In September of 2020 ,we contracted VIP Construction, LLC to perform work to repair damages sustained from Hurricane Laura. VIP as of this date has completed 2\3 of the repairs stated on the insurance company inspection. They have been paid approximately $26,000 to date. There remains $13,000 in escrow to be paid when job is finished. VIP is now demanding $13,000 more on and above the $38,000 amount that our insurance agreed to pay. In a recent communication from Sean T*******, owner of VIP, he stated that he will not finish the job until he is paid in full. The escrow company will not release the remaining monies until job is completed. Mr. T******* is now threatening to put a lein on our premise until he is paid. We never agreed to any additional jobs beyond what the insurance agreed to pay. All we ask is ,the job to be finished, consisting of 1, replacement of kitchen window, 2. Instal!ation of skirting around the entire trailer. 3. Installation of 14x50 foot metal awning

Business Response /* (1000, 5, 2021/10/12) */ This dispute is one that will be resolved with legal representation. The project at 5000 Leon in Lake Charles has been approved for $51,441.83. The amount that has been paid to date to VIP is $26,007.64. The amount of work completed to date by VIP is $39,676.16, leaving a past due amount for work completed as $13,668.52. The remaining tasks approved by the insurance on the property to be completed are $11,762.67. We informed the insured that they were required to pay the portions of funds insurance has released for completed work. The insured informed us we are not receiving any more funds until all work is complete and that they only had roughly $13,000 owed them by the insurer. Our legal rep advised them to contact their adjuster and or lawyer to figure out where the missing funds are. The Insurance Company has confirmed they have sent all payments other than the recoverable depreciation. The Insurer informed us to contact the insured about the missing payments and to-date no other payments have been made to VIP other then then amount detailed here-in. Once we informed the insured that we cannot complete the project until the past due funds are paid, we were told they would sue us and do what they needed to get the resolution they want. The contract (attached for review) clearly states the payment terms and conditions. We have to abide by the signed contract between the two parties.
