      Company: Legacy Construction Contractor they sent to do the work ********* Construction in Chaparral NM Deposit paid ******* Name of person at Legacy: Emiliano (owner) and *********************************** was the salesperson I hired a contractor (LEGACY CONSTRUCTION) to redo the roof. I checked the license website and it showed ****************** was licensed. The day they came to start the work, the workers that came identified themselves as ******* Construction. They came in like a whirlwind. I told them to stop when I saw they were not removing the wet rotten wood. ******* told me it would make the roof stronger. The work done was not done per contract. The old and wet wood was to be removed. It was not. They also did not install the 14 inch turbines. They installed 12 inch turbines. I have attached a photo as proof of the 7/16 OSB installed. It was agreed per email and contract that it was suppose to be 1/2 inch OSB. In addition, to breaching the contract, the workers did work that does not meet the manufacturers written standards. In fact the wood soffit underneath the roof overhang is falling off because the wrong nails were used as per manufacturer. Also, their own Legacy painters refused to paint the bare wood because they said they did not want to be responsible for the work that had been done. I did my due diligence in hiring Legacy and they defrauded me by sending an unlicensed contractor. They also wired the air conditioner wrong and it caused a loud bang sound when ** was turned on. ********* father shorted the electrical wires when they put it back after removing the ** to lay down the roof tiles. I was also suppose to get a warranty on the roofing materials but that could not happen because after I saw the work they did, I told ***** (over the phone) I wanted it corrected or they were not getting the rest of the money. Legacy then threatened me with a lien.

      I am not working with an attorney. Legacy knows that too. I am attaching proof of that. The relationship ended way before June when Legacy insisted on gagging me. I am asking for my deposit back without being gagged. Why should I be gagged to get my own money back which Legacy chose to misuse to purchase supplies not on the contract? Legacy did not want me to say anything to anyone about the work they did on the roof.  Legacy did not want me to write online reviews on any platforms like ****** reviews about the work. Legacy did not want me to tell anyone around me about the work. Legacy is a company that cheated us. The proof is obvious. How many people can go up to the roof and check the work they are doing? How many contracts have they used thinner cheaper priced material not indicated in the contract? They used air turbines they already had in the office instead of ordering the proper size the consumer wanted. They wanted to benefit themselves and optimize their pocket. Simply, Legacy breached the contract. Legacys actions tell me they feel they are a giant coming against a small consumer therefore they can continue doing this to us. Legacy is a rip-off company. Legacy threatened me with a lien. This is how monstrous they are and how much they believe they can continue to perform in such an unscrupulous manner.
      One more very important thing is that safety is not one thing Legacy practices. Why is that stated? Legacy and their unlicensed partner also know that when nails without a head overdriven on a heavy soffit plank, eventually it will fall because they have nothing to hold it. The soffit will eventually fall to the ground and hit someone on the head. Legacys painters who came to paint refused to paint the work because they said they did not want to be held responsible for the work done peripherally.
      I still believe I should get the $ ******* deposit back and feel free to tell anyone about Legacy if they happen to ask if I would recommend them. It is the hard-earned money I saved to have the roof replaced. Legacy chose to misuse the deposit money.

       These are photos of Legacy's work.

      Roof: The wet rotted roof was not removed. Legacy was supposed to remove the old OSB and replace it with new 1/2 OSB. Instead, Legacy put new wood on top of the wet wood. 

      Legacy (I showed ***** from Legacy) was shown the wet ceiling in the bedroom. The roof had been leaking water into the bedroom.

      Soffit: Currently, the soffit is falling off in places and will hit someone on the head.

      Most of the nails used were impacted and the nails did not have a head. This means that the soffit will come right off as the weight of it cannot be sustained.

      These nails without a head needed to be caulked and the soffit re-nailed so the wood is properly held and secure, so it does not fall off.

      I have attached the proposed settlement agreement document and letter from Legacy's attorney to ********* attorney.  ****************** refused to accept the offer.  The costs Legacy incurred in purchasing materials for her roof were way higher than the deposit she paid.  As to her claim of poor quality materials...we purchased the exact same roofing materials that we have purchased for the thousands of  roofs we have done in the past 18 years.  We attempted several times to go back and address/remedy her concerns but she would not allow us to do so.  

      FYI: ******************************* no longer works for Legacy.  Can you please remove his name as a contact person?

      I will accept a return of my $ ******* dollar deposit.

      Then: Legacy agreed to return the ******* deposit, but Legacy wanted me to sign a legal form to gag me. In other words. Legacy wants silence me so they can continue doing this to other people. Here I have a roof that is done wrong and without an ***** Corning warranty because of their own actions. They bought the wrong materials. They hired an unlicensed contractor. They sent painters to cover up the work. The painters ran off and did not want to be involved in the cover up.

      Now: I want them to return my money of ******* and not "gag" me. I should not have to sign a gag legal document drawn up by their lawyer in order to silence me. I want to get my money free and clear. When I contacted BBB it is what I stated in the initial form as to what I wanted: returned deposit without being gagged.

      I will take the refund of my money with no gagging. Only an unscrupulous company would expect me to shut my voice after their own intentional breach of contract. It is in black and white that they bought thinner OSB then what the customer wanted. ********************** did not follow the roofing code when it came to leaking and wet wood on the roof. How many consumers have they done this to? How many people cannot go on top of the roof to see the materials and the work they are doing?

      Legacy's obstinance and self-righteousness to want to GAG me before giving me my deposit shows how dishonest they are and ruthless they are in their business dealings. Legacy did wrong.
