    Federal Trade Commission v. FIRST AMERICAN PAYMENT SYSTEMS, LP, a limited partnership, also d/b/a/ MERIMAC CAPITAL, ELIOT MANAGEMENT GROUP, LLC, a limited liability company, also d/b/a SUNDANCE PAYMENT SOLITIONS, and THINK POINT FINANCIAL, LLC, a limited liability company, also d/b/a CYPRESS BAY SOLUTIONS and IMPULSE PAYMENTS

    The following describes a government action that has been resolved by either a settlement or decision by a court or administrative agency.  If the matter is being appealed, it will be noted below.

    On March 8, 2023, Think Point Financial, LLC, a limited partnership, also First American Payment Systems, LP, a limited partnership, also d/b/a Merimac Capital, Eliot Management Group, LLC, a limited liability company, also d/b/a Sundance Payment Solutions, and Think Point Financial, LLC, a limited liability company, also d/b/a Cypress Bay Solutions and Impulse Payments entered into a Second Amended Stipulated Order for Permanent Injunction, Monetary Judgment, and other relief with the Federal Trade Commission with the United States District Court Eastern District of Texas Sherman Division.

    The Court found the Defendants participated in deceptive and unfair acts or practices in violation of the Federal Trade Commission Act and Section 4 of the Restore Online Shoppers’ Confidence Act.

    It is ordered that the Defendants, Defendants’ officers, agents, employees and attorneys, and all other persons in active participation are permanently restrained and enjoined from misrepresenting or assisting the conditions for cancellation of goods or services provided, can be cancelled during an initial trial period with no penalty, can be cancelled prior to the end of a written agreement term with no penalty or can be cancelled at any time with no penalty. Cannot misrepresent the fees for the goods or services, such as monthly fees, the amount of savings using the good or service or any other fact material to Merchants concerning the good or service including the total costs, any material restrictions, limitations, or conditions of its performance, efficacy, nature or central characteristics.

    Furthermore it is ordered making or assisting others making, representing the amount of savings realized from using their good or service, unless the representation is not misleading meaning at the time of such representation they must rely upon and posses reasonable basis for the representation.

    Furthermore it is ordered that the business are prohibited against unfair debiting practices, prohibited against misrepresentations related to negative options-requiring disclosures relating to negative option features, obtaining express informed consent for a negative option, provide a simple mechanism to cancel negative option feature and maintain a compliance program by reporting submissions to the Commission and create records for 10 years after entry of the Order and retain records for 5 years.

      During the summer of 2021, I started experience problems with the equipment Cypress Bay Solutions (CBS) provided and I needed help from the customer service department. I could not get in contact with anyone from CBS after several days so I finally searched online for an alternative number only to find out that the company was listed as permanently closed. Because I did not want to be left without a credit card processing company, I scrambled to find another company to process credit card payments for me. After several weeks had passed, I reached back out to CBS to learn that a third party customer service department was handling their inbound calls. The third party customer service department had someone from CBS reach out to me named ******** offering to help me but I told her that because I could not reach anyone with the company I already signed with someone else. ******** then informed me that I could end my contract with CBS by buying out the remainder of the contract which I considered unreasonable because I only signed with anther company because I could not reach CBS and online they reported they were closed. ******** then told me to pay ***** per month until the contract expired but it turned out that I was paying over 100 a month without processing any payments with CBS. I emailed ******** several times asking her to have someone from CBS management to call me so I can discuss but no one has called me. The customer service department has sent in several request on my behalf also with all of them going unanswered. Finally I put a stop payment on my account after two to three months of paying with no services and no response and then someone from collections calls me on behalf of CBS. I asked the representative of the collections company to please have someone from CBS to call me but the representative was rude and refused to listen to anything I had to say because she only wanted payment.

      ********************* your account is automatically renewed without your knowledge until you decide to cancel. I cant count to the countless times Ive had issues with funds being deposited along with equipment failure ????. Your charged a ****** cancellation fee only to find out your actually being charge ****** for cancellations. What a total ripoff. I wouldnt recommend this company to a ***** !!!! My first time in history writing a horrible review. ABSOLUTELY ******. The only reason I gave it a one star, is because this is the only way I could write a review, otherwise I wouldnt give them SH#T.
