We hired this roofing company and they were supposed to replace the whole roof, all the skylights, 6 total, he only replaced 4, he had to remove and replace the damaged sheetrock scrape, texture and paint inside the house, clean and remove all roofing debris from outside and all this was not done. Our cable antenna was damaged, our air conditioning was damage, our water hoses were damaged, some of my plants were damaged, my walls and patio have tar everywhere. We contacted him and he promised to go and finish the job but until this day he hasn't. We do not want him near us because he gets violent and yells at us. Very unrespectful. He never provided a city permit. Always lying about it. We just want him to pay for all this unfinished job and damages. We feel that they took advantage of us since I was very sick during this time. We do not want other people to go thru this. Please help us.

      S. A. P. Construction was indeed hired to do Mr. ***** ********************* roof in which initially they were having problems with their insurance to have them pay for their complete roof. Their insurance was only paying for a repair and because of their high deductible was not enough to take care of the replacement of their roof. ****************** helped them by taking pictures and meeting with their adjuster to show them that their roof would qualify to get replaced. Then, yes, ****************** was able to help the ****** get paid to do their flat roof. Unfortunately, their first check was only $900.00 and because we've made business in the past, ****************** decided to begin their roof without any payment upfront. Permit was taken out at the time of beginning the roof as a copy has been attach. The first payment was done later when the roof had begun and without any problems was completed. Everything the insurance paid for was done with only $900.00. We never complained to finish without any further payment because we were working accordingly to their insurance. Pictures and final invoice was submitted to insurance and that was how they released their final depreciation. Then, the problem began because they got paid $13,900 as agreed upon our proposal minus their deductible. By law, homeowners have to pay their deductible, which in this case, was adjusted in return of not doing the interior repairs. Although, ****************** still manage to repair back suffid and facial at no extra cost. **************** at the time of paying the final balance refused to pay in full what the agreement and his insurance had agreed on. At no point did they ever mention that they were unsatisfied with the work whatsoever. Later, on October 28 we received the last payment on a form of a check and he signed the final invoice where it states his payments and where we gave them credit for their Deductible along with what had been done. Their insurance only paid to remove their skylights, clean them and install back. Still, S. A. P. Construction managed to remove and replace the damaged skylights. Days later, we received a phone call to go check a skylight that seemed cracked. And ****************** went and checked it out. We as a company never refused to change that skylight. The day that we had set up to change the skylight ****************** receives a text message from ***************** asking him to take the material we had left to replace the skylight. And that is what we lastly did. We never took advantage of ******************** health condition mention by them but, all we did was help them get paid what was fair for their roof and complete it. Everything was checked before signing final invoice, which is why it does not make sense to complaint weeks later in regards to this service. We have documentation where everything was done satisfactorily and even their insurance have closed this claim. In no sense or form have we refused to work with the ******, but at this point, work has been completed and from our end we do not owe anything to them. We are just pending the final inspection to be conducted from the City and this will conclude our business with Mr. ***** *****************.

      My case number is 16152540.

