      6/2/23: Contract for Engineering Plans, Construction of a Retaining Wall and a side yard Patio at our house, located at ***************************************************, was executed by ***************************************** homeowners, and *********************, representing Top Notch Foundation Repair.Payment terms of the contract were: ********* dollars amount due for the Services described. ?**** Down Payment ?**** After Engineering Foundation Plan Completed ?**** After Pavers Installed ?**** Final Payment Paid Upon Completion of All Services. 6/3/23: *********************, owner of Top Notch Foundation Repair, was handed a **** dollar cashier's check for Down Payment. 6/3/23: Top Notch crew removed concrete patio and deposited debris in front yard.6/5/23: Top Notch crew began digging trench for Retaining Wall. 6/5/23: ******** learned that the Engineering Plans would be delayed. ********************* requested, and ******** agreed to expedite additional payments, in order to keep trench preparation on schedule. 6/6/23 & 6/7/23: Two cashier's checks for **** dollars each were hand delivered to ********************** 6/7/23 & 6/8/23: Trench for the Retaining Wall was extended & rebar installed. 6/13/23: ********************* received Engineering Plans. 6/13/23 Top Notch work crews had not worked for one week. Project abandoned. 6/23/23: ********************* emailed Engineering Plans to *********7/7/23: ******** emailed and mailed a **** Certified Demand Letter to *********************, owner of Top Notch Foundation Repair, and *********************, Construction Superintendent requesting mediation. 7/10/23: **** unable to deliver Certified Letter to Top Notch Foundation Repair at their business address: *************************************************************/20/23: Learned that Top Notch did not trench nor install rebar consistent with engineering specs. Rebar needs to be removed and trench completely redone.8/30/23: ******** will go to small claims court to recover costs.

      hired a contractor (Top Notch Foundations) to build a french drain in my front yard because of drainage issues. Signed a contract with the contractor and paid over half of the bid up front. Realized that the contractor had no intention of finishing started project and I tried to get my money back that I paid by wire. My bank tried to pull the money back, but the contractor's bank refused. I have attempted to contract them several times, several different ways. No contact back. I explained that if they refuse to give the money back, they need to finish the job. No reply at all.
