      My company is called NIA ********* we are in *********, ********. We service aircraft interiors by doing upholstery and flooring. We had a well know customer in the Aviation industry ask us for aircraft cabinetry services. The surfaces on the wood interior pieces had cracks on the clearcoat surfaces. Customer recommended we do a strip and refinish of clearcoat to help remove these cracks. We decided to outsource our work to an associate ***********************. ****** has a fairly new company in ********, *****. He called multiple times in the past 2 years asking for NIA ********* to outsource him wood work in aircraft interiors. We finally decided to him an opportunity on this recent job. It was 15 components not every surface had cracks just certain areas and pieces. I explained to ************** that there is a budget of ****** dollars and that if it involved more costs than that to complete the job then we would have to find someone else to perform the work. He verbally promised and agreed to the job and terms. He then sent me several proposals until the one we uploaded here was accepted by me. He explained to me that the ****** would also include travel costs of pick and delivery and other services mentioned in the proposal. On December 5th, 2023 ************** sent over his daughter and others of his work crew to pick up items for servicing. The proposal made it clear he would complete the work within 4 weeks of receiving deposit of ****** dollars and the 15 work items. At the end of December 2023 he called me requesting an additional 2 weeks and a progress payment of ******** or else he would not return the work items. During the first 4 weeks I requested photos of the work process and ************** would not provide any photos. This was very concerning. Then on January 2024 he delivered the work items with none of the clearcoat cracks repaired. I had 2 different contractors confirm that he did not do the work in the proposal. He performed a scuff and buff not the strip and refinish.

      This contract is null and void due to the fact that these cabinets were under warranty,and the individual *********************** did not pay the balance on this contract and is still due.The warranty work is null and void after the person,***********************, works on these cabinets under his own knowledge with a different contractor and not allowing our company to finish these cabinets.The minute he touched these cabinets,,by working on these cabinets and never send them back to our company is contract that is no longer valid.The unpaid balance is still being utilized by ***********************.

      I am rejecting this response because: The contract was never completed and processes stated in the contract were never performed. If the contract were to be null and voided its because the vendor did not perform the work and additional services promised in the signed and deposited contract. The contract specifically states per customer approval and an approval by me, *********************** the customer was never given. I even went beyond the contract agreement to provide an additional progress payment because vendor was extorting a payment in order to begin delivering the proposed finished work. The vendor stated "warranty work" in recent response but ignoring the fact that the contractual work was never accepted or completed as agreed it would be in the contract. A vendor cannot warranty work items for work he did not perform or complete. This was made clear to the vendor and they are just ignoring the fact that they have taken my money to provide poorly performed services I did not agree to. The Vendor S.A. Jet Services has taken money from me for services he could not perform or complete in their stated time frame. I have already made the suggestion to return funds they have received for services they did not render.
