      On or about July 14 2022 I contracted with Titan Fence to obtain permitting and then installation of a fence on our church property. Titan fence applied for the permits form the city and the permit was denied due to city setback policies. Upon denial of the permit by the City of Garland Titan Fence began claiming they had purchased the fence material required for the project and demanded that we purchase the fence from them. At no time did we ask or agree to Titan fence purchasing the material BEFORE City permitting was approved. For a professional fence company to make such a huge mistake is unprofessional and not at all the fault of the consumer. Titan fence then began harassing members of our staff with threatening email invoices and finally began sending certified mail demand payment of $20,180. Titan fence has performed no work on the property and had no authorization from our organization to purchase any material before obtaining a valid permit from the city. It appears that Titan fence is merely trying to bully and take advantage of a community church. We did not agree to or approve the very poor business decision to purchase material BEFORE THE CITY GAVE APPROVAL for the project. We demand Titan fence cease all contact with our organization, including threatening email and postal mail.

      Business Response /* (1000, 10, 2022/12/27) */ Contact Name and Title: Cindy *******, Office Mgr Contact Phone: ********** Contact Email: ******@titanfence.com On May 12, 2022, ************************** reached out to our office and requested that we meet them on site to go over what they were needing to provide them with a fence quote. We reached out to them to schedule an appointment to meet with them on site May 17th, 2022. After meeting and multiple back and forth conversations to clarify any questions, they had. They had indicated upon receiving our initial bid they would carefully consider it as they were getting other proposals. ************************** approved our proposal and signed a contract with us dated May 29, 2022. Our contract when signed and dated by ************************** was authorization to proceed with procuring the materials needed for the fence install. ************************** wanted us to file for the permit on their behalf, which we did at no additional charges to them. We were just a conduit or intermediary with them and the city by filing the forms and documents they gave us with their buildings on them. The document was marked to show the fence locations per the meeting with ************************** and the direction on site with **************************. During this time, we went back and forth with ************************** to produce custom CAD drawings we were providing for a custom swing gate they were wanting which was a part of the scope for them to approve. ************************** approved the CAD drawing on June 14th, 2022, after multiple revisions we received approval from them. We proceeded to cut, custom fabricate and powder coat all the custom panels and posts for their job during this time. They knew their product was custom and that everything had to be fabricated from scratch as they elected not to get a pre purchased product that we offered and quoted them as an option. They had told us time was a key factor and were always on us about moving forward and when we would start. They even proceeded to call to our office and check on the status multiple times as well as emailing Jason quite frequently. After review by the city, it was found that *************** had owned two separate lots, one of which was not zoned correctly as it was recorded as a residential lot. The City of Garland would not allow front fences past the build line on the lot that was zoned residential. We went back and forth with the city to see what the options were at this point so we could inform **************************. We advised them according to the city their options were to apply to change the zoning to commercial or another faster option to submit a request to the board of adjustment for what would be a variance. In talking with the city this would more than likely get approved and would be a two-to-four-week process but needed to be presented and overseen correctly. We received an email back from *************** saying they have spoken to their team, and they had opted to forego either option and would relocate the fence to a different location. He asked at this time if we could come back out and verify the new layout and provide updated pricing. Because the materials were already fabricated and ready to install, we informed ************************** that the material cost would be fixed if the scope were reduced. After giving them the new proposal for the new layout we had not heard back from **************************. We reached out and tried to follow up with him. We informed that we were higher than another quote they received, and they were not going to use us. We asked if they wanted to buy the fabricated materials that they authorized on original signed quote. We told them that we could deliver the materials to the site. At this time, they just stopped returning most calls and when they did answer they were very nasty and disrespectful. The owner of Titan Fence tried to call and talk with Mr. ******* to reiterate what Jason had told them, but he did not care or want to hear it. We said we were willing to collaborate with them, but we at least needed to recuperate our costs associated with the things that were agreed to. He asked that we do not contact him again and hung up the phone. After this we did not contact Mr. ******* again and proceeded with the lien process to protect our lien rights. The proper notices were sent, and a lien was filed. Prior to filing the lien, we had our attorney review the documentation that we had on file. Our attorney verified that our lien claim was legitimate. The claim of harassment was simply calls to collect a debt and then the filing of the lien. This is standard practice in most companies. Hope this clarifies our position and the actual events that took place and the timeline of events. The fact remains that Titan fence fabricated and purchased materials PRIOR TO obtaining the city permit which the city refused to give to Titan on their project. They are a professional fencing company and they know they don't have a project until the have a permit which was 100% their responsibility to obtain PRIOR to purchasing parts. Titan fence made a bad business decision without our approval and now wants us to buy them out of they incompetence. This company ended up putting a lien on our property and we are contemplating a law suite to force them in front on a judge, to make a legal ruling. If you want to avoid this type of hassle. Find another company, these are not reasonable nor honest people.
