      The seller and the realtor just want to keep our ******* security deposit.On February 14th 2023 a new home contract was executed between my self and seller Savannah Main 7.Per Paragraph 22 of the executed contract, the Non Realty Addendum would be an attached agreement between the two parties. That non realty addendum stated that the full appliance package of fridge, washer, and dryer would be included -Also there were some repairs the needed to happen before the closing.Per paragraph 9A the closing would take place on or before February 22nd 2023. On February 22nd I toured the property and had found that no fridge, washer or dryer had been installed neither the repairs were completed.By February 23rd ******************************************************************************************************** the Non Realty Addendum by the contracted closing date. No amendment was signed by either parties to extend the closing date.I had fulfilled the duties per the contract and were ready to close and fund this transaction. The seller had not fulfilled their contractual duties to include fridge, washer, and dryer along with installation per the Non Realty Addendum.Including some of the repairs the were supposed to have been completed.We will be also reporting this to the Texas board of realtors.

      Last September (2021) we closed on a new build condo. We moved in before the final certificate of occupancy was issued. As of 11/18/22 the builder hasn't gotten the COO and the building isn't up to code. They have had over a year to get the building up to code but are dragging their feet to complete all that is needed. There are issues with the emergency generator, the basement parking area was recently flooded, Roof Leaks, Plumbing leak issues and other code related shortcomings. There are also a lot of clean up and detail finish work that needs to be completed too. I understand that the builder is working to get the COO ( for over a year ) but doesn't plan to have a final walkthrough in the common areas and address trim, painting and clean up issues. *** with the *************** has all the details for the COO issues. This builder has been slow and unresponsive completing this building even though all units have been occupied for over a year. The builder has been slow to address warranty issues too. Residents still have outstanding warranty issues that hasn't been resolved to date. Example: Roof leaks in unit 4001. The workmanship in this building is poor. Now that we have moved into our units, our hands are tied getting all the detail work and cleanup work completed in the common area. All the residents in the building are looking for help.

