      On 4-15-24 We agreed to have Mclean Landscape do our landscape work. They were suppose to excavate for yard to fix drainage issues. Fix sprinkler heads to line up with new excavation. Lay sod in front yard and lay rock in culvert for drainage. Also clear flower bed and plant new flowers, replace irrigation and lay tarp to prevent weeds and top with rock. When excavation company came out, they did a very poor job and tour up my neighbors yard. ( Mclean's never showed up to show them what they needed to do. Mclean's had to hire another excavator to come out to fix issues. ***************** suggested 3 more loads of dirt to do job right. Mclean's did not want to. Drainage was not fixed correctly. Mclean's said they were going to remove all old grass to lay new sod. They never did and laid sod over old grass instead of clearing. After sod was laid, they noticed a few dips in yard, but never fixed. 1 sprinkler head was broken, 2 sprinkler heads were below the ground. I notified Mclean's about issue with ********* heads and they said that her husband could come out and raise sprinkler heads. They never came out. I called ********* landscape out and they fixed 1 sprinkler head and the next day I bought and raised 1 myself. Also, after sod was laid Mclean's never turned sprinkler system on. So fresh sod was not getting any water for 2 days before we noticed and turned on ourself. Mclean's was also suppose to fix neighbors yard and never did. They took 1 pallet of sod that was suppose to be for my yard and left it by the neighbors yard and left it there for me to fix neighbors property. Mclean's also never put sod on other side of drainage rock like agreed to. I've messaged Mclean's several times letting them know that sod was not catching and flowers in flower bed were dying. They to me to up watering times. They never once came out to look. Apparently everything was getting too much water. The last storm that came in washed away most of sod in yard.       Everything was done correctly on our part as we sat there and watched Mr. ******** irrigation going off with every head working properly. All grass was being watered before he handed me the check. We even discussed the 2 heads on east side of property that was watering dirt and would cause an issue with erosion if he didn't add sod or rock.
      I even had employees standing there with me watching the irrigation go off before we left the job site. They also watched as I took ***************** into the garage to show him his irrigation box and the times they were set. I even set the stations to his back yard for his pool and grass areas with him right there.

      The plants were doing amazing when I left. I told them when it was raining our irrigation guy said it was crushing a plant. ******************** said he knew and he needed to fix his gutters there. The yard definitely was getting irrigation and Texas hit a heat wave after the yard and plants were done.

      We discussed the top area on the hill needed to be fixed and the side left of the house needed sod but he wanted house corner to drive. The drainage on that hill and side especially where left gutters run needed to be fixed. We weren't fixing his drainage problems we were hired to fill the rutted yard, add sod and raise heads.

      That area was their main problem but wasn't part of our projected bid.
      The black drain spouts at left side was crushed before we even started and the drains in beds we mentioned were plugged up. He said he'd handled that because he knew they'd be a problem. Also those drains would hold too much water in bed if not fixed and could be too much water for plants.

      We fixed the dirt, irrigation initially as the original bid stated, added dirt, added sod, plants and rock. The rain caused more run off from the first gentleman's dirt work and we added more dirt. My 2nd dirt guy knew the project as I met with him. To properly make the water flow he had to cut into the neighbors side because the drain was covered. The drain that goes under the road to keep Mr ******** west side from flooding. It was blocked off and needed to be cleared.

      Our job wasn't to fix the Shepards drainage at the top of the hill. That's why I mentioned to add the drain with 1 possibly 2 solar pumps to help any water that flowed off to be sucked down to the ditch area. Those pumps would have helped a bunch with drainage issues. Especially with the buried drainage pipes that we could have set to come out down the ditch. That's if they weren't going to do more dirt work on the top hill of their property.
      Shepards project was done right and completed then the start of a heat wave hit.
      Everything was done correctly with irrigation turned on and set when we left. I even set the back irrigation for his pool and back yard sod. He mentioned the heads needing to be raised and said he'd do it. Which he and his wife did. I saw he made a post on ******** about an irrigation guy and followed up with him. He didnt respond back for 5 days. If heads were fixed by them did they turn the irrigation off?
      Did they not reset it themselves after adjusting heads? Or was it ever turned back on? 

      ***************** also mentioned that he wanted to cut the costs of sod being laid on the other side of drainage rock. (Road side)
      He wanted to use that sod to fix his neighbors yard which he mentioned he'd fix himself.

