This complaint is regarding a 10 year warranty which is not being honored.On May 5th, 2021, I contracted with Collin Bryan Construction (Contractor) to install a retractable cloth awning. The frame and fabric carries a 10-year warranty "from the date of original installation against becoming unserviceable because of loss of... strength from normal exposure conditions...Dimensional stability is guaranteed to remain at plus or minus 1% in 'no tension' or 'constant tension'." What this means is the awning is warranted against sagging from ordinary rain. Almost immediately during the next few rains, the awning began to pool water and sag significantly. I reached out to the Contractor and requested them to come and fix it. They assured me they would come out and repair it, but they never did. They would make excuses, delay, or reassure me but break their word. I believe they were attempting to string me along until 12 months have passed so that my complaint with the BBB would be rejected. After May of 2022, they stopped responding altogether.Now, because of the faulty tension in the awning and the resulting pooled water, the awning has become completely unusable. I have never recieved the benefit of the services I was promised, nor have I received the benefit of the 10 year warranty I paid for.My circumstances extenuate this complaint being made beyond the 12 month period because (1) the Contractor strung me along assuring me they would come out and resolve the issue, clearly causing me to rely on their word until they can go dark after the 12 month period has lapsed, and (2) regardless of the 12 month period, my warranty is for 10 years, the issue had been reported within a reasonable amount of time, and the Contractor is not honoring their promise within the warranty period.My proposed resolutions, in order of preference are: (1) a refund, since I do not trust the Contractor on any work, (2) a repair, or (3) a replacement if repairs are unfeasable.
