  Contract to remodel our backyard was signed with ************************* on or about December 27th, 2021 (copy enclosed).  Specific items included:  adding steps into backyard, pouring a small concrete pad to side of driveway, removing an older fence, and installing two new gates to access the backyard, among other items.
  
  Unfortunately,much of the work was substandard.  Defective work includes, but is not limited to, the following:
  
  1. Contractor failed to follow proper construction practice.  Despite repeated guidance that he MUST maintain a 6" of uncovered area along the entire foundation perimeter, contractor filled backyard areas to the point where in many areas the entire foundation is covered, to include weep holes at bottom of the masonry walls.
  2. Failed to leave hot water heater drain pan drains exposed/usable.  Drain ***** were buried underground which precludes any ability to drain.
  3. Failed to secure irrigation system pipes.  When the backyard sprinklers run water floods into the garage via the garage walls.
  4. Failed to properly install gate latch assemblies.  East gate latch is attached to neighbor's fence, and also fails to secure gate as it was not secured to a door brace.
  5. Failed to properly prepare and construct driveway side pad.  Pad failed within months of installation and is now completely broken up.
  6. Failed to properly construct rain barrel water retention support platform.  Water flows off of the south side of unit, completely bypassing drain trough and scupper/collector.
  7.  Failed to install a proper drain collector at rain barrel water collection area.  Standing water in collection box allows mosquitos to breed with abandon.
  8. Failed to properly size rain water drain system.  Heavy rains overwhelm drainage system and cause water to back up into backyard.
  9. Failed to properly pack fill along retention wall.  Retention wall fill has significant areas of fill collapse.
  10. Failed to ensure sprinkler irrigation system operation was nominal resulting in death of most of the backyard grass (and flooding of the garage as noted above).
  
  Remediation
  Previous requests for warranty repairs (via text message) resulted in a call from the ******************************** with contractor complaints of "harassment."  Given the contractor's work performance and previous criminal history, our preference would be to secure a full refund of the total sum paid (estimated at $)so that we may have another contractor re-do the work properly.
