      Austin 360 installed a new roof at the end of October 2021. Days after installation the leak I had pointed out as my main concern and Austin 360 assured me would get fixed was still leaking. I notified them immediately. It has been 4 months and nothing has been done. They need to honor their agreement and fix the leak.

      360 Roofing was hired to re-roof Mrs. ****** roof but only the sections effected by hail damage.  An added addition to the house was not included in the re-roof per the insurance documentation and this was relayed to Mrs ***** prior to and after the re-roof.   Insurance inspected our work and everything was done per the insurance paperwork.  When a section of the roof that was not touched by 360 Roofing began to leak she become unhappy.  The email from her insurance clearly explains that portion was not covered by insurance and 360 Roofing was not required to re-roof that section.

      Mrs. *****,

      Per our conversation, I advised my manager has requested ******** remit the pending payment to Austin 360 to avoid any liens being put on your home. I also advised I would need to send a partial denial letter for the damages to the conjoining roof which are not damaged due to the current covered cause of loss. I reviewed Insurance perils and noted wear and tear would not be covered. You ask what it would take for ******** to repair the roof and I advised the damage would need to have been resulting from a covered peril. I reviewed the contractor’s statements of the leak being part of the transition to the metal roof which was not included in the current claim and noted to have no storm related damage. I also confirmed in the review of the original estimate and the most current re-inspection photos you can see a difference in flashing on the shingled portion of the roof. Although I also clarified I could not confirm if the flashing has been painted or replaced. I advised I would follow up on claim file to see if there were any addtioanl updates from the contractor. I will monitor the ******** file and follow up with you if there is any new information. I know you have continuously stated you were told by Austin 360 the leak would be repaired with the replacement of the roof surface unfortunate I cannot speak for the contractor.   I do apologize for any unprofessionalism you may have received from the contractor.  Please let me know if there is anything I can assist you with.

      To the Owners and Director of Operations for 360 Roofing,

       

      I received a letter from 360 Roofing yesterday, April 9th. The letter was addressed and postmarked April 4th. It is a letter of intent to file a lien against our home, ***** ****** ***** *** *** ******** ***** *****. The letter demands payment by 3:00pm April 11th, tomorrow. Filing a false lien against a property in the state of Texas is a criminal offense. 

       

      I take paying my bills very seriously. I paid Austin 360 my deductible and claim fund to 360 Roofing on October 21, 2021, the day the roof was installed. The only amount remaining is what insurance withheld due to a job that was not completed to satisfaction. A leak I was assured multiple times by Carlos Reyes would be repaired and the entire reason why I agreed to have 360 Roofing replace our roof was not fixed. My insurance has since sent their own inspector and found that your company did not replace, but reused existing flashing. Not a single sheet of decking was used on our roof that has had a leak for years. When the underside of the eaves are rotting with black mold, that is very troubling. It's reasonable to believe that your installers put shingles over rotten decking.

       

      My claim is under investigation by ******** and ********. I have paid the funds that I was responsible for. Your company is well aware of what the problem is with insurance holding back the last payment. I consider the multiple invoices that your company has sent and now this notice to file a lien as harassment.

       

      Since there are only a few business hours from the time I received the notice to the time Ms. ******* is threatening to file a lien, I am sending this correspondence to all the email addresses that I can find for the parties that are ultimately responsible. The business address alone is sufficient for ensuring that you are informed and cannot claim that you did not have knowledge prior to filing a lien. Continuing to do so would be a purposefully fraudulent action considering this matter is still in dispute.

       

      I expect Austin 360 to find a resolution with ******** and ******** on how to proceed with the completion of our roof. I expect all future correspondence in writing.

      This is still under investigation by ********, the company that hired Austin 360. ******** found that Austin 360 forged my signature on a document. ******** also sent out their own investigator this past Friday. I have yet to know what their findings are. Please leave this case open.

       

      Yes, this email chain does show the partial denial only because ******** couldn't prove that the flashing hadn't been replaced because it was a different color.
