      **************,

We hear and understand your frustration with this situation and apologize for any inconvenience this might have caused you. On October 18th we scheduled a walkthrough of your home with the city inspector, which you were made aware of. Our managers walked the property with the inspector for a second time and he agreed that the roof was in fact installed properly but wanted to gain access to the attic to inspect the decking from the inside as well. That is all that we are lacking to make sure that your roof is up to building code standards at this point. Since then we have made multiple honest attempts to schedule the completion of the final inspection with you as well as complete some final touch *** on the flashing that we noticed while walking the property with the inspector but we have been met with nothing but hostility on your part. Finally, you texted our manager back and told us that you will not allow us back on your property and you will also not be paying us the significant balance due on this project. We are available anytime to complete the work on your property we will just need your cooperation on this matter to do so. Please give us a call and we will happily come out and address the above issues as soon as possible.

      Thank you,

On April 3, 2023, certified letters and emails from my attorney were sent to Felix Salinas, President of Excel Construction Group and three staff members, *********************, Sales, *************************, Construction Supervisor and *********************, Consultant Manager for the roofing division. The letter's purpose was to void a repair contract between myself and Excel for the following reasons. First, the contract violated provisions of Section ***** (b) of the Texas ******************* Code. The code addresses required payment of insurance deductibles. On Feb. 2, 2023 I commented to ********************* any insurance payout was unlikely due to the high deductible. ************ verbally implied there are ways they could work around the deductible. Secondly, and also on Feb. 2, 2023, ********************* verbally misrepresented a document, submitted for my signature on a notebook computer giving Excel exclusive right to performing a roof replacement, as an agreement by me to not share photos or information gathered by Excel staff with a competitor. Third, my requests for a cost estimate made to Excel staff on Feb. 17, 2023, March 29, 2023 and March 30, ******************************************************************************************************************** their repair procedure. Fourth, on April 13, 2023 my attorney, ***********************, spoke with Excel salesperson *********************. ************ indicated she was instructed not to speak with **************** and someone would be reaching out to ****************. On April 18, 2023 **************** followed up that conversation with an email to Felix Salinas, *********************, ************************* and ********************* which read " All, I recently spoke with ************ and she indicated someone would be contacting me. Please advise by the end of the day whether an authorized person from Excel will be contacting me with its position on voiding the contract." To date, no one from Excel or an authorized representative have responded to ****************.

Excel Construction Group strives to always meet or exceed our customers expectations. Unfortunately, sometimes that is harder said than done, as is the case here.  Excel honors it contractual obligations and has at all times remained ready, willing and able to perform the repair work needed at this commercial property. Excel denies that it sought to collude with the property owner to avoid paying her deductible, that the statutory ***** warning was not included in the contract, or that no contact regarding the property owners concerns has been made. Excel has attempted to move this project forward with the property owner, still remains willing to do so, and invites further communication with the property owner with that goal in mind.

      Complaint: 20011185

I am rejecting this response because: I reviewed the long delayed reply from Excel to my BBB complaint submitted on May 2, 2023.  The response is self-serving and does not address the concerns I raised.

Among other concerns their salesperson, *********************, lead me to understand Excel could work around  my deductible concerns (in violation of Section 27.02(b) of the Texas Business & Commerce Code).   ************ also misrepresented the document itself that they were asking me to sign, indicating that it was simply an agreement that I would not share photos that Excel had taken. Excel also failed to provide costs estimates despite my requests and its website advertising that it provides free estimates.

Several other consumers have complaints about the quality of Excels work. These complaints along with my concern for some business practices of the company further diminish my confidence in Excel. Excel represented that the building required they scarify and replace the existing roof with new. Other roofers have advised me that the roof does not need replacement. Last, Excel is asking for an excessive cancellation fee which I find to be unconscionable.  See attached email.

      Thank you.

