      My neighbor wanted to put in a pool. He hired this contractor. The land between my neighbor and I was needed for the trucks to deliver the personnel, materials, and equipment to build the pool. My driveway was driven over by these trucks. After the pool was done, my driveway was cracked, my driveway was chipped in several areas, muscular of the lean was destroyed, and the sprinklers below the lawn was also destroyed. To take care of the crack the contractor told me he would come over to put chalk lines for how he would resolve the issue. I received pictures showing this and he told me he was going to proceed on cutting the lines. I told him to stop and that I didnt approve this as I wasnt home. I came home that evening to find my driveway was cut. Now action is required to fix it. The neighbor provided me the contact information for the contractor to work a resolution. After a lot of back and forth, the contractor is not being accountable. I have received 3 estimates which are all about the same. I just want to move on since I stare at this daily making me request the financial compensation equivalent to my estimate. The contractor is unwilling to pay this nor develop any plan to give me confidence he will resolve this in my best interest.

      The complaint that ****** has sent in is correct. It is missing some info, but it is correct.

       

      There was a small crack in ******* driveway caused by some or all of the subs that came through and worked on the pool. We do not know which one, but know it was not there prior. I had my concrete contractor go to ******** house to give me an idea of what they thought was the best way to repair the crack. They place chalk lines on the concrete where the current cut marks were. I told them to let me contact the customer to verify that he was OK with he repair. When I called them back after ****** told me no I found out they had already cut it.

      Myself, my wife (owner) and my customer Tyler (******** neighbor) met to discuss what could be done. I suggested that the least noticeable would be to repair that area that my contractor cut, or to cut out the larger area at the expansion joints. ****** was not OK with either of those options, and insisted that I replaced his whole driveway and sidewalks. That to me was just absolutely not even an option. He has threatened me with calling the police on vandalism charges, and just absolutely not been agreeable to anything. When he found that I would not budge on the whole driveway part, he then sent me a drawing to add concrete around the side of his house all the way to his backyard. This is no way fixes the problem, but I guess made him feel as though he was getting something.

      So now he has bids from several "licensed" concrete firms that exceed even his insurance bid. So once he got those he told me to pay him $5,000 and this could go away. This concrete repair would have cost me at the time, $300 to repair the cut section, and $600 for the panel. So $5,000 seems to me excessive. He has now come and said he will accept $3,000, which after rounding up is what his insurance told him. This is to repair exactly what I told him the night we met. We would be done.

      The neighbor who I built the pool for was, from the very start handling the landscape and sprinkler portion of this, as it was know that trucks would mess that up. That has no bearing in this conversation at all.

      It is time to be reasonable and get this behind us. I can not just pay crazy amounts for something I offered originally. I'm ready to be reasonable at any point that ****** is.

      I still think the best thing for aesthetic purposes and function would be to repair the already cut portion, however willing to discuss.

      I am rejecting this response because: this response doesnt solve anything. I dont trust ***** because he said he was going to be chalking what would be cut, I received pictures of the chalk lines and he told me he was going to have it cut. When I immediately replied and I told him not to, he had it done anyways so I cannot trust him. This has gone on for some time and the conversation he mentions at my property where he said he wanted me to be happy has resulted in nothing but frustration without results. I am requesting that we handle this outside of court with him paying me $3k or we go to court as this is what my cheapest estimate is. I dont trust him; thus, I dont want him doing the work.
