I purchased the vehicle on July 13, 2023 the business said there was no problem with the car except a broken windshield he fixed. On July 14 I took the vehicle to get an oil change when the mechanic lifted the car he began to see all of the mechanical issues the vehicle had including the gas filter being screwed on to another part of the car causing an oil leak as well as, the oil plug being broke, the oil spilling, oil being caked on the transmission as well as on top and the bottom, the engine began saying low battery voltage, and the oil pressure being saying low because the oil that was put in the vehicle was being spilled out. The business never told me any of these issues with the vehicle I contacted the business and he refused to give me my down payment back of $5,000 saying that the car was sold as is I continued to explain that what he sold me was a lemon he also failed to tell me I could take the vehicle to my own personal mechanic. He never gave me a contract all he gave me was a paper stating the amount of the vehicle, the price for the license plate, the down payment, and the remaining amount due. All I ask is for my down payment to be given back to me and I will return the car this vehicle is not functional anymore.Business response

The day of the purchase we encouraged Ms. ******************** to bring a mechanic to check the car before taking it, her step dad came and checked the car, I have no knowledge wether he is a mechanic or not she also told me that before buying the car that she took the car to a mechanic, then she came a couple more times asking info about the car we did replace the windshield, since it was pretty obvious that it had to be replaced, she claims the car has transmission issues but we id drive it to the store to put gas in it or simply to test drive it myself I found no issues with the transmission in fact the car ran great, the car has 220xxx miles and she still decided to take it, nobody forced her to buy the car she made that decision herself, she is a grown woman capable of making her own choices and I can't simply return the money because she no longer likes the car, also she signed the buyers guide of the vehicle being sold "AS IS" which means there's no warranty on the car after you take it, she also brought up the ****** LAW" which only applies to new vehicles not used vehicles, and she also signed the "arbitration agreement" that I have attached.

I am rejecting this response because: What was said was a lie they never told me to take the vehicle to a mechanic and I was never given the vehicle before the payment to take to a mechanic I never took or told them my personal mechanic took a look at the vehicle that is a lie. My stepfather was never given a disclaimer of what was wrong with the vehicle and it was never disclaimed to me the mechanical issues wrong with it I am a grown women who can make my own decision but they are also grown men who lied to a person knowing what was wrong with this car.
