The insurance company paying for this job has stated that the invoice (attached) provided by this business is inflated as they included duplicate items. I have requested an itemized invoice including each line item that was completed and materials used matching the provided invoice and have not received the same. The insurance company and I have called the company multiple times to request this because the estimate included multiple options to complete a few items, the business charges us for all options but completed only one for each. I am willing to bring an inspector to verify that the work items were completed per the invoice, and they refuse to provide it. I want to know what I am paying for, I trusted in their expertise that they would invoice us according to the completed work but that seems to not be the case and the difference is for $3,475.30. The business wants noted they might be an error but that they will only be paying for $1,000.00, thats fraud. The amount presented below is for this invoice alone. We have also paid for additional services which we are not disputing.Customer response

I received a response from the insurance on the incorrect details of the invoice.
Please note that the estimate provided by the company was based on an estimate from the insurance. We trusted their expertise in the same but as you can see we were charged for items that were not completed.Business response

Please note this complaint is not resolved.
The Contingency Agreement signed with the contractor (**************************, *President of A S R C LLC DBA All Star Roofing & Construction or AllStar Roofing & Construction or ASRC LLC depending on the document a different name is presented) states that he will communicate directly with the insurance company and obtain approval from the same for an agreed amount.
The contractor proceeded to summarize the estimate from the insurance by including the summarized amounts plus the scratched-off amounts and stated this calculation to be true as a result from communicating with the insurance as part of the agreed terms in the contingency agreement.
The $35,356.07 total amount was calculated and presented to us by the contractor in accordance with said agreement. The mis-representation of the arrival of this amount by the contractor has resulted in benefiting his business directly by double charging us for two items that were already included in the insurance estimate for the lines of work. Unless the contractor can provide proof that the insurance indicated to him during the course of executing the contingency agreement that the scratched-off amounts would have been paid on top of the total, we are owed the overcharges of $1,396.30 and $2,049.00.
The insurance has clearly stated that these amount should have never been in the invoice and they have also attempted to reach the contractor to resolve this matter with no response on his part. These charges were added by the contractor without the approval of the insurance as expected per the contingency agreement, violates the terms agreed.
Again, the business has had months to resolve this matter, the total amount signed might supersede the contingency agreement as in that there was no work order approved when the first document was signed, but it does not remove the responsibility of the contractor in fulfilling the terms of that agreement by communicating with the insurance on what they had agreed to pay.
The contractor has acted in any capacity to directly benefit from this deceptive business practice. A settlement for anything else than doing what is right by the side of integrity is unacceptable.

July 26, *************************************************************** the amount of $17279. Before any work could be done H343038313731****3830H LLC required all proceeds to be paid upfront. My insurance company honored the claim and sent a check for $12400 I in turn issued my deductible of $4879.00 on or about October 13, 2023. Day two after they started the project I received a call from ***** stating that he was going to have to submit a supplemental claim for additional work. Day three project was complete and I did not hear from them again. December 8, 2023 I began reaching out to ***** asking for a copy of the completed invoice along with copies of my warranty**;s. I continued many attempts through the end of January with little to no response. February, I received a text from my insurance company that the supplemental claim was approved and that the check was in the mail and to please not have the roofer contact them any longer. February 2024, I began receiving a barrage of phones calls from ***** asking for the check, which I had not yet received. Soon thereafter I received the check along with supporting documents only to note that the initial amount of $17279 was now $33174. From that point forward I began examining the documents only to learn of many discrepancies. I called the El Paso Planning and ******************* to see if my house had ever been red-tagged or if a final inspection had ever been completed; and there has been no final inspection. I took the insurance check to the bank which they are holding for seven days. I took a letter to the H343038313731****3830H and he proceeded t file an invalid constitutional lien on our home. In addition, he has reported my account to the various credit bureaus.Customer response