      Business Response /* (1000, 5, 2022/11/18) */ We had used a temporary generator when the building was complete 2 years ago as the permanent model was backordered due to supply chain issues. The permanent generator is installed now. The basement did recently have about 2" of water in it during heavy rains. When we checked on it both breakers were off (each pump has its own circuit) The HOA should have a routine maintenance program in place for cleaning and insuring proper pump operation. This is no longer a builder issue. We address all warranty claims if an owner sends a claim to us through our website. We track all of these until complete or explain why an item is not warrantable. We continue to do this even though the building is out of warranty. If something was done improperly, we stand behind it. We have for 25 years. Savannah's reply to this complaint was sent out to the homeowners in the ******** building and the HOA Below is just a few examples of the comments received to date. None have been positive in regards Savannah's communications or follow through. HOA Board Officer - The Savannah response is pure fiction. Not surprising. Homeowner #1 in regard to warranty claims and follow through. Unfortunately, this is not true. Got a response by **** ******** at a Savannah today Homeowner #2 I sent them issues, followed up with multiple people. It shouldn't be the case where I have to call 1000 times until someone comes. Submitted warranty request when the unit was still under warranty - still nothing. At that point I fixed most of the issues myself. Savannah has left out many important details on their reply to this complaint. They seem to think that truth doesn't matter. Let's break everything down item by item. * Savannah didn't comment on why it's taken over 14 months to get a permanent certificate of occupancy even though homeowners closed on this units over a year ago. As of 11/26/22 the builder still hasn't received a permanent certificate of occupancy. Savanah has slow walked all needed items to date. What has been worked on shows sloppy poor workmanship. Signs that the builder is cutting corners and doesn't care. * Emergency Generator - Savannah never communicated to the homeowners or the HOA that they were installing a used temporary generator on the building. Savannah placed a 10-year-old unit on a new building. It wasn't ever operational during the last 2 years. It was underpowered and never wired. The only reason Savannah installed a new generator on the building is because the HOA had the old one tested and it wasn't operational. Savannah seems to be untruthful with their reply. The wiring for the generator was installed 2 weeks ago for the first time. It seems that Savannah was trying to cut cost with the old generator install. The building lost power various times over the last 14 months that resulting in flooding due to the sump pump not running. When we lost power earlier this year the basement parking area was so dark that owners were forced to park on the street for 2 days in freezing wet weather. Parking on the street is first come, first serve. * Communication issues - Savannah sold and closed all units over 14 months ago. Savannah never communicated any information about all the modifications that they have been doing to the building to get it up to code. They just have workers show up unannounced. As owners of the building, we should have been kept up to date on all aspects of work performed on our building. Construction schedules and updates were never and are not communicated. Another example of poor customer service from Savannah. The builder obviously doesn't care about homeowners after they make the sale and get paid. * Warranty claims - Savannah requires that warranty issues be posted on their website. When a claim is submitted the homeowner doesn't receive a receipt. Savannah has been terrible over the last 14 months handling warranty claims. They don't communicate. Many items have never been addressed. * Roof Leak - One homeowner recently reported various roof leaks. Savannah has been slow to resolve this issue. ( Brand new Building ) The owner is experiencing mold in her until now. Another example of poor customer service, lack of compassion and workmanship by Savannah. * Challenges - It would be safe to say that most homeowners are dissatisfied with Savannah's workmanship and customer service. That says a lot. * What do I want to help resolve this complaint? IF Savannah really cares about their customers and takes any pride in their workmanship, they'll arrange a meeting with Homeowner representatives of the ******** Building and the HOA. It's appears that Savanah don't care about quality or communications. Here's their chance for Savannah to address outstanding issues. Here's a few examples but not all issues that needed to be resolved. * Workmanship, Cleanup and Paint issues with the doors moved on each floor. * Various doors not finished after they were installed. Frame painting. Gaps at the bottom of the doors. * Floor Trim is needed in Garage elevator areas. All areas that were drywalled. * Ground floor entrance from the garage need to be completed. * All conduit used for the heaters install needs to be painted. * All storage and common area in the garages need to be cleaned out of construction debris and spare items. Any much more. Pictures attached. It should be noted that a generator IS NOT required by code nor is it on the permitted set of plans. It was added after construction was complete due to a request from the Fire Dept. Once again, the building is out of warranty, but we continue to address any reasonable claim as evidenced by **** ******** of Savannah reaching per *****'s comments above. I do think it is unfair for one person to make representations of supposed consensus of 23 other owners. Again, as of today we have 2 outstanding requests for warranty, and we are tending to both. Having said all of this we still would be willing to attend a meeting with ***** to look at these items. I believe **** ******** already has reached out. In your last reply you failed to address many of the issues reported to the BBB. Your company seems to feel very comfortable being untruthful, deceptive and as well as being unscrupulous in your business practices. I understand that another community that Savannah developed is taking their case to court. All the pieces keep adding up to a very troubled organization. ** Let's circle back to the generator. The basement parking area has flooded no less that 2 times over the last year. Nobody from Savannah ever meet with the HOA or Homeowners to give guidance on fuse resetting let alone where the fuses are that need to be reset after power surges or outages. Another example of poor communications on Savannahs' part. Savannah makes it sound like they were doing the community a favor including a generator with the building. The generator is needed to keep the basement garage from flooding utilizing emergency power to a sump pump.( See pictures ) The Generator also supplies emergency power for lighting in the common areas needed for residents' safety. This is just another example how Savannah twists the facts to cover up their poor business practices. ** Warranty - Residents have been contacting Savannah on warranty issues for a year now only to have some of them ignored. Basically, the owners have given up getting warranty claims to Savannah. Another example of poor customer service. * As for your comments - (" I do think it is unfair for one person to make representations of supposed consensus of 23 other owners.") There are 68 units in *************** all built by Savannah. The *************** HOA board has been unsuccessful at getting Savannah to take care of many builders related issues in this community for years now. Our building is the newest in the community and contains 24 units. Many owners are very unhappy with Savannah and their poor business practices. * Request for a meeting. As of Friday 12/9/22, 5 or days after Savannah's reply to this complaint, nobody has contacted me or the board to set up a meeting in an effort to resolve the many issues. Another example of poor communications and follow-through on the part of Savannah. I've purchased 6 New Build homes in my lifetime. My experiance with Savannah has by far been the worst experiance of them all. I can live with the challenges that come with building new homes. Dishonesty and poor workmanship are hard to ignore. What needed to help resolve this complaint? Savannah should meet with some ******** Building Residents and representatives of the HOA abd address the homeowners' concerns. ** Please see the review below that had been posted on Yelp and various other review sites. I think it clearly communicates the situation here. * This review is for Savannah Developers Dallas TX. - After builder delays here at *************** here in Addison TX, we closed on our condo during Sept 2021. The building wasn't completed as we moved in on a temporary certificate of occupancy. As of 12/1/22 or over a year, Savannah hasn't completed all the work and or received a final certificate of occupancy for the building. In the meantime, some of the finish work that the builder has completed displays poor workmanship. Many dissatisfied homeowners have been in communication with Savannah, The *************** *************************** well as HOA for the community. As a homeowner, it is recommended that perspective customers preform a lot of investigations on this builder before considering purchasing a home from them. This is just a short summary of the homeowner challenges. Note that buying a new build home is supposed to be a rewarding and joyful time. This hasn't been the case at *************** built by Savannah Developers for me or many residents here at *************** in Addison TX. Hi, Not sure why Savannah noted in their last rebuttal that I didn't want to meet with them. I have requested an in person meetings in each one of my replies to this complaint. One of the replies from Savannah noted that they would reach out to me to set up the meeting. That never happened. To date I've never been contacted by Savannah. I would like to have 1 HOA Board Member and some residents of the ******** building meet here on site with Savannah to walk the site and make a punch list of items that need addressing. There are many items not completed and issues that need to be addressed in the building. Example - A door was replaced to the garage, and it hasn't even been completed after months. Please see the attached picture. Another example of poor workmanship and poor customer service. Anybody seeing a pattern yet? Here are some date and time options that I'm available.       Business Response /* (1000, 5, 2022/11/08) */ Regarding the CO, the City has extended our TCO until we could aquire the correct generator which had been unavailable due to supply chain issues. We have it now and it is in the process of being installed. The sump pumps in the garage have worked perfectly for over 2 years. Apparently, the breaker had been tripped and that's why the pumps did not come on. This has nothing to do with the generator as it only is designed to kick on when there is a power failure to the entire building. The HOA should have a maintenance contract in place that covers inspection and maintenance of the sump pump system. The miscellaneous punch out work is underway now.