      I am rejecting this response because: As can be seen in 2 pictures that were attached. Our yard was never completed and our yard looks totally horrible. *** area next to the driveway, the old grass was never removed and no sod was laid. Also existing sod was laid on top of old weeds and grass. *** excavating dug up my neighbors yard. Mclean's never mentioned or asked neighbor about needing to dig in her yard. My neighbor got very upset. I do not see where we should have to cover cost to repair neighbors yard. I hand racked and shoveled dirt and laid sod myself and the grass grew great. Our yard, most of sod is dead and almost the whole flower bed is dead. 
        Mclean's said that they programmed all the sprinklers including our back yard. This is totally false. See attached messaged from Mclean's. ******* stood there with just myself and attempted to show me how to program irrigation. First if she programmed all sprinklers, why would they be sending me a text message asking me how many times the sprinklers were going off? Also, there were 3 sprinkler heads in the middle of the yard that were buried below the dirt and not spraying the yard at all. I posted on the **** community page looking for and ****************** that could come out to fix broken sprinkler heads. Mclean's responded on 6-15 saying that there irrigation guy could come and fix and then said the husband could come out and fix. On 6-17 ******* from Petersons Landscape came out to give me a quote and fixed 1 sprinkler head. Which was one of the sprinkler heads that was buried below the ground and broken. While he was there, he set sprinklers for us. Non of the system was programmed. See attached text From ********* with proof. On the 6-18 we went and bought sprinkler heads to fix another sprinkler that was buried and needed to be raised 7 inches. We messaged Mclean's on 7-2 asking the husband to come out and check irrigation. While he was here, he noticed another sprinkler head by the driveway that was buried below the dirt. If *** system was working so good while they were here, then why would there have so many sprinklers heads buried below the dirt? While this was going on I messaged Mclean's on 6-20, 6-25, 6-29, 7-2, 7-3 7-8 7-10 and 7-18 explaining issues with the front yard and flower bed. ***re response on each occasion was to up the water settings. But yet made a comment in reply that bed would be flooded because of clogged drain pipe. How could one possible drain pipe cause almost every flower in the flower bed to die the whole length of the house with 2 different flower beds? 

        *** services from Mclean's Landscaping were substandard and resulting in numerous issues

         *** initial excavation was poorly executed and damaged the neighbor's yard. Mclean's failed to supervise the excavation and subsequently had to hire another excavator to address the issues. 

         *** second excavator suggested additional loads of dirt which Mclean's refused, resulting in improper drainage.

          Mclean's did not remove the old grass before laying new sod, leading to dips in the yard and failing to fix them. 

          One sprinkler head was broken and 2 were below dirt level. Despite notifying Mclean's Landscaping, they failed to address the sprinkler issues. 

         Mclean's Landscape failed to program sprinkler system along with broken or buried sprinklers causing sod to die.

         *** company said they would fix neighbors yard when our project was completed but never did so, leaving one pallet of sod for our yard to fix neighbor's property

         Multiple attempts to contact Mclean's Landscape about failing sod and dying flowers were not met with inadequate responses, advising to increase watering times without inspecting the situation. *** over watering resulted in further damage. 

        Despite numerous messages to Mclean's Landscaping, the company has not responded or taken any corrective actions.

      Mrs ********************** showed ******************* each station front and back yard.
      Irrigation was set for 4:30am and 9:30pm daily. ******************* was advised the first week to water two times a day with the heat hitting. This was a good 15 minutes in his garage. The irrigation was on and scheduled when Mrs ********************** left the job site on June 13th. Her employees waited for her as she instructed ***************** on his watering schedule. Water could be adjusted the following week if it was getting enough water.

      Sod was laid June 12th and finished on June 13th. When leaving Mrs ********************** mentioned the head being raised and he said he will fix it since it's an easy fix.
      Mrs ********************** messaged ******************* on June 15th that they could get the one head raised asap if still needed with no response back. It was watering the yard perfectly fine but could use a raise in the yard. McLean Landscaping could have sent the irrigation company that was hired to handle the shephards job. We would have sent them out to raise the head they initially raised. The rain and flooding before planting caused more dirt run off after initial dirt and irrigation was laid.

      As stated by ******************* on June 16th and 17th ********* came out and fixed irrigation.

      ******************* then messaged June 20th about having someone raise a head and extend another section.

      If ********* came out and fixed the situation why wouldn't they have raised it and extended for the new section?

      June 29th ******************* messaged the yard was doing good and growing great.

      McLean Landscaping did not refuse dirt for the yard. We have a specific dirt guy we work with so we had him deliver the loads instead of the excavator owner.
      There's a huge cost difference between the two.

      The initial excavator is not the one that damaged the land as stated by *******************. McLean Landscaping offered to take care of the property. The excavator took it upon himself to clear the land and we offered to cover the costs.

      Again, the pallet in neighbors yard, ******************* asked McLean Landscaping to buy and he would lay it to shut her up. He used a few other choice words. ******************* said he'd buy a pallet of sod because he knew this area needed to be graded to help improve for drainage. McLean Landscaping mentioned the pallet of sod that wasn't being used to put along the road and drainage rock could be used in neighbors ditch area. No extra costs on Shephards end just using a pallet that wasn't needed for project any longer.

      The entire yard was raised and dirt was added to cover the huge ruts all across the yard. McLean Landscaping has dirt orders that there was enough dirt and that the customer was satisfied with the excavators work.

      There were not broken irrigation heads when Mrs ********************** left the site on June 13th as ******************* states.

      Shephards mention overwatering but then states that irrigation system had failed. He said that it wasn't on and if ********* set it up then did they schedule it and over water?
