I hired Lawn Lab in September, 2022 for weed control in my yard. They regularly serviced lawn with preemergent and broadleaf weed killer (2, 4D). In late winter and early spring St. Augustine grass was showing signs of damage and being dead. For weeks and months Lawn Lab blamed it on freeze damage. Neighbors lawns with ************* had no signs of freeze damage. The portion of my lawn that did not receive Lawn Lab service had and has no signs of freeze damage. Lawn Lab treated my next door neighbors yard for weed control and killed all her St. Augustine grass also. *** warned me to resod my yard or I would be fined. I hired someone to resod and it cost me $1700. Next door neighbor and I have worked tirelessly with Lawn Lab with no positive results. They sent me a check for a refund for my service fee - $314.00 but steadfastly refuse to pay me for the damage done to my St. Augustine grass.

We treated the customers lawn several times over the course of the 6 or so months she was with us. The lawn was fine in January/February, just dormant. After a hard freeze in February, the lawn was damaged. We had a tissue sample sent off and analyzed from the lawn in question. It showed that there was no trace of any 2-4D chemical in the lawn. The lawn was damaged by the extreme freeze and because of an abundance of shade, it was unable to recover as hoped. We refunded the customers entire year payment, but because the tissue tests that she demanded showed it wasn't our chemical that did the damage, we did not feel that it was our responsibility to replace the lawn.

I am rejecting this response because:   Lawn Labs claim that my St. Augustine grass was damaged by freeze and shade tree is totally false. By researching on the internet, I found the following information from the ***** ******************************* St Augustine grass, as well as centipede grass, are sensitive to certain chemicals found in popular herbicides such as 2,4-D, dicamba, MCPP and MSMA.  These active ingredients will actually damage your St. Augustine grass lawn. Lawn Lab should have known this and avoided using the herbicide 2,4-D on my St. Augustine grass. However, 9/15/2022, broadleaf and grassy weed control (2,4-D) was applied to lawn; 10/19/2022 broadleaf and grassy weed control (2,4-D) was applied to lawn; 11/29/2022 serviced lawn with fall pre-emergent with broadleaf weed control (2,4-D); 1/11/2023 serviced with pre-emergent and post-emergent for broadleaf weed control. 3/18/2023 treatment was pre-emergent and broadleaf weed control; 4/28/2023 grass stimulator was used as Lawn Lab could see that grass was totally dead.  Not from freeze damage. My nextdoor neighbor also had her St. Augustine grass killed by Lawn Lab using the wrong chemicals on her yard. All other yards in my neighborhood with St. Augustine grass had grass growing and looking healthy in early spring, 2023.  I have pictures and information proving that my dead grass was not the result of freeze damage or my shade tree.

On 5/26/2023 a service call was made by Lawn Lab to collect a grass sample for a lab analysis. I did not make this request. They were only trying to cover their incompetence. Waypoint Analytical Lab analyzed the grass sample on 6/11/2023.  Result showed a minute amount of the weed killer 2,4-D. Even though Waypoint would not give me any lab results due to privacy concerns, a friend was able to read the report and discern that there was, in fact, some 2,4-D in the grass sample.  Enough time had elapsed from discontinuing weed killer treatments until testing that the weed killer would have dissipated.
My prepayment fee of $314.72 for lawn care/weed control was recently refunded by Lawn Lab.  My fee to a lawn care provider to have my lawn resodded due to Lawn Labs incompetence was $1,700.00.

The tissue sample was done because it was demanded by the homeowner. They refused to believe that the harsh freeze could damage the lawn. So, we had the tests done as requested, and, I'm sorry to say, whoever is interpreting the results for them, is doing so inaccurately. The test shows that there was less than the smallest amount that they are able to test for, meaning 0. I offered the phone number of the company that performed the test so that they could get clarity, but it seems as though they were never contacted. There we're certain times that broadleaf weed control was used on the lawn, but there are other broadleaf weed controls that are specifically designed for ************* lawns. The lawn was dormant and fine up until the freeze in February. After that is when the "damage" happened. The refund that was provided was meant to help take care of some of the cost of the resod as a goodwill gesture. I'm sorry it wasn't taken that way.

I am rejecting this response because:

After my next-door neighbors call to Lawn Lab Lawncare asking that the owner, or whoever is in charge of the company, come out and observe our lawns, Technician ************************* evidentially decided to have the grass tissue analysis done after apparently becoming concerned that our dispute was going to end up in court. Even though the request was made by my neighbor for someone, other than a technician, come and check our lawns, the request was not honored.  When the technician ************************* came, the neighbor was told that the companys president or owner wouldnt know or would not be knowledgeable regarding the issue.  He also told my neighbor that the company has insurance coverage.  If that was true information, then why has the company neglected to file an insurance claim to cover the damage that was done by Lawn Lab to our lawns.
Why does ************************* continue to erroneously claim that our grass was killed by freeze damage?  I have had more than one person in this neighborhood say to me that if this dispute were to go to small claims court, they would gladly be a witness to the fact that my grass was not killed by the February freeze.
As I have previously stated regarding the grass tissue analysis,I did contact Waypoint Analytical, and they could not discuss the test results due to privacy concerns.  Lawn Lab DID NOT use the broadleaf weed control specifically designed to use on St.Augustine grass.  Otherwise, St.Augustine grass in both yards (neighbors and mine) would not have been totally killed. Clearly the broadleaf weed control (2,4-D) designed to use on ******* grass and NOT ************* was used on both ******* and St. Augustine grass growing in our yards.
The companys choosing to ignore the fact that they made a damaging mistake and choosing to continue with false claims is incomprehensible. A very unreliable company!

I contacted LawnLab last year to come complete service for spraying the weeds at my home. The spray that they used was ineffective. I canceled the service. I asked them to spray for the weeds that they found they told me after 10 months of spraying the weeds that the stuff they were spraying would be ineffective. Then proceeded to tell me that I needed to purchase a different kind of spray specific for that type of weed. Another time I was told that I needed to have a years worth of spray to see a difference in the weed type. Regardless, the company lied to me from the start. They said that the original spray that they would utilize would be sufficient. Then 6 months later entrapped me by telling me the spray was ineffective due to needing a different more expensive spray. I have seen no change in the lawn since they sprayed. I am not satisfied with their way of handling the situation. It seems as though it was a total scam in my opinion. Additionally, the last time the lawn lab technician came by my neighbor told me that they sprayed the wrong yard. I have facebook messages from my neighbor verifying this information.
