We signed a contract with Dawn Sells of Texas Pergolas on January 19, 2022 for doing concrete, pergola and outdoor kitchen. The work on my project which was contracted to complete by April 15 but we still have major pieces outstanding. The driveway extensions/concrete and pergola was built in March but nothing has been done for the kitchen yet. No work has been done since April 1st week and we have lost more than 12 weeks now! The advance for the kitchen was paid in March and that work hasn't even started yet. DATE ACTIVITY DESCRIPTION QTY RATE AMOUNT Expected completion: April 15 Goal: March 21-25 Dawn has been so evasive and scant in her updates! Despite my regular attempts, she hasn’t been back to work in more than 3 months now. Her text updates do not have any specific details that I ask for and she hasn’t been able to deliver by any of the planned completion dates. She was supposed to update me every week on the progress and delays but I am yet to get a real update after the first week of April.

Client has not made an installment payment as per contract and the invoice emailed to him for an electrical installment.  As per contract, if payment installments are not made, we reserve the right to stop work until all payments are made.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.

Please note that while the invoice for $500 was emailed, Miss Dawn never called me up or followed up for that payment. She has also taken total advance of $9200 (for appliances, stones and kitchen) about 3 months ago as mentioned in my compliant and I haven't seen any of those materials yet!

Before she become unreachable, she used to text me about any due payments (that was the process she had laid out) and follow up for confirmation. She did none of that for this last electrical work.

Nevertheless I have gone ahead and made the payment now. As mentioned earlier, there has been absolutely no response from her on the advance of 9000 for appliances and outdoor kitchen work. She never responds to my calls and emails.

Now that the invoice is cleared, I would like to get a realistic plan for the outstanding work, delivery of materials (for which advance is given to her already) or a refund of the money paid. Thanks.

      Regards,

The people at Texas Pergola Co are first class crooks. If you want a patio, pergola, or gazebo, avoid the Texas Pergola Co. They began a patio in our back yard four months ago. They took our money and promised to finish week after week, never coming back. "Will finish tomorrow," "will come back by Friday or next week." They'll stay silent for weeks, will return calls or texts rarely, only to employ more delay tactics. They've ignored our demands for a refund. A totally dishonest and fraudulent business. Unfortunately, we didn't realize everyone else was having the same experience until it was too late.

Hi, This issue began last year when we hired Dawn ***** and Texas Pergola Co to replace our patio with concrete and build us a large pergola. The concrete work was subcontracted out and her sub did a poor job from the beginning. The sub was not prepared for concrete delivery so the truck sat cooking for 2.5 hours in August in Houston in front of my house. Once he was about 50% done pouring the concrete it started pouring rain and he was not prepared. It rained on the fresh concrete for 30 minutes before they covered it with plastic, then rather than peeling the plastic off in the opposite direction so the water on top would fall into the yard...they pulled it back and dropped all that water on the fresh concrete and then worked it all in. The surface of the concrete looked terrible immediately and I let Dawn know my concerns from the time the truck arrived and continued to update her as things progressively got worse. Dawn assured me they would take care of it so we scheduled the pergola install. The surface of the concrete was full of defects, it wore away with the hose and had large pits within days from the rain. Dawn's initial repair was to spray knockdown pool decking on top in the hopes that would fix the problem. It took four months from my initial complaint until it was addressed in this manner. Unfortunately that only lasted less than two months and it started flaking off in the rain and the edges are crumbing from the exposed areas. For the last 8 months Dawn has been stringing me along with promises that they will replace the patio that never come to fruition. Usually this ends with the date she's given me for the job coming and going and she won't respond to my phone calls or texts for weeks. Then I get a story about how some worker of hers was sick or died or something and now we can schedule again. I contacted a lawyer and his recommendation was to file a complaint with the BBB and then a claim in small claims court. I have not filed in court yet.