      We closed on our condo last November. Along with issues reported by other residents, we were lied to and gotten false promises regarding floors sound isolation, high speed internet and an ability to install an EV charger in the unit and a promise to change the door. The construction is still ongoing as the builder installed components out of warranty. It's been over a year. Also, the builder was also an HOA for 5 years before they switched over to residents and there was 0 reserves after 5 years of residency.

      Business Response /* (1000, 5, 2022/11/08) */ At a bit of a loss on this. Our floor systems far exceed required STC and ICC sound attenuation code requirements. I don't know anything about 'promises' made. We don't do business that way. We have contracts and specifications, 3rd party and City inspections. Spectrum is the data comm supplier in this project. Has nothing to do with us but we've received no complaints that I'm aware of. All parking areas have outlets for EV chargers. Again, at a loss here. Not sure what he is asking. We don't supply the chargers, we never said that we did. There is no 'continuing construction 'in the building. Just routine warranty work when requested and HOA maintenance work by their vendors not us. The HOA is funded by us the developer until turned over to the homeowners which has been done. There are always budget shortfalls during construction because not all units are occupied and contributing dues. During this period, we as the developer fund these shortfalls which in this case were close to $80,000. Needless to say, it is not our job to turn over to the HOA with a reserve. Let's focus specifically on the outlets. It doesn't seem that we have the outlets in the downstairs garage. I've been trying to talk with HOA about installing the charger and was denied for various reasons. How could we at least resolve this?       Closed on a new build townhome on 11/29/21. List of repairs signed by builder to be completed by 12/13. No work completed or scheduled. Neighbors are getting their repairs done. Multiple attempts made by me to have repairs scheduled with no follow ups. 2 repairs were scheduled with no call no shows for both. No follow up. Pictures of countertop and backsplash damage from 11/4. Not taking ownership of that. Was not given access to mailbox/mailbox key until 1/4/2022 despite multiple requests. I've asked for warranty information multiple times with no receipt. List of repairs signed by builder and included in contract: Utility doors don't close smoothly, microwave trim kit does not fit (microwave very difficult to open), floor on stair landing not smooth, paint touch ups throughout home, deep cleaning of home.- none of these have been completed or scheduled. My home was never cleaned prior to moving in. The grout in my master shower is stained. Chips in countertop in kitchen. Picture proof from 11/4/21- no acknowledgment from builder. I had electrical work done (fireplace) on 12/7. Builder stated in email he took a picture of my garage after electrical placed. This means he entered my property after I closed/moved in without my permission or knowledge. My heater did not work as of 12/20/21. I was told to go through Savannah website for extensive list of repairs (including heater)- still no follow up as of 1/13/22. I had to call heater company myself to follow up. I had to call electrician out myself to fix outlets and lights that did not work because builder did not respond. I have a toilet in one bathroom that does not flush- no follow up from builder. Email documentation present for all these occurrences.

All items have been completed except the replacement of a microwave trim kit which is backordered due to supply chain issues. This customer employed her own contractors to customize her home after she moved in. They put holes in her sheetrock for electrical work, damaged her countertops left everything dirty. She wants us to repair everything that her contractors did. I've never seen anything like this in my 40 years. Several of our contractors refuse to go back in her home. They say she is 'dangerous'. We will set an appointment with her to install the trim kit when it comes in. We will make sure we send several people to that appointment. Feel free to contact me for more details if needed.
