I’m May of 2022, I hired RETROCUBE to fine tune work I had already had done in an app and to launch it. They provided a quote of 5600 usd, (8+k Canadian) to complete the work in 40 working days. After 6 months there was still no proff of work being done and the app was not completed. I was then referred to the owner who told me they had completed their contract and everything they were doing now was a bonus to me. But I was never shown any of the work that was completed and to this day they won’t take my calls, answer my texts or emails and I have nothing to be shown for the work they did almost a year ago that was only supposed to take over a month.

RetroCube, LLC entered into a ******************** Agreement with my company *********************** on August 22nd, 2022. I paid RetroCube a total of $4,000 upfront to develop our website. As of the date of this complaint submission, their assigned developer/contractor has yet to deliver any viable product. I have not even received a prototype. The communication from the developer is always in the form of an email and there are times when weeks go by without any response/feedback from him. We were originally expecting to launch the new website around the end of October 2022. Per the agreement, it states in paragraph 1 that we should receive the software within ***** working days of providing payment which was made on August 22, 2022. My business has been greatly impacted by this and at this stage, we view this as a breach of the original contract. If the website can still be delivered within the next two weeks (20 to 30 working days beyond the original agreed upon delivery date), my expectation would be for RetroCube to negotiate a partial refund due to the breach on their end. Their failure to deliver the product during the holiday season as anticipated impacted my bottom line since having a working website during that period would have generated the most business for us. If RetroCube cannot deliver in two weeks (January 5), I am requesting a full refund of $4,000; I do not wish for this to drag out any longer. The contact phone number for the company listed on the attached agreement is no longer in service.

We are writing to inform you that our valuable customer (*********************) started a project with us to develop a professional, custom-built website to support the expansion for his laundry business with the name SLEEK LAUNDRY COMPANY.

Despite a slight delay in the timeline, the website was designed and developed successfully. However, ********************* expressed dissatisfaction and requested a refund. *****, our team has put in effort and time so refund is the total loss for us.

RetroCube clari?ed with ********************* that the project was indeed complete, with only the ?nal steps remaining, such as connecting the website to his third party system which he was using earlier to run the business.

Instead of letting us complete the remaining tasks, ********************* chose to abandon the project and subsequently engaged in defamatory actions through channels such as the Better Business Bureau (BBB),LinkedIn,Google Reviews, and others.

*********************, also changed the password of the third party portal (**************************) which was required to be linked with his newly developed website by RetroCube.
Consequently, neither this third party portal is linked with the website nor the website is fully functional despite being live.

The address of the *********************** website designed and developed by RetroCube is *************************

We tried several times to contact ********************* to get the updated password to link it with the website, but he is not responding back.

Therefore, now we request BBB to convey our message to ********************* that we are 100% willing to complete his project and he can get back to us anytime.

Resolving this complaint will reinforce our dedication to customer care and underscore our willingness to go above and beyond to ensure a positive experience for every customer.

In the end, we are thankful to you for inquiring about this complaint and knowing the fact that we are 100% willing to close this complaint positively by providing the required services to the customer.

We value our association with BBB and remain committed to upholding the highest standards of customer service.

Please do not hesitate to reach out if you require any further information.

      Customer response

      03/17/2024

RetroCube, LLC responded to my complaint months after the fact and in their response, they simply state that they delivered on the product requested within the software development agreement. Here is where they are confused and quite unprofessional.

Contractual agreement is another term sometimes used in place of contract. Thus, a contractual agreement is a legally enforceable agreement entered into by two or more parties to do, or refrain from doing, one or more things specified in the contract. A contract is also time bound, expressing that time is the quintessence of the contract. A Contract Period is any number of days, as outlined in the contract, that the contract will run for. This is also known as Contract Time and is the length of time between the start date and specific end date.

Retrocube, LLC violated the software development agreement established with my company on August 22nd, 2022:

Section #1 "Duties and Responsibilities", RetroCube states, "The Software, including all versions in either source code or object code form, shall be delivered to Buyer within ***** working days of receiving the payment." RetroCube, LLC did not even deliver a working prototype within that time window and communication with their hired developer was intermittent and at times non-existent (no response to emails).

Section #5 "Development Staff-Monitoring", RetroCube states, "Each party agrees that upon receiving a question or inquiry from the other party, it shall respond to the question or inquiry by the next business day.". I have evidence where their hired developer went days without responding to my emails or inquiries and requests for a simple phone call. I have every email communication and can demonstrate the absence or lack of a response per their contractual obligation.

Section #9 "Term and Termination", RetroCube states, "In the event either party defaults in any material obligation owed to the other party pursuant to this Agreement, then this Agreement may be terminated if the default is not cured within twenty (20) days written notice to the defaulting party."  I not only sent email communications and a certified letter, but I also posted a message a the LinkedIn profile of ***********************, identified at the time as the signer and their AVP on the contract. The default was never cured and no one has responded up until this point and the response was not even directly to me, but rather to a BBB posting I made months ago.

Because RetroCube did not even come close to delivering the product within the agreed upon contractual time period, my business suffered and RetroCube is in breech of our agreement. My only request was for a cancellation of the project and a refund. So, this response to my BBB posting from RetroCube defending their actions by stating that they delivered my website is unacceptable and unprofessional. I entered the agreement in August of 2022 and I am most positive that they cannot produce any evidence that they delivered the website product even within that year. I challenge them to produce one source of evidence that the site was delivered. I retained every communication and I am prepared to show evidence to the contrary.

To protect other consumers from being ripped off by this company and their fraudulent actions, I will be launching my new website, RetroCubeRipoff.com by the end of this month. The site will be open to any other consumers and business owners who have had bad experiences with this company. I feel that we as a community of negatively impacted parties should come together and share our stories to make the public aware. I may never be reimbursed by RetroCube, LLC for my losses, but the least I can do is make sure they don't get away with doing the same to others.

We utilized the services of Retrocube Digital to create our business website. After months and months of developing, Retrocube Digital failed to meet our expectations and didn't make the necessary changes that we submitted via email to change. In the end, we were not satisfied and requested a refund. After many conversations back and forth with their management team, they did agree that a refund was in order. It has been 2 months since they said they would process our refund and still to this day, nothing. We talked to their payment merchant, Stripe - who said has no record of them initiating the refund, and we confirmed with our banking branch manager the same that no payment was ever rejected coming into our account. They have been making empty promises that the refund is on the way and still nothing. I've tried to call and email the manager, Matt R**** and he has yet to respond to an email or phone call. We provided all the proof to Stripe, Wells Fargo and even Retrocube that payment wasn't made and still no refund after 2 months.

Business Response /* (1000, 7, 2022/07/11) */ We originally attempted to refund the amount of $650 to ***** on 17th May 2022. Upon his complaint that the refund was not received, our support representative worked with *****'s team and coordinated with his bank and our payment processors to verify the status. We again attempted to refund the amount on 23rd June 2022, and successfully transferred the amount directly to *****'s business bank account. References for both transactions attached.

I paid $45,000 for a social media app development. After numerous issues and delays I requested my complete intellectual property assets from Retrocube. What they provided is incomplete and corrupt according to the new development company that I enlisted. They continue to state the intellectual property is complete.
