      Negotiated and signed a contract for a few remodeling items in my house. I am new to the area. The contract was signed with MTR contractors and a deposit was sent. They rudely sent an email back saying they did not want to move forward with the project even though we have a signed contract and sent a check back with my deposit. I have not cashed this check so they still have my money. I need them to follow through with their contract. We cannot have businesses sign contracts and not follow through. Not even a phone call explaining anything. It's actually quite unbelievable.

      Business Response /* (1000, 5, 2021/12/20) */ Dear BBB: Please see MTR's response in reference to Case# XXXXXXXX: Mr. ******** and ******* were in negotiations regarding a minor remodeling project. Mr. ******** wanted to add items that were outside the quoted scope of work. When told the items were outside the scope of work and that they could be added as a work order, he stated there should be no upcharge for them and was not understanding when we told him we had to charge more for something additional he wanted. We also had a call to discuss our terms. He was unwilling to be reasonable in understanding the terms. During this conversation he made it seem like we did not know what we were talking about and was laughing at the clauses we had and the reasoning behind them. He only wanted the terms to benefit him and wanted us to pay out of pocket for his remodel if any increases in material prices beyond our control would occur. These conversations, along with misleading emails we received from him show it's best to not take on this customer in order to avoid larger problems in the future. We are allowed to pick who we work with and decided it best for our company to not work with him due to his demonstrated lack of reasonableness, due to his rude and disrespectful demeanor, and due to all the conflicts we've had prior to even having and agreed-upon contract. After these conflicts, we told him we would no longer be able to take on his project. It was clear we were not on the same page. After we told him this he continued to try to force his way into having us do his work with misleading emails. He wired the money after ******* clearly told him not to via email and after a phone call with ******** where she clearly stated that ******* was not taking his project. He additionally sent a contract signed after these conversations where we were clearly no longer in agreement. We have dated emails and detailed notes to back up the timeline of what happened and are happy to share. As well as detailed notes regarding the conversations and emails. We would not be able to take his project due to the lack of ever agreeing on the project scope, the terms of the contract, and the hostile attitude Mr. ******** has off and on. Even his complaint is misleading in stating he wants us to "finish a job" we never even began or agreed to begin. Mr. ******** has already cashed the check we promptly sent back for the money he wired after we asked him to not send so we no longer have his moneyeven though his complaint states otherwise. The facts are that if MTR did not want to do the job, why would they send a signed contract over. In addition, why would the owner not pick up the phone and speak to his potential client. These actions are rude, disrespectful and should not be tolerated under any circumstances. This is not how to treat prospective clients. No one should be able to treat others in this way. Everyone should think twice before considering hiring MTR for any remodeling jobs. From beginning to end, it was a nightmare. A very one sided contract and an owner who hides from any discussion. I pleaded to have a simple conversation yet was ignored each and every time. I did cash the refunded deposit. This in no way changes the fact that I have a signed contract from MTR. bottom line is no one can trust this company. How can you trust a company that signs a contract and still does not follow through. And a company that has an owner who ignores and is disrespectful to his prospective clients. Avoid this company like the plague. Business Response /* (4000, 11, 2022/01/04) */ ***Document Attached*** The facts are that we had not come to a complete agreement with Mr. ********. We were in the negotiation phase and we promptly decided it'd be best for our company to not take him on as a client. It became clear we were not in agreement on the terms, scope of work, or cost and as business owners it is our right to choose whom we are willing to work with. We clearly let him know on 11/19 (and multiple times after) we would not take him on as a client BEFORE he sent us any money or a signed contract. He sent the wire and a signed agreement on 11/24 again after letting him know we did not want to take on his project. We immediately refunded him a wire of $10,000 via check which he has already cashed. We respectfully ask that this complaint be removed as we never did any work for this individual as we determined he was not a good fit for our business. Thank you, MTR Contractors
