      Atlarep is a construction company that agreed to install my pass ******* window and built-ins. Unfortunately, the contractor ******** fell ill and would not be able to come back therefore told me I would get a refund in January however has not issued a refund after multiple calls, texts and emails. They are intermitently responsive when my new contractor needed to pick up supplies but still have not issued a refund. I have attached both invoices which reflect these amounts, and feel the amount due back is #3,750. I sent them this email: "There is $887.50 for the installation of the pass ******* window and $4,560.00 for the labor portion of the built-ins. I understand that some of the labor has been done, however none of the onsite installation or painting portions of the labor are expected to be completed. Therefore, I do expect at minimum a total refund of $3,750.00. If you need to review your documents, the invoice numbers are #3748 for the pass ******* window and #3692 for the built-ins."

      Business Response /* (1000, 5, 2022/03/01) */ My Name is ******** *******, Thank you for the opportunity to respond on behalf of Atlarep Construction to this unfortunate misunderstanding. I am the fields operations manager and I was personally involved and assisted with Mrs. ******** home rehab project. Per BBB complaint case # XXXXXXXX filed on 02-16-22. We have reviewed Mrs. Mudaliars claim and have found discrepancies. The description of the claim is part of (2) separate contracts with terms and conditions that Mrs. ******** approved and signed. Although there is a credit owed to Mrs. ********, the amount is much different due to the changes, delays and schedule alterations caused by Mrs. ******** and trades hired by her. This resulted in us having to alter our schedules, procedures and finish bulk millwork offsite of which was not part or cost of the original scope of work on the contracts signed by Mrs. ********. Because of the need to accommodate Mrs. ******** changes and request to move in without allowing us to finish among other things the millwork, we had to do all the millwork offsite, therefore, the work incurred additional costs and expenses such as storage and processing fees, fuel costs, labor costs, transport and operating costs. All these expenses where not part of or included in the original scope of work as described on the contracts signed by Mrs. ********. Per our records, once we deduct all expenses incurred the credit owed to Mrs. ******** is $750.00 of which is the balance of the deposit after deducting the impact costs. these deductions are also justified and backed by the verbiage on the terms and conditions that compose the contracts signed by Mrs. ********. If needed we can provide copies of the signed contracts of which include such terms and conditions along with dated receipts, timelines and documentation that can prove no wrongdoing on behalf of Atlarep Construction. Per our final discoveries we will issue a credit check to Mrs. ******** for the amount of $750.00 of which will be placed in the mail within the next 24 hours. Kind Regards ******** ******* Consumer Response /* (3000, 7, 2022/03/07) */ (The consumer indicated he/she DID NOT accept the response from the business.) To the BBB, I do not accept Atlarep's refund of $750. I was charged a total of $9,427.93: $8,557.93 for built-ins which I still do not have (please see photos attached) and a pass ******* window installation charge of $870 which is still not installed (please see photos attached.) Window was paid for separately. I stand by my original claim of fair value amount of $3,750, which is already much less than the full value and I refuse to compromise further. Regarding Mr. *******'s claim- The original move-in date was estimated to be the second week of August even with built-ins, then after an additional month of September as a grace period given to complete secondary to delays (where I was paying both nightly rent for an AirBnB as our home was already delayed by over 6 weeks later than the date originally agreed upon and mortgage), I moved in on October 2, 2021. You will notice that the invoice was dated August 19, 2021. Facts to support my case are: 1. Built-ins: The original invoice for the built-ins #3692 is dated as deposit paid on August 19, 2021. The move-in date was October 2, 2021. Time allowed for installation of the builtins was allowed to be until the time of this complaint filed, which was February 16,2022. This is more than adequate amount of time where my home was de- prioritized, despite multiple phone calls and text messages left with with Atlarep to install the built-ins and complete the renovation as quickly as possible. Additionally, in review of the invoice you will notice there was no notification that I would be charged extra when they did not complete the installation in a timely manner. I have not signed any documents which indicate that I am willing to pay extra for delays and/or off-site construction. I am only now being notified that I am getting charged EXTRA when the company did not complete the work in a timely fashion. Also, please see attached photos which clearly show I do not have a pass ******* window or built-ins, yet I am expected to pay for the complete cost of $8,557.93 charged for the builtins. Atlarep's delays in construction cost me additional fees as well: I hired a handyman for over $3,000 to pickup materials and complete multiple additional tasks of uncompleted work and $3,000 in AirBNB bills while also paying for a mortgage due to repeatedly delayed move in dates. Now I am expected to pay for off-site construction bills that I never agreed to, especially when the move-in was on October 2, 2021 and it is now March 7, 2022. For the built-in materials which I hired someone to pick up, please see entirety of items picked up. We maintain that the delays are the responsibility of the contractor, not the client. Given the improper quality of current work and incompletion of remaining work, we believe a refund of $3,750 is more than fair. 2. Pass **** Window: Atlarep was notified that the window was delivered on December 20th. It was delivered directly to me, with no storage or additional costs incurred to them. I was charged $870 for this installation and currently do not have a window in place. Please see photos attached. Also, The refund check that was issued to Mrs. ******** Via check # 3732 in March for the amount of $750.00 was cashed on 05/07/2022.