You signed a contract with Excel Construction Group, which is a very simple one page agreement, after which Excel put a lot of time, effort, money and resources going back and forth to your property to meet with you, take pictures etc. We did so in exchange for your promise that Excel would be your contractor for all repairs. Relying on that promise, our Project Manager walked the property with your insurance adjuster who confirmed that the roof was damaged. It was only after the adjusters visit that you started to backtrack on that promise. The sales consultant did not agree to waive your deductible or act in any way contrary to the law. In fact, the contract you signed clearly says that Texas Law requires an insured to pay their deductible, which Excel requires on all its sales. Excel is not perfect no company is but has a great reputation because we take pride in our work and strive to ensure that every customer experience is a positive one.

In April of 2022, I entered a contract with Excel Construction group/ solar division to put solar panels on my house in ********, **. The Ramseys (agents of Excel construction) are the ones that were the salesman and contact persons. In May, I adjusted the contract to include a Tesla PowerWall for energy storage. At some point, the Ramseys were let go by the company and ******************** became my contact person. Because it had been so long, and the financing lender timeframe ran out, *** had me do another contract in Sept. Installation of the panels was still not completed or even close. I was met with excuse after excuse for why it was not progressing. In October, ******* told me that I should drop the PowerWall because I would lose my interest rate if I waited. I did that with the information that they would be receiving PowerWalls in January. Installation was still not completed with more excuses given. As of today, they have finally completed the panel installation but can now not get city inspection done. It failed once over a month ago and they have done nothing to remedy the reason for the failure, and they have not done nothing of any kind since then. I spoke with the electrician and he says its ********************* issue and ******************** says its the electricians issue. All I know is that it is not my fault. At this point, I have an expensive set of panels that are not lowering my electric bill because the inspection has to be passed before my electric company will allow me to sell energy back to them. I am paying full electricity bills and full payments for the system. This job needs to be completed with a PowerWall. Nine to ten months is completely ridiculous and I am tired of all the excuses.

      04/11/2023

      ************,

We sincerely apologize about the issues that you have had regarding your solar panel install. Unfortunately, the **************** has very extensive regulation regarding solar panel installs in that area and we had trouble navigating around all of their requirements. By the time *** inherited this job from the previous consultants that you signed your initial contract with we were already on a time crunch and ***** was almost a year out on delivering Power Walls which is why we discussed with you dropping the Power Wall in order to keep your current interest rate. This was not something that we had anticipated happening beforehand and we apologize for that as well. We sent *************** from **********, Texas to complete the electrical portion and he didnt anticipate the 7 Inspection process so he had to make multiple trips in order to complete each inspection step and he also works out in ******* so navigating around his schedule added to the time frame it took to complete the job. We wanted him to do the install so that we could insure that it was done correctly. As of a few weeks ago I received confirmation that the install was complete and the system had been issued Permission To Operate. The system is operating as discussed in the contract at this time. If you have any issues please contact our corporate office ************ as this will be the best way to reach a member of our upper management team.

I am rejecting this response because: My original contract included a Power Wall and I was told they would be available in January. April 14 and I still do not have one. Because I was talked out of leaving it in the renewed contract on the word of ************ that they would have some in January. I realize some things may be out of excel control, I have heard nothing over last 4 months as to the status.

On March 5, 2022 we hired Excel Construction Group to replace our roof windows and screens. On March 9th, 2022 a payment of $3703.63 was given to ***********************, sales representative. On March 16, I sent text message to ***** asking when will they start the roof job. He said Excel was waiting on a supplemental scope from my insurance for the windows. I have documented and saved all text messages and voicemails. The roofers started the job on Friday March 25. They hit our basketball ball goal and broke the cemented metal pole in in half. They did not return until Monday, 28th leaving half of the roof covered in plastic. At this time, we pointed out problems with the shingles not laying flat and poor workmanship on the chimney flashing. We were told they would be back to fix the issues. Over a two month period we were given excuse after excuse for not completing the job and repairs to the roof being done. Plus, we now had a broken basketball goal laying in the yard. On May 27th, two months later Excel finally replaced the basketball goal. I started getting phone calls from ********* and ****** demanding payment saying all work had been repaired and completed I have a voicemail to verify. NO ONE came to my home to repair anything and my windows were never done. I was also sent a demand letter and an invoice different from the invoice I have but, with the same invoice number. On October 5, I had another roofing company come to see the condition of the roof. I sent the pictures Excel. She sent ************************* with Excel and the roofer who did the job. She told me they would schedule a day for all the repairs. While we were out of state and with no one from Excel on site or afterwards to approve the work, repairs were made even worse than before. On November 7th I talked with ********* asking for payment. I asked for ***** and was told she doesnt work there anymore but, would have her call me. As of Nov 15th Ive still not heard from anyone. ******** was paid to Excel.

