    State of Texas v. VA Claims Insider, LLC (Cause No. 2023CI25316)

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.

    On November 29, 2023, The State of Texas, acting through the Attorney General of Texas, Ken Paxton filed an action against VA Claims Insider, LLC for violations of the Texas Deceptive Trade Practices − Consumer Protection Act, Texas Business and Commerce Code §§ 17.41–17.63 (“DTPA”), and seeks a temporary and permanent injunction to stop Defendants from engaging in false, misleading or deceptive acts or practices in connection with the marketing or sale of goods or service to consumers by:

    a. Causing confusion or misrepresenting, directly or by implication, the actual costs of participation in Defendant’s membership programs;

    b. Causing confusion or misrepresenting, directly or by implication, the types of services offered and provided by Defendant or the benefits of such services;

    c. Selling or offering for sale VA disability claim preparation services unless Defendant has received accreditation by the VA; Plaintiff’s Original Petition Page 15 of 16 State v. VA Claims Insider, LLC 

    d. Offering to provide or providing Veterans with individualized, personal advice regarding a Veteran’s specific disability claims unless Defendant has been duly recognized by the VA to provide such assistance;

    e. Causing confusion regarding its affiliation with the VA; and f. Accessing or seeking to access the VA benefit information of Veterans through the VA’s eBenefits portal.

    Recently in Feb i was seeking help/guidance for putting in VA claims since i have an extreme difficulty talking about myself & while in the military i didn't give myself the time to get medically checked out for issues i was having. Living overseas in ***** also adds to that difficulty, but i digress. Hence why i attempted to use CI as a form of guidance. From quick memory i've had a total of 4 phone calls with them, 2 of which were the onboarding rep & the other 2 were my coach. The onboarding felt a little rushed, but i thought nothing of it. I told them my rating & wanted help trying to get my migraines re-evaluated & to also my insomnia. I even told them to please be mindful of the time difference because it's a 13h difference, which they ignored many times & called me at 2-3am. They went straight for my migraines claim & have had near 0 help with the insomnia. Basically that insomnia is difficult to prove & that's about it. Something a friend/family could have told me. At the same time i was collecting data on my insomnia for 2 years for a solid case. VA immediately denied my migraines, but scheduled me with a psychiatrist for the insomnia & that went through. My own work with no help from them at all. I told them about my increase & next thing you know i have a $5,500 bill sitting in my email. They basically slapped their name on my work. I roughly calculated it up. 4 total calls spanning 2h of time. 2 of which were the onboarding, 2 were my coach. I told them this in an ********* got a call from a Claims Rep saying she would look into it & get back with me. That was back in early ********** heard nothing since, but best believe CI has sent me an email about payment like clockwork every week. Dont get me wrong, i would have absolutely no problem paying for help at all, but there was no help, no insight, *********** told the rep this. I'm not paying any service bill because there was no service given at all. It's just fraud & scamming on veterans needing help.

    My experiece was mixed. I liked my coach and the others i dealt with. Nothing but positive with folks i talked to. However I was under the impression they would be of a lot more service. After the ******* session i was pretty much on my own other then random contacts. Only real help was contact with people to help with the nexus letters. At a fee of course on top of the 14k i was charged by them. Felt that for the insane fee they charge they should have been of more help. Another odd issue was on original claim they called me for update the day i recieved notice of decision. Then they did the same on the day i recieved my appeal decision. Coincidence maybe... bottom line is i felt the fee i was charged was not justified for the work they did.
