Since 05/22/23 this company has been trying to get me to pay them, when I dont believe I have any contract dealing with them. If they could provide a contract I would provide what I owe. However, theyre also abusing power by leaving a stain on my consumer report. This is a unnecessary problem to have.

I am rejecting this response because:

I am writing to formally dispute an alleged debt being pursued by Williams and ****. They have failed to provide any contractual proof that authorizes them to collect this debt on behalf of the original creditor.

      Specifically, they have not provided:

1.Proof that I owe the debt to Williams and Rush, including:
      The amount of the debt.
The date the debt was incurred.
The name and address of the original creditor.
2.Documentation showing that Williams and Rush are authorized to collect this debt, including:
A copy of any contract or agreement that gives them the right to collect this debt.
Proof that they have a valid contract with the original creditor to collect this debt.
Any documentation showing that Williams and **** is the assigned collection agency as per the original contracts terms.
An affidavit from the head of the accounting department of the original creditor, verifying the debt and detailing that I owe this debt, as per 15 U.S.C. 1692g.

Without this documentation, their attempts to collect this debt are baseless and constitute harassment. I am requesting the BBBs assistance in resolving this matter by requiring Williams and Rush to provide the necessary documentation or cease all collection activities.

      Thank you for your help.

      Sincerely,

      Dear BBB,

I am writing to formally lodge a continuing complaint against Williams, Rush & Associates concerning their fraudulent and unethical debt collection practices.

Despite my repeated requests for validation and proper documentation of the debt, the company has failed to provide any proof or authorization. Furthermore, they have placed a derogatory account on my credit report, significantly impacting my credit score without any justification or prior notice.

Their practices violate the Fair Debt Collection Practices Act (FDCPA), as they have engaged in harassing behavior and have used false and misleading representations in their collection efforts. Specifically, they have:

1.Attempted to collect a ghost debt without proper validation.
2.Reported this debt to credit bureaus without my knowledge or consent.
3.Continued to harass me with calls and threats despite my request for documentation and clarification.

I initially responded to Williams, Rush & Associates complaint with the BBB on 06/11/2024 it was read on 06/15/2024. However, it has been a month since they last responded, and they have still not provided proof of a contract or any documentation to support their claim. I have patiently waited for their response, but they have failed to resolve the issue.

I have discovered numerous similar complaints against Williams, Rush & Associates, indicating a pattern of fraudulent activity and consumer rights violations. Legal rights advocates and consumer protection forums have documented various instances where this company has acted unlawfully.

Overall, the Better Business Bureau (BBB) and various consumer protection forums list numerous complaints against this company, reflecting a pattern of potentially unlawful and unethical debt collection practices

I kindly request the BBB to investigate these claims and take appropriate action against Williams, Rush & Associates to prevent further harm to consumers. I would appreciate any assistance or guidance you can provide in resolving this matter.

Thank you for your attention to this serious issue.

They have placed a total of 3 charges on my credit report. I have disputed all 3 of them but only 1 was removed. All 3 should be removed because all 3 charges were made at the same time and were all supposed to be removed as agreed during covid. Rent a Center agreed to close my account at a zero balance during covid. I bought all 3 items a couch, a washer, and a dryer in 2019 from Rent a Center. They agreed to zero out my account and close it during covid-19. I disputed these charges on my credit report giving this same information, and they removed 1 of the charges but wont remove the other 2 charges. I dont think that is fair or rightful when all of the items i purchased were at the same time and all were supposed to be closed out a d my account at zero with no mention of later reopening this account or attaching it to my credit report. They should remove all of these charges like they did with the one i disputed and was granted. Please research this and have them remove these from my credit report. Again all of these charges were originally acquired in 2019, and later agreed to be removed from my rent a center account and closed at a zero balance during covid-19.

I have attached the charge they agreed to remove from my credit report. My issue is everything I purchased from rent a center in 2019 was bought at the same time. A couch, a washer, and a dryer. Why did they approve only one of my disputes when all 3 items were agreed to be charged off because of me and my whole family having the covid virus and them not wanting to come get the items? Its not right what they are doing. If 1 dispute was granted the other 2 should as well.

I am rejecting this response because:

Subject: Dispute Regarding Debt Collection and Consumer Rights

      Dear *********************** and associates ,

I am writing to address the recent correspondence I received from your collection agency regarding a debt that you claim I owe. According to the Fair Debt Collection Practices Act (FDCPA) 12 CFR 1006.34(c)(4)(i), you are required to provide proof that you have contacted me within 30 days of acquiring the debt, giving me an opportunity to dispute the account. Despite my request, you have failed to produce evidence that you have mailed me a letter via certified mail within the specified time frame, thereby infringing upon my consumer rights.

Furthermore, you have stated that you possess video evidence validating this debt. However, I am compelled to inquire whether you have consulted with an attorney to validate this debt, as outlined in 12 CFR 1006.34(b)(5). I demand that you provide substantiated evidence supporting your claim.

It is imperative to note that I am a victim of identity theft, and this debt does not belong to me. Therefore, if you have indeed validated this debt with an attorney, I insist that you furnish me with documented evidence supporting this validation. Failure to provide such evidence will necessitate the immediate removal of this debt from my consumer report.

Additionally, I would like to bring to your attention that this debt has surpassed the five-year statute of limitations for collection. Pursuant to the relevant laws, any attempt to collect on this time-barred debt is unlawful.

I expect a prompt and thorough response to this matter, including the provision of the requested documentation and the removal of the disputed debt from my consumer report.

      Sincerely,
      *******************************

Subject: Complaint against *********************** and Associates

      Dear BBB,

I hope this letter finds you well. I am writing to file a complaint against *********************** and Associates regarding a debt that has been erroneously attributed to me. Despite my efforts to resolve this matter, I have not received any satisfactory response from them.

On April of 2022, I sent a letter to *********************** and Associates via mail, requesting that they provide proof of the debt in question. I emphasized that I have the right to dispute this debt, as it does not belong to me. However, to date, I have not received any evidence supporting their claim that I owe this debt, which I assert is not mine. I have requested that *********************** and Associates send me proof that they had sent written notification to me via certified mail before attaching this debt to my consumer report. I have received no reply. I would like to bring to your attention two significant concerns related to this matter. Firstly, the debt in question has not been verified by an attorney, which raises doubts about its validity. Furthermore, I have not received any prior notification from *********************** and Associates regarding this outstanding debt.

This lack of notification directly contradicts my consumer rights, which ***** me the right to dispute any debt owed. It is worth noting that throughout all these years, they have made no attempt to contact me whatsoever.

Given the circumstances, I kindly request your assistance in resolving this issue. I believe that *********************** and Associates have violated my rights as a consumer by failing to provide sufficient evidence of the debt's legitimacy and by neglecting to inform me about its existence. I ask that you investigate this matter thoroughly and take appropriate action to rectify the situation.

In light of the aforementioned concerns, I also request that you intervene and ensure the immediate removal of this debt from my credit report. It is crucial for my financial well-being and reputation that this incorrect information is promptly corrected.

I trust that you will handle this complaint with the utmost professionalism and diligence.

Thank you for your attention to this matter. I look forward to a prompt resolution and appreciate your efforts in ensuring a fair and just outcome.

We have investigated the consumer's complaint. He has never requested a copy of his original documents because we have never spoken to this consumer. I have attached the original loan application that this consumer signed when he applied for this education loan. The school has retained us to handle the collection of this account. If there is anything we can do to help this consumer get this matter resolved, please contact our office.
