      My daughter ***************************** was a cheerleader on the Senior 3. My daughter was made an alternate and asked to sit out doing practices. When my daughter join the gym the skills were not required. My daughter is a survivor of ****************** in which she tends to move slower than others , I have paid $180x 4 for competition fees that my child wont participate in. $185 for February tuition and hotel deposits. I will like my money back and a resolution

      Per our contract, our clients register for the entire season and agree to a no refunds policy should they quit.  The child

      that she is referring to is 18 years old and she, along with all athletes on her team, were informed at the beginning of the season what was expected of them as athletes on the team.  One of those requirements was continual weekly tumbling training to work The complainant was aware going into this season, per her signed contract, of the terms of the commitment and our no refund policy, to which she signed.  This adult athlete was placed as an alternate, along with other athletes, because she didnt not have nor was she working on obtaining skills needed for the team.  This has been discussed with the athletes individually and collectively that if they werent working on obtaining required skills they could be made an alternate on the team.  They were told this again in November, December and in a parent meeting in January.  Her adult athlete did not utilize the gym time included in her tuition until recently, to begin working on her tumbling skills.  Therefore, she and 3 other athletes were made alternates for the next few competitions.  During a meeting with her adult athlete we also informed her that if she got in the gym and we could see she was working toward her skills regularly, there would be an opportunity to no longer be an alternate.  Since that meeting we have now been threatened both personally (she has dislocated my personal address and number and told people on social media to have a field day) and professionally - she reported untrue claims to a professional organization I am a long standing member that I was drunk at an event - not only does she have no proof but I have many many people that were with me that day that will report otherwise.  She is now also claiming that her adult daughter has ****************** (which was not disclosed to us nor listed on her form - as required- under medical conditions.  This type of diagnosis involving bone cancer would require a release from a medical specialist and that release would be required prior to being involved in a high impact sport like competitive cheerleading.  I have full contracts to substantiate our no refund policy, with her signature accepting and acknowledging the policy, and a copy of the registration form to prove she never disclosed a medical condition and screen shots to backup my claims of personal threat.  I am also including proof via social media by the complainant where she states she quit and was not released from the team.  If additional information is need or you would like a copy of the police report for the threat she made against me and requesting others to have a field day, please let me know as I or my attorney would be happy to provide any additional documentation needed.
