      Date of Written Estimate #**** for Irrigation/Drainage Work: April 14,2022 Date of Oral Agreement to Add Installation of Hose Faucet to Scope of Original Work associated with Written Estimate #**** : April 20, 2022 Date of Initial Payment: April 20,2022 Amount of Initial Payment: $4,862.50 Date Irrigation Work Initiated: May 18, 2022 Date of Walk Through to Complete Work: May 24, 2022 Date Problem was observed and brought to attention of Austex:5/18/2022 and 5/19/2022 by phone, 5/20/2022 to ******** on site, and on 5/24/2022 to **** on site and to Mr. ************************* by email.Problem: Hose Spigot/Faucet installed but fails to function except when the irrigations system is actively watering some part of the yard. I specifically requested that the faucet be able to be used to hand water my flowers separate from any part of the irrigation system being turned on.I requested ******************** consult with me about how this problem could be fixed but he has refused to meet or fix the problem. He denies the problem exists despite the fact that his tech, ****, specifically stated that the faucet cannot be operated unless the Master Valve for the Irrigation System is turned on.

      We have satisfied all aspects of our scope of work set forth in the agreement. The hose **** was not part of the contract, but in good faith, we agreed to install the unit at no additional charge. We are an irrigation company and our hose **** applications are always tied into the irrigation system at the nearest mainline or lateral line for the system. The hose **** functions fine as is with the master valve on so that the lines are pressurized.  There was no agreement made that we, as an irrigation company, would install a hose **** to function independent to the irrigation system, nor has this customer paid for any such application. If she wanted this to be independent to the irrigation system, a licensed plumber would need to be commissioned to complete the application. We were commissioned to provide an irrigation system and a drain system for this customer per our contract and to date all aspects of the contract have been satisfied. This customer is in breach of our agreement per the terms and conditions she agreed to. This complaint is baseless and nothing more than an attempt to bully Austex into providing something that was neither part of our contract or agreed upon in any fashion.  Per our terms and conditions, we again ask that the delinquent invoice be paid to avoid legal action for the apparent theft of services occurring at this time.

       Complaint: 17295601

      ******************** has intentionally misrepresented his contract with me which included not only his written estimate for the scope of work but also his verbal explanation of what work was to be included.  After I received the written estimate on April 20, 2022, I immediately called his office to remind him that I had requested a hose bib to be installed for use in hand watering my flowers when the irrigation system was OFF.  He was not available to take my call but called back within a few hours.  ******************** admitted that he had forgotten to include the hose bib on the written estimate but assured me that it would be included in the scope of work at the same price listed on the written estimate.  He never stated or implied that the hose bib would be provided free of charge.

      I only agreed to have him do the irrigation and drainage work after he clarified this detail.  Please see my email that followed this conversation on April 20, 2022.

      I do not agree that this complaint has been resolved. 
      I have made it clear that upon completion of the work, as he originally described it in the phone call on April 20, 2022, I will pay the original billed amount.

      Mr. Thompsons allegations that I have engaged in bullying and theft of services are false and libelous. 
      Even if he does not agree with my perspective, there is no need for him to become verbally abusive.

      This complaint is nonsense and nothing more than an attempt to defraud my company. We were commissioned to install an irrigation system and a drain system, which was done several weeks ago. The distraction about a hose **** and its functionality is not pertinent to our legally binding agreement. Continued non-payment of the delinquent invoice will result in both criminal and civil theft of service charges. I also ask that this frivolous complaint be closed, as its a waste of time.

      I am rejecting this response for 3 reasons:

      1) Austex has failed to address my legitimate  complaint.

      2) Austex misrepresents the facts. As I explained in my prior messages, Austex has failed to complete its contract with me.

      3) Austex's most recent response to my complaint continues to be disrespectful and abusive.