Today, Sunday, April 14, 2024 I received the attached letter from Allstar Construction and Roofing Company. Tomorrow, Monday, April 15, 2024 I have an appointment to seek counsel how I should proceed. One of the reasons I am seeking legal counsel is because I thought a "final inspection" by the city is included in any roof replacement. I am seeking surety without a hint of reservation that ************************** will honor his word to:
1. remove the (invalid) constitutional lien (original contract signed by both spouses. Contract must have been signed at the office of a lender, title company, or attorney and contain a notice allowing the property owner to rescinding the contract within three days of execution. The contract must be recorded with the county clerks office. If these requirements have not been satisfied, then the original contractor and anyone working under that contractor, do not have lien rights against the property. Neither of these have been met nor have I been served by certified mail)
2. recall and cease third party debt collectors
3. recant all derogatory information released to the credit bureaus
4. After receiving payment in the amount of $8974.28 from USAA, to provide a final invoice clearing us of any further financial responsibility to include any additional legal costs he may have incurred; leaving us with a balance "paid in full".

I am rejecting this response because:
******************************* response dated April 17, 2024 (5:37 p.m) in regard to complaint #******** regarding Allstar Construction and Roofing response that we are in litigation.
Allstar Construction and Roofing has presented a written response stipulating that they will fulfill the below requests but only after they receive the $8974.28.
My desire is not to withhold the money due to this company. I do have concerns that the company is not willing to answer such as:
Claims for replacement of soffit (no detection of this ever being done), gutter repair/replacement (same gutters since we purchased the home), turbine installation (no turbine on roof) Satellite detachment, resetting fee alignment and calibration (no satellite on roof), Window replacement/reglazing (windows were replaced two years ago and have not been touched since) detaching and reattaching of Refrig. AC sensing unit (asked to see certified HVAC invoice),Electrical Meter mast overhead detached and reset (asked to see invoice of certified electrician completing the work).
Being the consumer, I do not believe these requests are unrealistic or unachievable.I am seeking immediate resolution. I have no desire to delay this any longer.Please see to the following so that I can surrender the $8974.28 due.
Roofing replacement requires a Final Inspection from the city before the job can be considered signed off as completed which has not been satisfied.
Release of the Constitutional lien has not yet been released. The constitutional lien that was applied is considered invalid for the following reasons:
Original contract signed by both spouses. (it was not)
Contract must have been signed at the office of a lender, title company, or attorney and contain a notice allowing the property owner to rescinding the contract within three days of execution. (it was not)
The contract must be recorded with the county clerks office. (it was not)
Texas law states: If these requirements have not been satisfied, then the original contractor and anyone working under that contractor, do not have lien rights against the property.
Neither of these have been met.

Recant all derogatory information released to the credit bureaus

Allstar's Sales Manager ***** has tried on several occasions to seek resolution with ****************** with no resolution:
On April 12th ***** went to ********************** property as ****************** refused to answer neither text message nor phone calls to seek resolution. ***** met with ******************* and was advised to provide ****************** with written correspondence to his email to try and come to some form of resolution. Attached is the document which was sent to ****************** with an attempt to seek some form of resolution.
****************** then advised on April 16th that he was taking the letter to seek further counsel.
On April 29th (more than 2 weeks after the letter was first sent to him) ***** attempted again to contact ****************** to seek resolution as ****************** had not reached out. ********************** response was as follows: I read your email response. I believe we are at an impasse. Should you reach a different decision please don't hesitate to reach out.
****************** showed no attempt to resolve this issue with Allstar at the time.
I will attach the following correspondence which was handled via text message.
Just yesterday we received correspondence from ****************** which requested the same demands of Allstar with no flexibility as before.
Allstar has agreed to move forward with meeting his demand as follows once the executive pastor ******** our offices and provides us with proof that they have the funds:
- Complete the final city inspection and ensure that it passes inspection
- Release the lien from his property
- Cease third party debt collectors
- Recant derogatory information released to the credit bureaus after receiving payment in full
- Clear ****************** of all financial responsibility (any additional costs Allstar has incurred) and provide a final invoice showing the balance has been paid in full once payment has been received from the pastor
We believe this to be fair as we are compromising with majority of his demands however the last 2 are only able to be completed after payment has been made as we do not have any ability to report the outstanding balance to any credit bureau once we have told them it has been resolved and we cannot alert them this has been resolved until payment has been received.

