********************************************** company for *************************************, has misrepresented its authority, engaged in retaliatory enforcement, and applied HOA rules unfairly. On March 3, 2025, they issued me a violation notice falsely claiming I violated a Tarrant County ordinance on trash can placement, despite our HOAs rules allowing cans out 24 hours before pickup. They have no authority to enforce county laws, and ************** has not cited meonly VCM Texas, under false pretenses. This appears retaliatory, as I received my first-ever violation just hours after filing a complaint on February 26, 2025, about their failure to enforce community rules fairly. Other homeowners routinely leave trash cans out beyond 24 hours without citations, yet I was singled out immediately after raising concerns. When I requested citation data to verify fair enforcement, ********* refused. Their violation notice also threatened a fine, even though no HOA document grants them that power. If the county had an issue, they would have cited me directly. Instead, ********* is overstepping its authority and unfairly targeting homeowners. I ask the BBB to investigate VCM Texas for falsely claiming authority, retaliatory enforcement, and refusing transparency. I request that ********* rescind my violation, provide proof of their enforcement power or admit they lack it, ensure fair rule enforcement, and refund my $1,550 in HOA fees due to bad faith actions. I am willing to continue paying fees if they commit to fair and transparent enforcement. Please confirm receipt and next steps.Business Response

Mr. ****** The Courtesy Notice was issued to you in error and has been voided. Your documents state that Trash cans may be placed out up to 24 hours prior to trash pickup. With your communitys scheduled trash day being on Wednesday, your trash cans may be placed out on Tuesday. However, the City Ordinance states that trash cans may not be placed out prior to 6 PM the evening before your scheduled trash day and you may be subject to a Code Compliance violation from the City, not the **** The Board has agreed to void out your Courtesy Notice.
With respect to your comment about the notice having been sent as a retaliatory measure, both of the violations you submitted were done so after your Courtesy Notice was issued. Therefore, your notice was not sent in retaliation to you submitting violations online. We provided the timestamps of these to you on 2/26/2025. Other owners that have their trash containers out on undesignated days are also subject to receive the same notice(s) as you received. You did ask for citation data and were told that we cannot discuss other owners open/closed violations with you as they are confidential to those specific owners. In the past two months, there have been 15 notices sent to owners, in your community, for their trash cans. This is not a violation that you were singled out for, but one that we enforce on a regular basis. Board Meetings for your community are held quarterly and are a great avenue for owners to address their concerns with the Board directly. The local VCM team in *******/Odessa has failed to provide the missing financial reports that have been formally requested several times. VCM has failed and has filed false HOA violations as a form of harassment to homeowners. They have failed to keep up with their obligations when it comes to weed removal and etc.Business Response

As previously shared on numerous occasions by many VCM team members, balance sheets and income statements are posted to the community website each month. A financial review is provided to the homeowner members annually at the Annual Meeting of the Members. The more detailed reports provided each month to the Board of Directors only. We have additionally communicated with you the proper process that any homeowner must follow to view records of the Association that a non-Board member may not be privy to. This process is outlined in Governing Documents and/or Texas Property Code. We encourage you to reference those sections. Please feel free to exercise your right to a records request.
Violations are issued in accordance with the recorded Governing Documents for your community and date and time stamped photos are taken as burden of proof of violation. If you feel youve received a violation in error, please reach out. Additionally, the FINAL violation notices, Community Governing Documents, and/or Texas Property Code speak to steps that may be taken by any homeowner to appeal a violation.
The weed obligation that you are referencing, along Yukon and **********, are not part of the *** and therefore, not within our realm of responsibility to insure the area be maintained. We did look into this area and found it to belong to the ****************. Please reference recorded plats for your community for clarification on areas owned and maintained by the ***. VCM does not maintain the common area; but rather we work directly with the vendors who do so. We are only contractually obligated to inspect common areas once every two weeks. If any homeowner ever feels any area that is *** responsibility (aka common area) is not being properly maintained, please reach out to your local management team. Multiple emails sent with NO response over the past several months from my husband and I to obtain a pool card. I called over a month ago because I wasn't getting a response and talked to a hispanic person over the phone and he said he would help and took my credit card information. Once the email was received at the manger@ email, we were able to trouble shoot the communication errors. Additionally, when we learned that the pool card you ordered and paid for was not delievered to your address by the ***** we were able to issue another card. This card was sent out with a **** tracking number to ensure delivery. The initial card was mailed to your property address as this is the only address we have on file for you. Continuous insurance fraud claims by VCM and *** ****** Community Insurance Agency on my home *** **** **** ***** ** by board and HOA and VCM by putting some condos and removing my neighbours home from insurance policy. Our condo/townhome unit has 236 units , *** ****** and VCM added 294 units fraudulently and are using false claims fraudulent claims particularly *****, ***** and the new board. The Community has a total of 237 townhomes in which we account for on the community insurance along with all of the common areas that are deeded to the HOA on the master policy. The insurance claim that is being processed currently is not fraudulent but in process form hailstorms that took place in 2023. The vendor was approved by the board and inspected the townhome units along with the insurance company and began repairs in December 2023. The board has approved to hold a meeting on January 22nd to provide owner with an update on the claim and repairs and to vote on the special assessment as well.Initial Complaint

