      I knew Dewayne ****** from a previous roofing job he had done for us. On Thursday, February 1, 2024, Dewayne sent me a quote for the job via email for $46,964.65 with a deposit required of $23,482.33. I used my debit card to transfer $24,000 into his business account, (D&D Roofing and Construction), which was also with **** ** *******. I told him that we wanted the project to be completed very soon as it was approaching mid April and if he could not give me a start date or an estimated start date, that I just wanted our money back and have another company do the work. He avoided my question and mentioned he had a job in Albany, Tx and would be out there. I said that I understand he's busy, but I want the job done ASAP. I told him that I prefer just to get the money back and let the other company do the work since they can start pretty quickly. I texted Dewayne on April 14, 2024 to ask if we could meet on April 16 or 17, 2024 or he could stop by to give me the money. He called and said that he could start the job the following week, so I sent him pictures of the stone that I wanted to use. We didn't communicate again until April 25, 2024, at which time he texted that he forgot about me and would be in town on Wednesday and would get my money to me then. He texted May 2, 2024 and said he was on his way back from Nebraska and would call me in an hour, he did not do it. I called him the next day May 4,2024, he didn't answer, but he texted and said he was on the phone with his investors to get a check cut for me. He asked 24K?? I responded yes, thank you. I called and texted several times but have not heard from him since May 9, 2024 when he said he would call me back.

      I see some false information here. 

      1. you said you wanted the project done before mid May and I told you I’d have you done before then

      2. We had you on the schedule a few times to pour concrete but Mother Nature didn’t let that happen (I can’t stop the rain)

      3. You wanted your husband to be in town ect 

      The last time I dealt with you on building a metal shop for you, I returned the full deposit bc I hadn’t done anything at your property, this time I have concrete supervisor drive 21/2 hours down and we had marked it ect. Then when *** was in town I came over on a Sunday for you so we could stake the yard out. Then drove to rock quarries for you in that Sunday as well. I also had ordered material and had to cancel that. You hired me to do a job paid me a deposit and kept looking for a better price. That doesn’t make sense!! If you keep looking you’ll find someone cheaper than who you now, ohh then you ask me to split the project with the other company since they were cheaper, you’re a business owner, that’s like me asking for just your cup of ice and going get the snowcone juice elsewhere. I offered you 15k that’s the 24k minus 25% which is 18k minus the 3k you already owed me since April the 18th

      I am rejecting this response because:  I told Dewayne April for the project date. I had put everything on hold as long as I could. By the time I started looking for other contractors, our project should have been started with D&D. It was one excuse after another, I have suppprting text messages, many times he ignored my request for communication. I asked Dewayne to split the job because he was not getting started and at that point, we were hoping to at least have something to show for the $24,000 that I gave him in good faith. If he didn't have time to do all of it, maybe he could do some of it.  
      He obviously spent the money to fund another project, which I've learned is common in that industry. I was willing to take the $18,000, pay the $3,000 for the roof repair and sue him in small claims for the $6,000 (25%), but was advised not to do that, that we should just pursue the entire amount and handle the roof repair in a seperate transaction. The only contract I have signed with D&D was for a roof in 2020.

      I am rejecting this response because:  Dewayne, you are correct. I will not respond to any other comments you make with BBB, but since you have stopped responding to my texts and calls, this is the only line of communication. I'm sure you funded another job with our money or you would have it. You know what you did,

      Bottom line, we don't have a contract. The only way this will get resolved is for you to give us our money back.

      Surely you don't think we're just going to let you rip us off. I will add that we obviously trusted you and are totally shocked by your behavior.

      I’ve responded to you by text!!! I told you I’m not just letting you skip town on canceling a contract that you back out of because you found someone 6k cheaper. So now your falsely accusing (saying I stole your money giving false information to ruin my business) your the only thief here! You owe me 3k to this day still and have since April the 18th.

      Dewayne, you know you owe me money. Give it back and we'll drop it. You're the one ruining your business by ripping people off.