Chief complaint: 1.Making Outrageous promises This business doesnt get to push its way around when asked to wait for a decision, especially when it concerns financial liabilities, creating financial harm. The contractor has placed a lien on my property for a claim for work that has not satisfied the work agreement. That is a complete aberration and abuse of illegal tactics.2.Use of manipulation in their talk, as I was Ignored as the client regards wanting to decrease out-of-pocket funds as the possibility to reduce or absorb the insurance deductible. 3.Aggressive contact- excessive constant, pushing to buy unscrupulous deceptive sales tactics and harm created by their own best interest.Summary:27 Feb - The AllStar contractor met with my insurance rep to assess roof hail damage. I received a repair estimate from the insurance company notified the contractor and provided them with a copy. Later the contractor drafted a contract with details using the insurance quote. They assured me they would ensure the insurance would cover anything and everything that needed to be fixed.27 Feb - After presenting a draft of the work contract I initiated it to acknowledge going over the work. Then, I asked to hold it since I needed it to go back to the insurance and ask them about the cost difference and color of the roof. I also asked to wait since there was another insurance covering the roof and I need it to go and check with them. After this, no documents were provided to me. This meant there was no contract in effect as the presented draft contract had blank spots (unfilled) (the color selection was missing) in it- so I never signed the contract.29- Feb After several days, they showed up at my door asking about the decision from the other insurance and color selection. The representative also explained a way to absorb the homeowner deductible cost, as he wanted to pick up the check the insurance company had sent. Snip from the INSURANCE CALCULATION SHEET BELOW- 10-Mar - This time, the company representatives- showed up with another representative. While the conversation was turning about the contract, I paused and stated that there was no contract. The decision of the color was not firmed or finalized and the other insurance that would cover a portion of the cost was not resolved. One contractor stated that there was a clause of a 20 % cancellation fee. 20% fee of what? I have not signed a contract and I have not finalized the action to move forward with any job.This means I have no copy of the work to be completed. 12 Mar - received a letter demanding payment (20%) and a LIEN filing intimidation lettering. This is the first time I have received a photocopy of the contract that was initiated and never executed.22 Mar - I received a letter and a copy of a lien that was placed in my home.Business response

We contacted All Star Roofing in 2023 for a shingle roof replacement on our home. Before we signed contract All Stat Roofing offered a $500 dollar gift card upon completion of work and payment when the work was completed. After 8 weeks I tried to contact the salesperson (*****) by phone and texting about the $500 gift card. ***** finally contacted us stating he would speak to his supervisor, and President of All Star Roofing (****). After another 6 ******************* texted saying offer had expired, then offering half of the $500 gift card and not until end of the second quarter of 2024. I replied that this was not what was offered and now nearly 6 months has past. The president of All Star Roofing (****) has texted not to contact him or his business.Business response

Mr. ******** roof was installed past the promotional period to qualify for the $ ****** gift card. After relentless texts and messages from Mr. ********, Allstar agreed to consider it for the next quarters promotion. Mr.******** continued his relentless harassment when we agreed to meet him halfway and accept $ ****** gift card. He refused and has continues to harrass Allstar, culminating in this complaint. The present offer of a $ ****** gift card still stands for him to accept.Customer response

