed to meet the standards that were expected.
We appreciate that these explanations do not absolve us of perceived responsibility in the eyes of the complainant. We regret the distress that this situation has caused and are committed to finding a resolution.
Therefore, we propose the following steps:
We will formally communicate the issues outlined in the complaint to the property management company and insist on their immediate attention to resolve them.
We will request the property management company return the keys and garage remotes, or reimburse the complainant for the replacement cost.
We will seek reimbursement from the property management company for the unpaid water bills and, if successful, will pass this refund on to the complainant.
While we cannot undo the inconvenience caused to the complainant, we are dedicated to ensuring that similar situations do not occur in the future. We value our relationship with the complainant and the BBB and thank you for providing this opportunity to address these concerns.
