Cannot get ahold of Rock Creek Capital, LLC. I have tried calling, left messages and emailed them with no response. They have filed a suit against me, yet I have not been served or contacted by them. This appears to be fraudulent and I am looking into my legal options.Business response

Rock Creek Capital, LLC "Rock Creek" is a passive debt buyer and all of the accounts are worked by third party collection agencies and attorneys. Messages were received by Rock Creek and forwarded to the law firm handling ********************** account. I have spoken with our law firm and they have been in touch with the ****************** since this message was received. We will assume this matter is closed with the BBB, if you need anything further please let us know.

I am rejecting this response because:
The attorney was in contact with me one time. I have called back over 30 times in the matter of a week and a half and he will not return my call. I am attempting to make a payment plan with his client but it seems he is not adtiquitly representing his client at all and will not return my call in order to set something up. He told me he would get back with me after speaking to his client and nothing Ive called and left multiple messages talked to multiple colleagues of his they have emailed him And he will not return a call to his name is ************************* with **** and ******** law firm.*** I have payment today *** I just need him to call me back and set up an arrangement

Rock Creek Capital, LLC "Rock Creek" acquired this loan via a loan purchase agreement. Rock Creek does not directly report to any credit bureaus but some of our 3rd party agencies have the ability to report should they choose to do so. We have reviewed the account and supporting documentation, the debt is due and owing to Rock Creek. Should you need anything further please let us know.

Where they received *** payments in my name way out in *****. Please take notice on a informal investigation. Just because they verify information under my name doesn't state I provided any of my personal income to this company. Inever received any notice by mail or any debt collectors agencies only way I noticed when I checked my credit.Business response

The original commercial installment agreement was with HBR ***************** signed on 3-17-16 and financed by Freedom Trucking. In addition to the copies of the contract there are copies of the borrower's commercial drivers license, social security card, and a copy of a voided check for ******* Highway Freightlines, LLC. There are also copies of paperwork for a borrower dispute, dated 9-16-18, from ****************** along with a response from Freedom Trucking dated 9-24-18 stating that there is no evidence to make changes to the reporting on the account. The account was sold to Rock Creek Capital, LLC on 2-1-21 and no payments have been received during that time and the balance is believed to be due and owing from the borrower.Initial Complaint

Rock Creek Capital LLC. Is practicing predatory and fraudulent collections practices. They have enlisted RPM to collect an erroneous and fraudulent debt that they have added to my credit report without any attempt to notify me of the fraudulent debt. In addition, they have not provided any valid proof to substantiate their abusive and malicious tactic to try and destroy my credit. They have not provided any dates for which the debt occurred; nor any type of agreement or authorization of such debt. Where is my signature? What is this for? When did it occur? They are in direct violation of Fair Debt Collection Practices Act (or FDCPA) and the Fair Credit Reporting Act (or FCRA) so I will be filling a complaint and will be seeking financial restitution for the credit harm this company has imposed on me and my financial well-being.Initial Complaint

I participated in the Uber Xchange Leasing Program starting in 2016 by leasing a ****** Corolla. The Xchange Leasing portfolio was originally purchased by Fair and I returned the vehicle I leased to Fair in February of 2019. After my return, I was never notified by Fair of any outstanding balances owed on the vehicle. I confirmed with Fair that they never determined anything was owed on the vehicle. More than 2 years after I returned the vehicle, the portfolio was again sold to Rock Creek Capital, LLC. Rock Creek Capital, LLC apparently decided after the acquisition that I still owed $401 on the lease. I never received any notification or explanation from Rock Creek Capital regarding the amount owed. They then apparently just decided to forward the outstanding amount to a collections agency, ********************************** LLC. I never received any written correspondence or phone calls from RPM. I just received an alert of negative activity on my credit score due to this amount despite never receiving any correspondence from either entity regarding this amount. I have attempted to contact Rock Creek multiple times regarding this. They do not answer phone calls and have not replied to my emails. I would like the amount of $401 to either be explained or refunded and my credit report to be corrected. They have my SSN so I am absolutely certain correct address and phone information could have been optained if any effort had been put in whatsoever.Business response

Thank you for following up with us, the account was reviewed internally and we confirmed that the balance that was sold to Rock Creek Capital, LLC. In addition, we followed up with the original creditor who performed an audit of the account and came back to us that the balance sold was incorrect and it should be a zero balance account. We have contacted our agency, RPM, and have them close the account out with a zero balance and remove any credit reporting from this account. Should you need anything further from us please let us know.
