On 12-31-21, I entered into a contract agreement with ***** ***** (Owner) DJ's Roofing to have work done in my home on 2 Rooms which involved drywall, painting, and replacing baseboard/Crown molding. We both agreed upon a price of $2800 with a $1500 deposit before work could start. I asked for ***** ***** to write me up a contract on the price and detailing our agreement which he did that same day. I wired ***** ***** $1500 from my bank through Zelle directly into his account. He promised me that work would begin that same day and would be completed Saturday 01-01-22. ***** ***** and another worker returned later that day with only a portion of the supplies and materials to start the job in my home. He advised me that he made a mistake on supplies when placing his order with the Material Company and needed $350 more dollars. I told him that we'd already agreed to a price in the Invoice Contract he sent me, but that I'd give him an additional $175 toward my deposit to help expedite the process. He agreed and I cash app him the money. He promised me that he'd be back after lunch with the rest of the materials to begin working in my home. He never returned as promised. He said that he'd return Saturday to start work and be completely finished Sunday, but ***** ***** didn't return those days either. After numerous phone calls and text messages, he finally returned my calls and stated to me that he'd had trouble finding workers to do the job in my home. At this point I told ***** ***** that I did not want to do business with him nor DJ's Roofing and I wanted my deposit returned to me ASAP because he'd breached our contract agreement. ***** ***** told me that he didn't have my deposit to return to me because his working capital account had been over drawn and that the earliest he could return my deposit was Tuesday 01-04-22. He lied about that too, because he never called me as promised or showed up to my home to return my deposit. I will be pursuing legal charges.