The contract does not mention anything in return for the deductible. This is a lie.  We never agreed to this.   Our insurance paid for the whole replacement of the roof, including the 6 skylights, and they agreed to that and the interior repairs as well.  And to the cleaning, which they never did.  We were never satisfied with their unfinished work, and they know, ****************** promised to finish it but he demanded the money, got angry, yelling inside of  our business in front of customers and we paid him because we wanted him to leave.  I called him about the broken skylights, he argued that they weren't broken and that they didn't have to be replaced.  He never showed up, but called after I had already filed the complaint, but we don't want him around because of his behavior.  We never had problems with our insurance, we were working things out and asked ****************** for an estimate that was given to me by my adjuster after my roof was approved, ****************** never gave me the estimate, he decided to take the pictures that I was supposed to send, he said he would take care of everything especially as soon as he found out we were approved.  He promised to take care of the roof and the interiors as well.  We let him because my husband was still sick.  He DID take advantage of the whole situation.   The minute we were approved he sent a notice to my insurance saying the job was completed, they called me immediately to see how that was possible, I told my adjuster they hadn't it even started.  He told me to be careful, that once they find out you are approved, they are after the money.   And not to give him anything more than the $900.00, that the roofing companies know they have to wait for payment, or you can hire another company, but we told *******, he didn't have to do the job, we had 2 other companies and were willing to do the job for less, and he begged us not to do that, he said, he would do that and more,   but this guy is a scam, you hire him and he hires other people to do the job, we were told by the guys that did the roof, ******* was never around, they rent equipment to work, they don't even have any equipment, this remodeling company is under the daughter's name which makes me wonder if ****************** had issues in the past.  We were unhappy with them since the beginning, they broke my satellite antenna, ****************** said it happens all the time, they messed up our air conditioning, we were without air or cable for days.  My house was a mess outside and inside, and ****************** said he was going to take care of everything and never did.  All we are asking is for them to take responsibility of their actions and pay us $1900.00 so we can hire someone to replace the skylights and do the interior job that was included in the contract from the insurance and this S.A.P. company.

Thank you for all your help.

This is the initial estimate the ****** had received from their insurance and send to us in regards to their property claim. This estimate would not have cover our cost and they would of had to pay out of pocket. ****************** attended a second appointment with their adjuster and was able to help them get paid $13,900.00 minus their deductible of $2,570.00, which by law has to be paid to the contractor in order for them to receive final depreciation and was not paid to us.

The ******** insurance did pay for the replacement during the second inspection in which ****************** attended and was able to help them get approved. Then, that's when the ****** agreed to proceed with the work and signed our contract for $13,900 including the deductible, in which the customer is responsible of paying. In this case, they did not pay us the deductible of $2,570.00.  The only word we received from their insurance agent was that they had approved them for the total of the contract we had submitted ($13,900) for them minus the deductible. Work was completed and pictures along with Final Invoice was submitted to their insurance on October 16, 2021. We know insurance payments take days to be send but we gave the ******** enough time for them to have checked any missing details from the day that we finished up until the day that we received the final payment. The skylights were not broken when the roof was completed, pictures of the skylights were submitted to the insurance and they never said a word about it, but agreed to send the final depreciation directly to their bank account. It took them 12 days to pay us in full and they still did not pay us the deductible and we still deducted $150.00 because of a credit they had received in the past and the insurance had deducted it from their depreciation. We have photos to proof that work was done correctly and photos of the extras which were repairing the back soffit and facial. On October 28, 2021 we received the final payment of $1,910.00 in form of a check and **************** signed the final invoice without any complaint of the clean out, the skylights, the air conditioner nor their cable not working. At no point was *********************** nor demanded money aggressively. We have never refused to take responsibility of our work, but at this time, from our end, there is nothing we owe to the ********.

I am rejecting this response because:  I don't know how many times I have to send his invoice, it it very clear, the stuff that had to be done and the replacement of the 6 skylights.  Once again, how can we be satisfied for this crappie and unfinished work?  Yes, he was paid completely, but he did not finish.  Again, the reason why he got the last payment is because yes, he was rude and aggressive, he went crazy demanding this money, I was here, my husband and a customer, there is a police report.  I have health issues and I am scared of *******************  At the previous statement he admitted everything and said there was an exchange for the deductible, which is a lie, unless he can prove it in writing, the insurance keeps the deductible he should know this.  And yes, the skylights are broken, he knows he only replaced 4.  Why did he mentioned in the first response that he went to try to replace them, he went, but after acting violent, that's why we refuse to work with him and this company has to pay for the unfinished work and the replacement of the 2 skylights as they promised since the beginning.    Once again ******************, I am providing these copies but I am delivering them in person, because I don't even know if you've seen them.

      Thank you,

      Sincerely,

      Mr. and *****************
