      I engaged ************** to do a variety of work on our house as we readied it to be be listed for sale. Our pave stone patio had to be re-leveled, the patio cover needed to be replaced, the front and back yard needed to be re-sodded (**** pallets), the fence needed some minor work and a small tree had to be removed..Note, one month previous ************** had replaced 30 windows at a cost of $7500.When they were prepping the yard to be re-sodded, two workers came to the house. This was Thursday, August 3. One was the ******* of the group (****) and there was just one other worker. That worker was using a line trimmer and cutting the existing ********** at the ground. As expected, there was a lot of debris ejected and when he was close to the house the windows were peppered dozens of times. My wife and I were sitting in the den at the times (which is in the front of the home) and we both remarked we hoped a window didn't get broken. Once work moved to the side and back of the house I paid it no mind. On Monday, August 7, we were cleaning in the front of the house and discovered a large window in the formal dining area had a crack in it. I immediately texted ************** and he apologized and said he hadn't previous broken any windows. He asked me to send some photos, which I did. After this communication was by email and, essentially, he absolved himself of responsibility. He talked to ****, who acknowledged that his crew had broken windows before but denied responsibility.My last communication with ************** was August 19 and he said he was on vacation and was "discussing with ****". That was his last response.The day I discovered the broken window I called ************** and they gave me a quote of $745.38. I paid the 50% deposit then and the remainder when it was installed on August 17. His refusal to accept responsibility for his worker's damage is neither ethical nor professional. I would not use him again would not recommend any others use him either.

      *****************, again I am sorry this window damage happened to you. However, you are drawing a conclusion with a lack of direct evidence. The facts are yes you hired me to execute several projects at your property.

      My ******* & his crew were weed eating on 09/03. As in any weed eating debris does get thrown. You would have heard debris hitting the window. When that large crack occurred you would have heard a significant sound.

      After crew finished on 09/03, my ******* walked the perimeter of your house. No window cracks noticed. I spoke to my ******* after your email complaint & he stated 100% no way was his crews weed eater capable of that single large crack. Furthermore, I recently had my crew replace some ************ sod in my yard. I heard the weedeater debris hitting my window. The weedater throws small debris that hit our windows. I asked my *******

      to weedeat a rock about a half inch in diameter at my property. A rock possibly capable of breaking a window thrown at a forceful speed. After the weedeater line hit the rock, the rock only moved a couple of inches.

      Another fact is that you had many contractors at your home doing work.  Did you check the windows after you heard the weedeater throw rocks on the windows? Again that damaged window would have created a significant breaking sound. Not just smal debris sounds. My ******* has weedeated near thousand and thousands of windows over the years and said any small amount of windows that he is broken in the past created a shattering of a window rather than a single impacted crack.  THAT CRACKED WINDOW WAS BROKE BY A SEVERE IMPACT. I believe that I am innocent and not convinced with certainty that my crew committed any wrong doing.