I am rejecting this response because:
Allstar Construction & Roofing representative, *****, who is employed by ****, validated the promotion when contract was signed, and did not state promotion of the $500 gift card had expired, had we had known of the expiration of the promotion we may not have considered All Star for the shingle replacement. I believe the promotion of $500 gift card, as stated by the representative of All Star Roofing should be respected.In regard to the "relentless texts and messages", by **** in his response to complaint. I had attempted to contact his salesperson after many weeks and months had pasted to address this issue, of the promised Gift Card of $500, but to no avail the representative then redirected me to his supervisor, president of All Star.
The last text, dated Feb 9 he stated, "send one more message or contact us again you will not receive one split dime".
Also, in his response dated Feb 13 he says, "continues to harass All Star", **** is not forthcoming. Since contacting Better Business Bureau on Feb 10 I have not contacted, emailed or texted ****. Why would he say this!
I would like to know why the All-Star representative offered the $500 gift card and with ***** knowledge.

THE business did not a good faith effort to resolve the issue. I do not feel I should be pressured into half of the $500 gift card offered. Would anyone buy a car with only two tires.
Plain and simple, he made the offer of a $500 gift card, did not honor his advertisement and a fact that his representative relayed the offer at the time the contract was signed. Is a contract not a contract binding?
I do not know if All Star Roofing has not provided any documentation the offer had expired at the time the offer was given. His sales representation had confirmed it was valid at that time and questions why the president did not honor It.
City Planning and Inspections has found several discrepancies and has required All Star Roofing to correct the discrepancies and resubmit the required inspection.

Hired this company to remedy a roof leak that was causing internal damage to my home. After the roof was replaced, after the first rain, the roof not only leaked - it leaked more than before. Since, we have had quite a bit of rain and the rain water is coming through and running through the walls again. I have contacted the company and they sent someone back out on one occasion to fix the "patch" of the roof (that area was patched before and should of never been repatched - it should of been completely replaced - this is the crux of the problem). The patch failed, the water pours in. We contacted them again advising that the leak is worse and sent video and expressed concerns that the drywall repair paid from by our insurance is going to be damaged again due to recurrence of the same problem that lead us to seeking remedy of the issue. They continue to promise to send someone out, but never do, nor call again unless we contact them. This has gone on too long and I can tell now that they never intend to remedy the failure of their craft and 1,000s of dollars later, our problem is literally WORSE than what we started with. We are laying a tarp on our roof when it rains to try and mitigate as much water damage as we can, but the water still gets in. This is my last ditch effort before seeking civil remedies. I have contacted another roofing company to provide an estimate for repair in preparation for a civil suit. My preference is to have them EARN the money they made, however. I am beyond upset with them at this point.Business response

On March 17, 2021 All Star roofing started my roof and i was leaving out to town that very same day, so I gave the remaining balance to a friend to pay the amount in full. On the contract, i was promised a $500 Visa card for my business. Well, I asked the sale rep, ******** if i could just take the $500 off the total and just pay $4300 instead of $4800. I did not receive an answer until the day i left, March 17, 2021. The day i left is the same day that they finished the roof. They started on March 17 and finished on the same day. The roof was supposed to take 2-3 days to complete, that i why i gave the check to my friend to pay them in my absence. Since i had wrote the check and was not in town, i told ******** that i had wrote the check and was out of town, and that they can send me the $500 back. **** the owner picked up the check for $4800 on March 17, 2021. On May 4, i texted ******** to let her know i had not received the $500 and that i had spoke to **** on April 17, 2021. I send her my address to send the check. i was promised on that the check would be send by the end of the week, which fit was not. On May 6, 2021, ******** texted me that the check will be sent out the next week. On June 9, I texted ******** to let her know i still have not received my check. On June 17, She texted me to say the manager said the check would be sent out next week. Texted ******** that i still had not receive money (July 1, 2021) On or about July 2-3, i posted a review on Google about the money. On July 6, I called the office and they told me that they could not speak to me about the matte. On July 7, I spoke with office and they stated that the only way i could get my money was if I removed my review and signed documentation . I have attached documentation. I never signed or removed review and i have still have not received my money as of January 10, 2022. I have attached all emails and text messages.
