On July 28, 2021, the Texas Medical Board filed a complaint before the State Office of Administrative Hearings.
The complaints against Jon Peter Ver Halen, M.D. allege violations of the Medical Practice Act. The complaint against Dr. Ver Halen alleges he failed to meet the standard of care in his treatment of two patients. Specifically, it is alleged Dr. Ver Halen performed multiple procedures on a patient including a breast procedure, tummy tuck, and liposuction on a patient without adequately evaluating the patient and without ensuring that post-operative practices and procedures were followed. It is alleged this resulted in the patient having chronic pain and disfigurement. It is further alleged Dr. Ver Halen failed to create and maintain adequate documentation of his evaluation of the patient, post-operative care, and related billing.
Another allegation is concerning Dr. Ver Halen's failure to meet the applicable standard of care by failing to perform and/or document that he or a delegate performed a physical examination on the patient before several surgical procedures performed on or about December 4, 2018. It is alleged Dr. Ver Halen improperly delegated a Cellfina procedure to treat cellulite, to his wife, a Texas-licensed physician assistant, and failed to provide adequate supervision during the patient's assessment and the Cellfina procedure itself. It is also alleged Dr. Ver Halen failed to document the patient's post-operative results with photographs.
On April 25, 2022, The Texas Medical Board suspended Dr. Jon Peter Ver Halen, MD's license, however, the suspension is stayed, and was placed on probation until Dr. Ver Halen makes a written petition and appears at an Informal Settlement Conference before a panel of Board representatives. Dr. Ver Halen is to meet the following conditions: Dr. Ver Halen shall not engage in the practice of plastic surgery or cosmetic surgery, anytime a physical examination on a female patient is performed Dr. Ver Halen is to have a chaperone who is able to directly observe during an examination. Surrender his Drug Enforcement Administration Controlled Substances Registration Certificate for all Schedules II and III controlled substances. The authority to prescribe, administer, possess, or dispense such controlled substances is limited until he has received written authorization from the Board after a written petition and a personal appearance.
It was ordered Dr. Ver Halen pay an administrative penalty of $2,000.
