      Contract 11/16/22, total value $18,500. Deposit 50%. Added $675 for a drain. Total amount paid: $9925. Nugen walked off job after leaving tarp unsecured and causing water damage. Contract called for additional payment of 25% after "materials dropped and construction started."Nugen failed to provide materials for bulk of work (roofing plywood, underlayment, shingles, patio structure, wood, etc.) but insisted on additional payment to continue work. I insisted on either completing the roofing work started or providing full project materials to satisfy contract language prior to additional payment. Nugen failed to provide such materials, and further provided no contract revision, compensation, or remediation for water damage. Left job with unfinished roofing, exposing me to more liability/risk of damage. Nugen then walked off the job and ceased responding to communication. What work that was completed was of poor quality: Slab was poured directly atop sprinkler lines, resulting in under-slab gushing leak when sprinklers run. Drain installed backs up during rain. Nugen's subcontractor broke my gate with their bulldozer, and failed to lay any protection over the yard, destroying most of the grass and landscaping.

      As the customer mentioned he failed to make his second payment on the agreed contract, materials were drop For concrete which was completeld and for the patio. We were unable to finish the project due to his lack of cooperation during the process and it delayed our labors production. **** moved in and caused damage and we tried to cover it for him but unfortunately the weather was very severe. If he followed the contract as agreed this could have been avoided. At the end of the day we can only do so much when limited to the funds we are provided.

      Thank you for your input and we will be more cautious in the future who we do business with and set expectations as clear as possible, we clearly follow the contract.

      I am rejecting this response because:   There's so much wrong with this response I don't know where to begin. 

      First of all: The idea that the concrete constitutes "materials dropped" is ridiculous. The Deposit was nearly 10 grand, and that concrete cost approximately 3. I know this because the subcontractor they hired reached out to me a week after pouring the slab, asking for help because the check they paid him with bounced and *****'s ********************* wasn't returning his calls. He wanted my help pressuring ***** to finish paying him. He told me they owed him the full amount of concrete and installation: $3000. To this day I don't know that he ever got paid.

      Knowing that the deposit was still only partially touched, if at all, I will remind everyone that Nuben never provided materials to finish the remainder of the project. The contractor only ever brought a day's worth of materials at a time, such that the roof framing wasn't even complete by the time they walked off the job. By my estimation, only around 5K of work was ever completed, even counting cost of materials provided. 

      Furthermore, if the slab *did* constitute "materials dropped," then why didn't ***** request payment when the slab was installed in December? Why did he wait until I pressured them to resume work in February? The explanation that makes sense to me is that even ***** didn't consider the slab "materials dropped" until he spent the rest of my deposit on other projects and then realized he needed more money to finish mine. 

      But let's assume that we accept this argument for a moment and say that somehow the Deposit was spent and I got the value of that 10 grand from partial completion of the job... 

      That still doesn't account for the water damage. The weather wasn't "severe," it was a typicat ***** spring rainstorm. It was in the forecast. *****'s ******* secured a single tarp with metal-edged roofing nails, which tore through the tarp under even light winds. There's no excuse for that. I had him re-secure the tarp with screws and wood to distribute the weight, and that held up to a similar rainstorm later just fine. So the cost of the water damage (which is all I'm asking for) is still Nugen's responsibility. I gave ***** the option to resolve this damage back when it happened, and he never responded. All I want is to be maid right for his worker's negligence.

      Again, Concrete is considered material and lumber and decking were delivered which is materials, plus labor costs. Again we go by signed contract conditions and they were not fulfilled by homeowner. When contracts are not followed we do cease work thats common practice for any business.

      I am rejecting this response because:   

      Okay, fine. We'll agree to disagree on the original project scope. You got 10 grand, I got a partially-finished project. We can set aside quibbles over whether the project is "half-finished." 

      The issue here is still the water damage. Nugen left a poorly-secured tarp and needs to pay for repairs to the damage.

      Warning - please for your own sake don't make the mistake we did. We looked at these ratings and sure, the past customers here may have had great service - we were on track to have it too - but ***** disappeared halfway through our project. He pretty much stole our money and ran, and apparently has a substance abuse problem. We have reported the business to the better business bureau and terminated our contract. If he has the nerve to try and dismiss this comment try looking up his criminal record online. I have never gone to this extent to try and ensure people don't make the same mistake I did and end up losing the same thousands of dollars because of *****'s deception. To break it down - we paid 75% down and were due to pay 25% upon completion for a fence, pitching the roof of an outdoor patio, and laying some concrete. The fence was completed minus the stain, and that is when ***** went AWOL. The contractors then started invoicing ** for work that had already been done, and because of incompetency from *****'s choice in contractors we are STILL left with holes in our roof with a project that has cost us thousands of dollars more than anticipated and STILL has no end in sight. I am doing my absolute BEST to find every review platform that houses this company to ensure people know what the company has become. I'm sad we didn't see it in the great state it seemed to once be in.

      All projects were performed and the subs were transferred over directly to clients for finishing out the remainder of job due to a personal emergency situation at the company as explained. No one is a con man and this is defamation of character due to a life situation.

      I am rejecting this response because the project was not handed over - it was abandoned flat out. We have had to hire new contractors and are over $15k out of pocket. ***** disappeared with no word of warning, will not pick up our call, will not answer our texts, and has the audacity to try and claim otherwise. We will be suing.

       

      lets do the math with what we were left with

      fence - finished but unstained - $1k out of pocket

      patio concrete - $5.5k out of pocket

      patio roofing - $15k out of pocket

      patio painting - $700 out of pocket

      ***** was paid $19k to put up a **** fence. Horrendous behaviour from an horrendously immoral human.

      Engaged NuGen Contractors at the end of January 2023 for a new fence, patio remodel and concrete extension of the patio. The work started fine with the fence. When the patio was being demolished, the contractor (Billy ****, owner of NuGen Contractors) was uncommunicative since February 25, 2023. Billy remains missing. We have tried contacting Billy with no success. Further, the concrete subcontractor had already started work when Billy went missing. When the concrete pour was complete, the concrete subcontractor sent me an invoice directly, when I had already paid the quoted price to NuGen Contractors (Billy). Billy is a crook and con man. We made contact with his now ex-fiance on this matter. She stated Billy "was dealing with issues" and she has no contact with Billy. This man and his company are not to be trusted and should not be in business. Avoid at all cost or it will cost you.

      Hello, our company did start the work as described by customer and we had a personal medical emergency with the owner here and advised the client he could pay the sub contractors directly so the work continued as planned , client agreed and the contract was canceled, no additional monies were required by homeowners. The statement as provided as conman are exaggerated and frankly in accurate. All communications were provided to the customers and the sub contractors were notified.

      Contractor abandoned the job with zero communication. Had to contact his fiancé who said even they could not contact the contractor. Totally unprofessional. Also, we are out of pocket more money than quoted. Allow me to break it down. Original contract with NuGen $26,300. 75% deposit paid $19,725. Work stopped and was billed directly from one sub at $5,500 with future work at $500 to finish concrete with paint. Engaged second sub to finish the patio at $2400. Total amount we are out of pocket $28,125. So by contractor abandoning job we paid an additional $1,825. Contractor has prior legal history in Collin County. When he runs out of money he just leaves. So yes, I will stand by the comment of con artist leaving customers in the dust. This business should not be allowed to engage any customer. This is the first response from NuGen in almost a month.