Hello,I am a customer of ********************** now unfortunately going on over 2 years. My home was damaged from the Derecho storm in ************, **** on August 10th, 2020. My home sustained roughly $40,000-$50,000 in damages (windows, roof, siding, doors, rain gutters, and more). I sought out for a company to take care of these damages. Excel construction group's location in ************, **** was the contractor company I was referred to. I signed a contingency form with this company on September 27th, 2020. I have a more thorough timeline of issues typed up. I need to summarize to fulfill the limitation of ***** characters for this complaint. This company has fired, and had employees leave several times over the course of two years. They have not notified me leaving me waiting months for replies. One of their employees ordered my 15 windows and said I would need to wait 6 months or so. I waited 7 or 8 months just to find out the person I spoke to got fired and never actually ordered them setting me back that long. This company attempted to have me pick out a vinyl siding when my insurance covered a much more expensive steel siding. They also attempted to only replace 10-15% of my soffit that was covered by insurance. I have repeatedly reminded them and this is still not completed. they installed my windows and the window seals were busted already. They waited TWO YEARS to tell me that they have determined that they CANNOT install my french door. This put me back two years of waiting when they said they would do it until just now. My experience with them has been filled with nothing but broken promises, ignored phone calls/messages, half finished work, and poorly finished work. I feel they cut corners to increase profits and pray upon ignorant customers that have grown impatient therefore accepting low quality, incomplete labor.

****************, We would like to sincerely apologize about the experience that you have had while working with the **** division of our company. We have 12 locations company-wide and nearly 200 people depend on our reputation to support them and their families. I can assure you that this is not the way that Excel typically does business. We initially mobilized to ************, **** to be of service to your community after the Derecho storm, most specifically commercially. After seeing the extent of the devastation that this storm had caused we mobilized some additional project managers from our other locations and brought on some local project managers as well to help mitigate the damage for the residential customers in ****. Unfortunately, with COVID restrictions leading to labor and shortage materials country-wide, we struggled to complete a lot of the projects that our team out there had committed to. We are finishing up now and as I understand the siding on your home has been completed and the window company is scheduled to complete the warranty install on your property this week. If there is anything additional that we are not aware of that still needs to be addressed please give us a call at our corporate office as that will be the quickest way to reach a senior member of our team. Our goal is always to help our homeowners restore their properties to pre-storm condition in as short of time as possible and through this experience we have made a lot of the necessary process changes to help insure that Excel and it's homeowners do not have to experience this type of situation moving forward. Thank you, ************************* Excel Construction Group ************

My son recently crawled up in the attic and saw many holes in the roof decking. I also had several people knock on my door and tell me that it looks like one of my roof joists had broken. It came as a surprise to me because I had just had my roof replaced in October and it was the end of June. They said they would replace any bad decking. Being a widow and older, I feel they took advantage of me. I called Excel and was told that the installer was on vacation and would be back next week and they would send him out to look into it. I called back the following week and was told he was in ******* working and he would look at it when he got back. I asked if someone else could look at it and they said that he needed to look at it. When I asked when he would be back they said they did not know. I have called repeatedly since then and they do not answer. They obviously have caller id and will not answer my number or return my calls!

First, in all my life I have never left a negative review anywhere. I have never liked the concept of using a platform to settle disagreements. However, I have no other choice. I cant seem to get anyone to call me back. The repair on my roof was incomplete and done incorrectly. I have requested assistance on numerous occasions and been told the job was done correctly. Thank had much own insurance adjuster come out and not only did they confirm the job is not adequate, they wont insure my roof in its present state. In addition they tried to scam me into paying more than my portion of insurance and tried to bully me into completing additional that work I did not originally agree to. Of course, at a higher price tag. The overall problems include a laundry list of things.
