We paid deposit of 4000$ and was promised a delivery date of today 05/12/2023. We got a call saying they cannot deliver it and it might deliver next week by Tuesday. The employee keeps lying and refuse to give me owners number which I asked twice. Looks like they are trying to do scam or fraud with ** and we dont know where to go for help.Initial Complaint

Order shelves and slatwall from TX Store Fixtures on February 16, 2022. Called the manager on February 18, 2022 when the shelves arrived about the shelves I ordered are not the color white but instead are the color pink. I have asked for a full refund for the shelves and for the shelves to picked up for the return. First response I was meet with was they have no control over the color of the shelves and that I would have to deal with the shelves. Now everytime I call or text the manager I get the response we are trying to find a driver to pick up the shelves. Also they are telling me that I will be responsible for the shipping charge for their mistake on the shelves. I would like to get to my money back on the shelves and for the shelves to be picked up.Business response

Business Response /* (1000, 11, 2022/06/07) */ We are sorry to hear that the shelves were not to your liking. But as you correctly stated hue of the color of white is not in our control. These were sold to other clients as well without any issues. As a courtesy we offered to have them returned for you, as long as you had them packaged and wrapped on a pallet and accepted the return charges. This is offered to you as a courtesy. We cannot pay for return charges on items where the client has a very specific preference. Let us know if we can do anything else for you. TX Fixtures, you responded, "But as you correctly stated hue of the color of white is not in our control." First of all, the color of the shelves is pink, not a hue of white. By definition, the word hue means, "any color that is on a color wheel". White and black are not on the color wheel. Tints are created when you add white to any hue on the color wheel. Tones are created when you add white and black to a hue. Shades are created when you add black to a hue. The color white has no hue. Secondly, it is disappointing that TX Fixtures is passing the blame to the customer for your lack of quality control on this product. If you are going to sell a product made by a third party to your own customers, you are ultimately responsible for the product being as described. When you sell a product that is not as described, you refund the customer, then go to your manufacturer and remedy the problem. You don't blame the customer for something out of their control. I ordered the shelves on February 16, 2022 and have attempted several times to get the shelves picked up. February 24, 2022 the Manager stated in a text message, "We will go ahead and get all of the shelves picked up from you. We will create a label. After you can send some pictures." I sent them pictures on February 24, 2022. A few text messages went back and forth about the pallet and weight. March 3, 2022 I asked again, "Hey I'm trying figure how where we are at with pickup?" TX Fixtures replied with "I'll send you the information and update on this tomorrow." March 7, 2022 TX Fixtures replied, "Hello sir just checking to see if they have already picked up the shells for me" autocorrected to "shelves from you." At this point, I told them the shelves had still not been picked up. I received another text from TX Fixtures stating, "Text me the dimensions of the pallet. And a day and time that would be perfect for you for us to send a driver to pick up the pallet." March 7, 2022 I stated, "Pallet Dimensions 52"x52" will be available Tuesday - Friday 10-6pm". March 7, 2022 TX Fixture stated, "Got it. I will forward the information to my administration office". March 9, 2022 I replied, "Checking about date and time?" March 9, 2022 TX Fixtures replied, "Yes sir! I'm checking with them right now. I'll let you know as soon I get an update on it." March 22, 2022 I replied, "Hey I need to get a date on pickup?" March 22, 2022 TX Fixtures replied, "Yes sir let me check." March 29, 2022 "Hey I need to get a date on pickup? Thursday I will be shipping the shelves back to your store." March 29, 2022 TX Fixtures replied, "I'm on it right now trying to find out when they planning to send a driver out to pick those shelves up for me." May 2, 2022 I replied, "So did you forget about me? Still no pickup?" Attached are screenshots of all of these text messages. I also purchased white slat wall from TX Fixtures. The slat wall was the correct color, white. However, you clearly see in the pictures attached that the slat wall does not match the shelves. With it now being June 10, 2022, almost 4 months since the original purchase, the question is why has TX Fixtures not attempted to pick up the shelves one single time. Why have they not attempted to rectify the problem with a customer? Why continue to give false information stating someone was coming that day to pick up the shelves, only for me to wait around all day and nobody ever show up. Your word has no value. I am a small business and have close to $1,000 tied up in this transaction, and that is a lot for small business. I also have a product that I cannot use which I have unsuccessfully tried several times to return to this company. When I originally reported this issue to the manager, I even agreed to pay for the return shipping in order to get the majority of my money back. However, this has gone on long enough. At this time, I am requesting the shelves be picked up and transported back to TX Fixtures and their expense and my money be refunded.
