      Mod Tub lacks sent my tub my local carrier with delivery only between 11-4. At this first attempt at delivery the carrier did not deliver during their stated delivery window making me miss a day of work. Upon trying to schedule second delivery ModTub abruptly canceled the order against my consent and issued a refund against my explicit request and direction. ModTub provides a medically necessary product that I was relying on as part of my health treatment and is now refusing to deliver the product and is causing me mental anguish and emotional distress.

      The customer has been rude to every single person he has interacted with between Modtub and the shipping company, he has hung up on both Modtub and R&L Carriers repeatedly when we've tried to work towards a resolution, and when offered options hasn't moved forward with any of them. Therefore, we canceled his order, issued him a full refund, and told him to find a different company to purchase from.

      I am rejecting this response because:  In light of the seller's public disclosure of all correspondence, it is evident that there was dissatisfaction concerning the scheduling of the delivery. Rather than addressing these concerns in a cooperative manner and extending a simple expression of regret for any inconvenience caused, the seller opted to unilaterally cancel the order and abstain from further resolution efforts. It is important to note that the product in question holds medical necessity, potentially implicating state and federal legal considerations.


      Despite my numerous attempts to facilitate the delivery and resolve the matter amicably, the seller persists in evading their contractual responsibilities by summarily canceling all aspects of the transaction. Such conduct could be construed as a denial of service within the purview of a protected class under federal law. My primary objective remains the fulfillment of the agreed-upon commitment, and, in addition, a conciliatory acknowledgment of the lapse in courtesy through an apology would be appreciated.

      The consumer had the opportunity to schedule another delivery with the carrier, but instead has hung up on them multiple times, demanded a delivery outside of normal working hours, and been unable to commit to a delivery appointment or provide the necessary documentation to the carrier to deliver without an appointment. Because of his inability and unwillingness to make an alternative plan and being incredible rude and disrespectful at every step, we have canceled his order, fully refunded him, and told him to purchase a cold plunge elsewhere. We have the right to refuse service, and we are exercising that right.

      As you can see, Mod Tub LLC is lying. I requested delivery. Additionally, Mod Tub never called me at my request, so how could I have hung up on them?

      On 2/14, I contacted the carrier to request the immediate delivery of a product I had purchased from Mod Tub LLC. Regrettably, the carrier informed me that the request was denied by the seller.

      This refusal has caused significant inconvenience and frustration on my part, as I am in urgent need of the purchased product for reasons previously communicated. I would appreciate your prompt attention to this matter and a swift resolution to ensure the timely delivery of the product.

      Theres not really much more to say. This guy has been so unreasonable and rude, and we have informed him that we will not be doing business with him. We issued him a full refund and told him to go elsewhere.

If this product is as desperately needed as he is claiming, he should stop wasting time with us and go buy from a different company. We love our customers and community that were building, but I do not tolerate customers disrespecting my team or the people we work with. We tried to be reasonable, he continued being rude, and now we are not doing business with ***.

      I reject the provided response due to unprofessionalism in their communication. Their derogatory remarks and questioning of my legitimate need for their medically necessary product are concerning. I invite all parties to review the correspondence. Despite their behavior, I refrain from retaliatory name-calling. I anticipate a prompt resolution and further communication on this matter... one way or another!