The Villas of ********** ***** of ********* and VCM have committed insurance fraud since I have been living here since 2010. They have taken money using false insurance claims and have disrupted one of friend ************************* life by causing fire to her home . They are insuring 294 townhomes by using my neighbour ******************* and other owner of record ****** and ******************************************************************* HOA **************** Policy. There are only 236 townhomes. These people of the board and ******************************** and VCM are collecting money using false claims on false buildings 294 townhomesand false addresses. 2022.pdf shows that HOA and VCM removed 320 ******** and ******************************************** from insurance document and added ******* noah ** a non existent address and added 10 additional fraudent buildings and then next year insured for 56 buildings instead of 46 buildingsBusiness Response

Villas of **************** is discontinoulsy not cutting trees, painting home and stealing insurance money I had to cut the trees behind ******* road damging foundation. They are not paiting stucco and not replacing roof per contract.According to the Insurance Law they have to ************** and they are commiting insurance fraud and accounting fraud continously by bumping up the building count to 299 instead of 236 orginally. this has been bought to their attention several times.My kitchen tiles broke, I had to cut tree branches. In 2022, VCM and Board included 302 -322 ******** - which is 10 buildings in place of my home. My home ******************************************** was not included. Please refer to *************. Additionally a ******** building policy means townhome association covers for outdoor maintenence, however when snow storm occured they are constantly asking my insurance to cover for the outdoor claims , this has made Farmers increase my insurance for 4 years to 2700 yr due to snow and hail damage and townhome board not maintaining my home. I had to hire someone to cut trees, look at foundation damage, paint lintels all which association should take care.
this caused uncessary financial burden on me and paying for insurane.
I had paid assesments without fail and have an extra balance of 228 on their account. The assesment fee was 230 and I was paying 240.

VCM has taken out funds in November 11 , more than ******* dollars in building loses on fake buildings and failed to ************** ************************************************; during that year causing an insurance raise for me but insured 10 fake buildings 302 -322 *********** in its place and put building count to 56 instead of 46 and commited insurance fraud , and taking money out of the insurance on fake claims .
This year VCM claimed 294 homes instead of 236 homes in insurance. This year the insurance certificate is not showing the property addresses on the record. it should clearly show 322 ************ on record.
This all accounts for fraud. VCM painted most homes, but never painted mine, they have more than 228 dollars of my balance due

In the past 3 years, during 5/14/2022 period as attached in insurance certificate the board where my home was omitted and 10 buildings were put in place and vcm took money on fake claims and never maintained my home. I see all homes are painted, but my home is not painted.
My home bricks are damaged, but board took fence claim which is not acceptable for me.

I am rejecting this response because:
Stucco was not painted No maintenance on home done till date per scheduled maintenance despite me requesting several times, instead robbing money on fraudulent claims in 2022 by using false buildings in insurance,
Bricks damaged by hail not repaired
No maintenance was done on home and no tree pruning since 9 years, me pruing trees as they are damaging gutters and foundation
Roof not replaced and gutters not replaced upto now
Only me paying dues to them without fail and have excess money and paying excess insurance to my insurance company to cover outdoor porch

The board of director recently held a meeting regarding the special assessment and held a vote for the insurance claim regarding the roof,fence, and window repairs. Once this project is competed the board will then investigate the landscaping needs throughout the community. I am rejecting this response because: It was the association responsibility to prune trees so that they dont fall on patios , until I had to cut them when they had caused faoundation damange due to soil shifting. It was association response, to maintain outdoor grounds properly so that outside sprinkler does not get messed up or water the lawn. When we purchased our home, we were told that there were strict rules and regulations within the community that were regulated by the **** We had to sign a document saying that we would abide by all the rules. There were strict parking rules. However, since we have been here, we have seen no rules enforced and have tried repeatedly to contact Vision Communities Management with no response. We are told every time we call that the contact person is out of the office and she will return our call. There has been no return call in over two months of trying. The company charges a large fee for doing absolutely nothing. The contract stipulates that calls will be returned within 24 hours which is a joke. The worst company ever.Business Response

HOA community for ****** springs **********, residents reporting no HOA communications nor legally mandated board meetings to its residents. This community is currently development phases. Board meetings are not mandatory during the development phases. We are working on getting the Splash Pad up to Health Code and pending final builder repairs in order to get it open.

The company opened the splash pad, I now have access to the website as a resident.
However, they indicated there are no board meetings since community HOA not operating due to development yet they are penalizing homes which negates that comment. There are HOA fees as well.Initial Complaint

This HOA management company is committing fraud. We pay $2200 a year and $1200 is towards lawn maintenance that you are NOT allowed to opt out of yet they dont actually maintain the lawn. The lawn company they have contracted doesnt treat the lawn for weeds and fails to show up weekly. The property manager ****** ignores emails and phone calls requesting info about who Manages this contract because they are collecting money from us but not providing the service outlined in the CCRs. Failure of response from VCM - their chosen vendor to cut our grass damaged our irrigation system and we are unable to water our lawn - we contacted them 04/09/2023 - they let us know this wasnt something they were sure would be an an HOA item on 04/19 - they said the landscaper replaced ***** on 05/01 - landscaped didnt replace hoses so we re contacted them 05/06 -on 05/11 they told ** they dont have control over our irrigation however their landscaper damaged our property and we have zero choice in whether we receive this service. -weve continued to contact 05/11, 05/15, and 05/18 with zero response In addition we have dead plants that contractually the landscaping company is supposed to replace and we have yet to see those replacements for 2 years. We want our property fixed and if our lawn continues to die replacement of the sod and plants.Business Response

We are still needing to replace plants. She will send over some photos so that I can put it on the Riverset workorder list ¬ify the landscapers.
